A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CATHEDRAL CITY ACCEPTING THE DEDICATION OF CERTAIN
REAL PROPERTY FOR PUBLIC ROAD PURPOSES FOR AN UN-
NAMED ACCESS ROAD AS DESCRIBED IN THE DECLARATIONS OF
DEDICATION RECORDED ON FEBRUARY 3, 1982, AS
INSTRUMENTS NO. 20498 AND 20500, AND DESCRIBED AS LOT "F"
OFFERED FOR DEDICATION ON THE MAP OF PARCEL MAP NO.
30726, FILED IN PARCEL MAP BOOK 243, AT PAGES 96, 97 AND 98,
ALL IN OFFICIAL RECORDS OF RIVERSIDE COUNTY, CALIFORNIA
AND ACCEPTING SAME INTO THE CITY MAINTAINED STREET
SYSTEM SUBJECT TO THEIR IMPROVEMENT PURSUANT TO
STREETS AND HIGHWAYS CODE SECTION 1806.
WHEREAS, in connection with the development of property on the west side of
Date Palm Drive and south of Varner Road, certain Declarations of Dedication were
executed and recorded for the dedication of real property for public road purposes and
public utility purposes described as follows:
The South 40 feet of the West half of the Southwest quarter of the
Southeast quarter of Section 33, Township 3 South, 5 East, San
Bernardino Meridian and the South 40 feet of the West half of the
Southeast quarter of the Southwest quarter of said Section 33, as
described in the Declaration of Dedication recorded on February 3, 1982,
as Instrument No. 20498, in Official Records of Riverside County
(Assessor Parcels 660-390-006 and 012); and
The South 40 feet of the East half of the Southeast quarter of the
Southwest quarter of Section 33, Township 3 South, 5 East, San
Bernardino Meridian as described in the Declaration of Dedication
recorded on February 3, 1982, as Instrument No. 20500, in Official
Records of riverside County (Assessor Parcel 660-390-007); and
Lot "F", a 40-foot-wide access road offered as an easement for public
street and public utility purposes as shown on Parcel Map No. 30726,
recorded in Parcel Map Book 243, at Pages 96, 97 and 98, in Official
Records of Riverside County (Assessor Parcel 659-270-005, 006, 007 and
008); and
WHEREAS, the above-described Declarations of Dedication were located within
unincorporated areas of Riverside County at the time of their recordation, and were not
accepted by the County of Riverside, nor were they accepted into the County
maintained street system, and subsequent to the annexation of this area into the City of
Cathedral City, were not accepted by the City nor were they accepted into the City
maintained street system; and
WHEREAS, at the time of the approval of the final map of Parcel Map No. 30726,
the offer of dedication of Lot "F" was rejected by the City Council of the City of Cathedral
City; and
WHEREAS, upon incorporation, the City of Cathedral City became the successor
in interest to the above-described Declarations of Dedication; and
WHEREAS, in order to provide public access to the undeveloped lands west of
Date Palm Drive and to facilitate access for the construction, use and maintenance of a
reservoir for the benefit of the community, it is now in the best public interest to formally
accept the above described Declarations of Dedication and to rescind the prior rejection
of the offer of dedication of said Lot "F" and to now accept Lot "F", and to accept them
into the City maintained street system subject to the improvement of the access road.
NOW, THEREFORE, BE IT RESOLVED, DETERMINED, AND ORDERED BY THE
CITY COUNCIL OF THE CITY OF CATHEDRAL CITY, that the real property described
in the Declarations of Dedication recorded on February 3, 1982, as Instruments No.
220498 and 20500, in Official Records of Riverside County, are hereby accepted on
behalf of the public for public road and public utility purposes, and pursuant to Section
1806 of the State Streets and Highways Code are hereby accepted into the City
maintained street system subject to their improvement.
BE IT FURTHER RESOLVED that the prior rejection of the offer of dedication of Lot "F"
as shown on Parcel Map No. 30726, as filed in Parcel Map Book 243, at Pages 96, 97,
and 98 in Official Records, is hereby rescinded and is now hereby accepted on behalf
of the public for public road and public utility purposes, and pursuant to Section 1806 of
the State Streets and Highways Code the street is hereby accepted into the City
maintained street system subject to its improvement.
BE IT FURTHER RESOLVED THAT the City Clerk is hereby directed to cause a
certified copy of this Resolution to be recorded in the office of the County Recorder of
Riverside County, California.
BE IT FURTHER RESOLVED that upon the improvement of the access road described
in the above Declarations of Dedication and the portion described as Lot "F" of Parcel
Map No. 30726, and upon receipt of a written notice from the Director of
Engineering/Public Works that the improvement of the access road has been
satisfactorily completed to City standards, the City Clerk is hereby authorized and
directed to accept the street improvements on the said access road into the City
maintained street system by the filing and recordation of an instrument to that effect
pursuant to the provisions of Cathedral City Municipal Code Section 14.36.010.
APPROVED, and ADOPTED at a regular meeting of the City Council for the City of
Cathedral City held on this 28th day of September, 2022 by the following vote:
