HomeMy WebLinkAboutCC Reso 2022-47 RESOLUTION NO. 2022-47 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY, CALIFORNIA, ADOPTING RULES OF PROCEDURE FOR THE APPOINTMENT OF PERSONS TO SUBORDINATE BOARDS, COMMITTEES, AND COMMISSIONS OF THE CITY COUNCIL WHEREAS, City Council has from time to time established by ordinance specific boards, committees and commissions that are subordinate to the City Council and that assist the Council with various aspects of the City's business (herein after "Commissions"); and WHEREAS, Chapter 2.06, of the Cathedral City Municipal Code (hereinafter "CCMC") provides general rules regarding the appointment, service, removal, terms and filling of vacancies of members of the Commission; and WHEREAS, CCMC section 2.04.040 authorizes the City Council to adopt rules of procedure related to functions and activities of the Council; and WHEREAS, the City Council desires to adopt rules of procedure to more clearly establish the manner in which the City Council will identify, recommend, and appoint members to the Commissions as provided in this Resolution: NOW,THEREFORE BE IT RESOLVED by the City Council of the City of Cathedral City as follows: 1. The above recitals are true and correct and material to this Resolution. 2. Application of the Rules. The rules of procedure set forth in this Resolution shall apply to all boards, commissions, and committees, established by ordinance or resolution of the City Council, and which are subordinate thereto ("Commissions"). This resolution shall not apply to any board, committee or commission which has been established by voter-approved initiative or which was created to provide independent advisory review pursuant to a revenue or bond measure (e.g., Citizen's finance advisory committee CCMC section 3.44.150), and which proscribes a specific process for the appointment of its members. 3. Process to Assign Commission Seat Numbers. Each seat on each Commission shall be assigned a number between 1 through 5 by means of a random number generator or other similar method selected by the City Manager. Each Councilmember shall then be assigned a numbered Commission seat on each Commission corresponding to the Council person's numbered election District (i.e., 1 through 5) solely for purposes of recommending new appointees to the Commissions to fill vacancies in the RIV#4867-8901-7648 vl assigned seats whether due to expiration of their term or due to other reasons. 4. Appointments At-Large. Notwithstanding the method used to initially assign Commission seats, the recommendation of appointees may be on an at- large — city-wide — basis and is not limited to recommendation or appointment of persons residing in the Councilmember's electoral district. 5. Notices of Vacancy. The City shall continue to provide annually a list of all Commissions and a list of all appointive terms which will expire during the next calendar year and will also provide special notice of any unscheduled vacancy of a Commission seat, all in compliance with the Maddy Act (Government Code section 54970 et seq). In addition, each Councilmember may contact residents of the City individually or at large to further solicit interest in one or more of their assigned Commission seats. 6. Review of Applications. Each Councilmember shall review the applications received by the City related to each Commission seat to which they have been assigned and may interview one or more of the applicants, the Councilmember in their discretion, find to be qualified for the Commission seat, provided the questions asked are not of a confidential or personal nature or would otherwise be prohibited by law. Each Councilmember may also review materials provided by applicants attached to their application or submitted in advance of or at their interview. 7. Recommendation to Council. Each Councilmember shall select one applicant per assigned Commission seat for recommendation of appointment to the City Council. With the assistance of the City Manager's Office, the Councilmember shall cause a staff report to be prepared for action by the Council recommending the person for appointment to the relevant Commission seat with a short summary of their background, qualifications and reasons for recommendation. The recommendation shall be placed on the next regular session of the Council as a consent calendar item. 8. Action on Recommendation / Appointment. Appointments are intended to be routine in nature and shall be placed on and acted upon as a consent calendar item, unless removed by one or more Councilmembers for comments, questions or discussion. A majority of the Council membership shall be required to confirm the appointment, except for the reappointment of an applicant who has already served for two (2) full terms on the Commission in which event CCMC section 2.06.010.D requires the affirmative vote of at least four(4) Councilmembers. 9. Removal of Appointees. Removal of appointees shall be governed by CCMC section 2.06.010.B. RN#4867-8901-7648 vl 10. Interpretation / Application of Rules. The City Council or any Councilmember may at any time request that the City Attorney interpret these rules in the event of an ambiguity or opinion on the application of these rules to any potential or proposed recommendation. 11. Resolution does not Modify CCMC Chapter 2.06. This Resolution does not and is not intended to modify or amend the provisions of CCMC Chapter 2.06 and at all times its express provisions shall govern in the event of any conflict between this Resolution and Chapter 2.06.
