HomeMy WebLinkAboutCC Reso 2022-45 RESOLUTION NO. 2022-45 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY, CALIFORNIA, ESTABLISHING CIVIL FINES FOR VIOLATION OF CANNABIS BUSINESS REGULATIONS WHEREAS, on October 25, 2017, the City Council adopted Ordinance No. 800 establishing civil fines for convictions for violations of Chapter 5.88 (Cannabis Businesses) of the Cathedral City Municipal Code and codified said fines in Section 5.88.120 of the Code; and WHEREAS, on August 24, 2022, the City Council introduced for first reading Ordinance No. 863 amending Section 5.88.120 to delete the civil fines stated in that section and authorizing the City Council to adopt civil fines by resolution; and WHEREAS, by this Resolution the City Council adopts civil fines for violations of Chapter 5.88 of the City Code in the same amounts as were previously established by Ordinance No. 800. NOW, THEREFORE,THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. INCORPORATION OF RECITALS The City Council hereby finds the recitals set forth above to be true and correct. SECTION 2. ESTABLISHMENT OF CIVIL FINES Pursuant to Section 5.88.120 of the Cathedral City Municipal Code, any person convicted of an infraction or misdemeanor violation shall, for each separate violation of this chapter, be subject to the following civil fines in addition to any infraction or misdemeanor penalties: A. A fine in an amount not to exceed two hundred fifty dollars for a first conviction of an offense; B. A fine in an amount not to exceed five hundred dollars for a second conviction of the same offense within a twelve-month period of the date of the first offense; C. A fine in an amount not to exceed seven hundred fifty dollars for a third conviction of the same offense within a twelve-month period of the date of the first offense; and D. A fine of one thousand dollars for the fourth and subsequent convictions of the same offense within a twelve-month period of the date of the first offense. RIV#4882-4961-2053 v2 SECTION 3. EFFECTIVE DATE This Resolution shall take effect on October 14, 2022. SECTION 4. CERTIFICATION The City Clerk shall attest to and certify the vote adopting this Resolution.
