HomeMy WebLinkAboutReso 2004-91 RESOLUTION NO. ,2OU y- r-/ C A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY APPROVE AN AMENDMENT TO ARTICLE 7.1 OF THE CATHEDRAL CITY HUMAN RESOURCE POLICY PROVIDING FOR PAYMENT OF SUPPLEMENTAL SALARY AND HEALTH BENEFITS ALLOWANCE TO FULL-TIME EMPLOYEES CALL TO ACTIVE MILITARY DUTY FOR A PERIOD NOT TO EXCEED SIX MONTHS IN A FISCAL YEAR WHEREAS, the City Council supports the United States military and deeply appreciates the role military reservists play in resolving conflict and defending our Country; and WHEREAS, the City Council has determined that it is in the public interest to encourage and promote civilian participation in the military reserve amongst full-time employees of the City, and therefore desires to extend supplemental salary and benefits allowance in excess of that required by law to fill-time employees called to active military duty; and WHEREAS, California statutory law provides that public employees are entitled to a temporary military leave of absence for active duty and thirty (30) days pay, provided the call to duty does not exceed 180 (one hundred eighty) calendar days, and provided certain minimum service requirements are satisfied for some military reservists; and WHEREAS, neither federal nor state law requires public employers to continue health insurance coverage for employees on military leave of absence; however, under federal law, employers must allow employees on military leave to voluntarily continue coverage for a maximum of 18 months at their own cost; and WHEREAS, the City Council desires to amend Article 7 Subsection 7.1 of the Cathedral City Human Resource Policy to provide that any officer or full-time employee of the City who is called to active duty for more than 30 calendar days in a fiscal year receive from the City, for a period not to exceed six months in a fiscal year, compensation equal to the difference between his/her base City salary and his/her military pay, together with his/her health benefits allowance for up to six(6)months in any given fiscal year; and WHEREAS, this benefit will be limited to not more than twelve (12) months in any one military duty activation; and WHEREAS, the payment of the supplemental salary and health benefits allowance provided by this Resolution are intended only to provide salary and health benefits allowance in excess of that required by law. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Cathedral City as follows: Section 1. FINDINGS (a) That any full-time employee of the city who is called to active duty shall be granted a military leave of absence in accordance with the provisions of State and Federal law; and (b) That any full-time employee of the City who is called to active military duty shall continue to receive compensation equal to the difference between his/her base City salary and his/her military pay, together with his/her health benefits allowance for up to six (6)months in one (1)fiscal year. (c) That this benefit will be limited to not more than twelve months (12) in any one military duty activation. Section 2. RESOLUTION That the amendment to ARTICLE 7, SUBSECTION 7.1 of the Cathedral City Human Resource Policy be approved. Section 3. CERTIFICATION That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolution of the City; and shall make a minute of passage and adoption thereof in the records of the proceedings of the City council, in the minutes of the meeting at which Resolution is passed and adopted.
