COUNCIL ACTION A. Continuation of Teleconference Meetings Recommendation: To adopt a resolution authorizing the City Council and Commissions to meet via teleconference pursuant to Assembly Bill (AB) 361. City Manager Charles McClendon stated that pursuant to AB 361, in order to continue to authorize the City Council and Commissions to meet via teleconference, the City Council will have to adopt a resolution authorizing teleconference meetings and making findings that there is imminent risk to the health and safety of those attending in person. Reso 2022-01 A motion was made by Councilmember Gregory and seconded by Councilmember Carnevale to adopt a resolution authorizing the City Council and Commissions to implement teleconference accessibility for conducting public meetings pursuant to AB 361. OATH OF OFFICE - MAYOR PRO TEM RITA LAMB City Clerk Tracey Martinez administered the Oath of Office to Rita Lamb, who was appointed to serve as Mayor Pro Tem for a period of one-year. Councilmember Mark Carnevale congratulated Mayor Pro Tern Rita Lamb. He stated that she has brought so much strength to this Council and what she has done is phenomenal. He feels all the constituents are in good hands. Councilmember Raymond Gregory stated that he is so happy that Mayor Pro Tern is at this point in her Council career and feels she will have a great year. He also stated that he is happy to share an office with her and always learns so much from her. He is looking forward to this upcoming year. Councilmember Nancy Ross stated that Mayor Pro Tern is her colleague and her friend. She concurs with Councilmember Raymond Gregory that they have learned so much from Mayor Pro Tern Rita Lamb. She believes she will enlighten us and bring together good programs and projects and can't wait to further collaborate. She congratulated her and thanked her for being such an intricate part of the City Council. Mayor Ernesto Gutierrez congratulated her on her great success and feels she has done an amazing job for the City. He hopes all the residents appreciate all she does. He stated that it is an honor to be able to serve with her. He is looking forward to a great year. 3. PUBLIC COMMENT There were no members of the public that wished to speak. 4. CLOSED SESSION City Attorney Eric Vail announced that the City Council will meet in Closed Session to discuss the following items on the Agenda. A. Conference with Labor Negotiator Pursuant to Government Code Section 54956.6 Agency Negotiator: Charles McClendon, City Manager Represented Employees: AFSCME - The American Federation of State, County and Municipal Employees CCPOA - Cathedral City Police Officers Association CCPMA - Cathedral City Police Management Association CCPFA - Cathedral City Firefighters Association CCFMA - Cathedral City Fire Management Association The City Council recessed to Closed Session at 3:15 p.m. Cathedral City Page 2 Printed on 1/20/2022 The City Council reconvened at 3:56 p.m. City Attorney Eric Vail announced that the City Council met in Closed Session to discuss item 4A. Conference with Labor Negotiator, AFSCME, CCPOA, CCPMA, CCPFA, and CCFMA. There was no reportable action taken. 5. STUDY SESSION A. Short Term Vacation Rental Update Recommendation: This item is presented for information, discussion and direction only. Police Chief George Crum provided an annual recap of the Short-Term Vacation Rentals Compliance Team progress from the period of November 13, 2020, to November 28, 2021. He presented the following points: • Number of short-term vacation permits by month • Licenses in HOA and non-HOA areas • Call for service • Citations issued • Hearing Dispositions • Top 8 residence that accounted for 63.8% calls for service Councilmember Raymond Gregory inquired on what the City is doing to collect outstanding fees. City Manager Charles McClendon responded that the City could place a notice of pendency on the property, send to collections, or place a lien on the property. City Attorney Eric Vail provided further clarification on the options laid out by the City Manager to collect the outstanding fees. He feels that revoking their license is the biggest penalty that the City can impose on violators. Mayor Ernesto Gutierrez inquired if the City can add legal fees to a judgment. Eric Vail responded in the affirmative. He indicated that the City can ask the court to include these fees, typically the courts have allowed us to collect court and filing fees not attorney fees. Mayor Ernesto Gutierrez inquired if there is a breakdown of the outstanding fees by category. City Manager Charles McClendon responded that he does not have that information at this time, however, he will have staff work on providing that information to the City Council. Mayor Ernesto Gutierrez inquired if the response time is the same for calls to the hotline and the Go Request app. Cathedral City Page 3 Printed on 1/20/2022 Police Chief George Crum responded that there can sometimes be a slight delay with Go Request submissions, however, the response time is typically the same. Mayor Ernesto Gutierrez inquired what is the top violation that the hearing officers have dismissed. Police Chief George Crum responded that advertising violations where the top violation dismissed by the hearing officers. Councilmember Raymond Gregory inquired if the options laid out by staff for collecting outstanding fees will be discussed, worked on, and moved forward in the upcoming sessions. City Manager Charles McClendon responded in the affirmative. Mayor Pro Tem Rita Lamb requested clarification on the process for placing a lien on a property prior to a property being sold. City Attorney Eric Vail provided clarification on the options staff has to try and collect the fees. He stated that the City can place a Notice of Pendency on the property, place a lien on the property, or put a lien on the tax roll. Councilmember Nancy Ross inquired why fees were not collected or a lien placed on the property mentioned by staff, which had outstanding fees that was sold. City Manager Charles McClendon responded that the City was not at that point with the legal team to be able to act prior to the sale of the property, however, everyone was happy that this particular property was sold due to the amount of staff time and resources it used up. Sandra Richter provided an overview of her experience with the short-term rental near her home, which has been sold. She thanked the City Council for their support and efforts. She urged the City Council to make all those who do business with the City provide a valid street address. Tony Michaelis, President of Montage at Mission Hills HOA, informed the City Council that they enforced restrictions on short-term rentals in 2018. One of the homeowners sued the HOA, Brown vs. Montage at Mission Hills, and prevailed due to Civil Code section 4740. He urged the City Council to change the ordinance to protect HOAs from this situation. Doug Evans thanked the City Council for giving his neighborhood back. He urged the city to be more aggressive in suspensions and non-renewals and to keep an eye on the illegal operators moving forward. He would like the City to amend the zoning ordinance to prohibit short-term vacation rentals in R1 and R2 zones. The Following individuals submitted public comments via email and were read into the record by City Clerk Tracey Martinez: Cathedral City Page 4 Printed on 1/20/2022 Joan and Andy Braunstein expressed their gratitude to the City Council for their support and execution of Measure B, which has returned their neighborhood back into a community of residents. They hope the violators continue to be enforced and cited. Pattie Hagedorn thanked staff and the City Council for their efforts to enforce the new ordinance. She also thanked the residents that stood up and spoke up. Ed Emond-Worline congratulated the City Council and staff for the success of the STVR program to date. He urged the City to continue to enforce rules and regulations harder. City Manager Charles McClendon stated that this item was for information and discussion only and no action is needed. There will be an item on the January 26, 2022, Agenda to discuss some recommended changes and receive feedback from the City Council on additional recommendations to the STVR Ordinance. B. Update on FY 2021-2022 Community Development Block Grant (CDBG) Program Substantial Amendment and Five-Year Consolidated Plan Recommendation: Update on FY 2021-2022 Community Development Block Grant (CDBG) Program Substantial Amendment and Five- Year Consolidated Plan. This item is for discussion and direction only, no formal action will be taken. John Corella, Director of Engineering and Public Works, introduced Darrell Stamps from the Ramsey Group and Andrew Lee, Assistant Engineer for the City. Darrell Stamps and Andrew Lee provided a presentation on the Community Development Block Grant (CDBG) FY 2021-22 Substantial Amendment and Five-Year(2022-27) Consolidated Plan. Darrell Stamps requested that the City Council provide their feedback related to potential five-year priorities. Councilmember Ross would like to see resources to help parents return to the workforce after leaving the workforce due to their children being out of school during the pandemic. Councilmember Raymond Gregory suggested that staff provide more information and examples of what this funding can be used for in order to be able to provide their feedback. Councilmember Mark Carnevale concurs with Councilmember Gregory. Mayor Ernesto Gutierrez concurs with Councilmember Gregory and Councilmember Carnevale. City Manager Charles McClendon stated that staff will bring back an item to educate and provide examples to the City Council so that they may provide input on the Five-Year Consolidated Plan prior to taking action in May. PUBLIC COMMENT No members of the public wished to address the City Council. 2. COUNCIL REPORTS Councilmember Raymond Gregory stated that it has been a long time since our last meeting and he wished everyone a Happy New Year. He reported that he attended the Parks and Community Events Commission subcommittee meeting, the Blue Light Ceremony and a City Hall at Your Corner event. He reported that discussions continue with other agencies in the Desert regarding the College of the Desert Road Runner Program, and he will keep everyone updated on the progress. He also attended the CVAG Public Safety meeting, the League of California Cities Riverside Division meeting, and the Riverside County Transportation Commission meeting. He announced the upcoming Special Meeting on January 19, 2022, and the Goal Setting meeting on January 22, 2022. He hopes everyone has a happy and prosperous year. Councilmember Mark Carnevale announced that the CVAG mobile crisis unit will be parked on the basketball courts behind Napa on Mondays. He reported that he spent some time talking to residents and businesses related to an array of concerns. He also reported that he met with Economic Development Director Stone James and Assistant City Manager Katherine Fuentes to tour the new Suniva building. He also met with Assistant City Manager Fuentes and a local developer for lunch. He met with Parks and Community Events Commissioner Robert Puentes at Century Park to discuss the much-needed park upgrades. He also received many calls from residents related to the paint color of the new Casa Blanca, which he feels is not in line with our ordinance and has asked the City Manager to investigate it. He announced that he will be attending the CVAG Homeless Committee meeting next week. Councilmember Nancy Ross reported that she met with Tribal Consultants and a Public Arts Commissioner to discuss a possible cultural event in the Cathedral City Community Amphitheater this coming year. She also reported that she celebrated the Holidays on vacation with her children, which was the best vacation ever. She also reported that she was assigned to Jury Duty the week of Christmas, however, she was not selected to sit on any trials. She announced that she will be attending an academy to learn and have a better understanding about water districts. She also announced that she has sent out her latest "Notes from Nancy" for the month of January. She announced the Jurassic Wonders Exhibit, brought to us by the Museum of Ancient Wonders, is now available to see. She reported that she attended the League of California Cities Riverside Division meeting along with her colleagues and was proud that they were fully represented. She expressed her excitement to be representing the City on the SunLine Transit Agency and will be participating in an upcoming training and events. She also expressed her excitement to be receiving her newly built all electric vehicle soon. She announced the upcoming Goal Setting meeting and encouraged everyone to join via Zoom. Mayor Pro Tem Rita Lamb thanked Councilmember Raymond Gregory for his leadership over the last year. She reported that she attended the League of California Cities Riverside Division meeting, and complimented Mayor Gutierrez for doing a great job. She also reported that she attended the Santa for Seniors event at Cathedral Palms Senior Living along with Councilmember Nancy Ross. She announced that she is working with the Chairman of the Parks and Community Event Commission, Gary Marshall, to plan kids concerts in the Cathedral City Community Amphitheater. She also announced that Parks and Community Events Commissioner, Robert Puentes, has facilitated a program for Veterans and guitars, which is a wonderful program. She recognized the Cathedral City Fire Department for their shopping event which benefited children from the Boys and Girls Club. She also wanted to recognize Melody Chaclan, a Cathedral City High School Senior, who Cathedral City Page 2 Printed on 1/25/2022 received a full tuition scholarship to Stanford University. She reported that she attended the memorial for Isabel) Bringas, sister of Ofelia Bringas. She also reported that she attended, along with Goeff Corbin and his staff, a field trip to her hometown Burbank to visit McCambridge Recreation Center. She also attended an Am vets meeting, Coachella Valley Mountains Conservancy Board meeting, and a Coachella Valley Mosquito and Vector Control Board of Trustees meeting. She announced that she will be attending the upcoming Martin Luther King Jr. celebration at the Coachella Library on January 16, 2022. She will also be participating in a City Hall at Your Corner event on January 18, 2022. She announced the upcoming Emergency Make and Take event which will be held on February 5, 2022, at the Cathedral City Library. She reported that she spoke to many residents regarding permit concerns and vacant lots. Mayor Ernesto Gutierrez wished everyone a Merry Christmas and a Happy New Year. He urged everyone to stay healthy with the new Omicron variant going around. He reported that he attended a Parks and Community Events Commission subcommittee meeting and the League of California Cities Riverside Division meeting. He reported that he had an interview with Joe Smith from KKGX radio station and met with City Manager Charles McClendon for his weekly meeting. He reported that he spoke to some developers and builders who were concerned with the process for pulling permits with the City, and he was able to refer them to City Manager McClendon for information. He also spoke to residents regarding the illegal vendors in the City and fireworks/gunshots during New Year's, which has been referred to City Manager McClendon and Police Chief Crum. He also reported that he drove around the City to see what needs attention to talk about at the upcoming City Council Goal Setting meeting. He announced the upcoming Special Meeting on January 19, 2022, and the Goal Setting meeting on January 22, 2022. He also stated that Martin Luther King Jr. is one of his favorite speakers and inspired him in his life. 3. Danielle Mead expressed her excitement about this change. She suggested that the City hold an informational event to educate residents. Purchase of Fencing and Shade Structure for the Panorama Dog Park Recommendation: Authorize the City Manager to execute the documents required for the purchase and installation of the Echelon Plus Fencing in the amount of $187,634, including tax; and authorize the purchase and installation of a USA Shade double wide cantilever fabric shade structure in the amount of$76,486, including tax; resulting in a revised budget of $610,000, including a General Fund budget amendment for the increase in costs in the amount of $110,000. John Corella, Director of Engineering and Public Works provided an overview on the recommendation to purchase fencing and a shade structure for the Panorama Dog Park. Danielle Mead expressed her appreciation for this project and expressed her concern with loose dogs in the area. She inquired about the height of the proposed fencing. Terry Applegate inquired on the materials to be used and ADA accommodations in the park. M.O. 2022-08 A motion was made by Councilmember Carnevale and seconded by Councilmember Gregory to authorize the City Manager to execute the documents required for the purchase and installation of the Echelon Plus Fencing in the amount of $187,634, including tax; and authorize the purchase and installation of a USA Shade double wide cantilever fabric shade structure in the amount of$76,486, including tax; resulting in a revised budget of $610,000, including a General Fund budget amendment for the increase in costs in the amount of$110,000. December 2021 Hall of Flowers Event Recap Recommendation: This item is for review and discussion only. Stone James, Economic Development Director provided an overview on the recent Hall of Flowers event held in December 2021. Geoff Corbin, President and CEO of the Cathedral City Senior Center, praised Dani Damanstein, Palm Springs Motors, Mayor Gutierrez and Stone James for their help with providing a van for the Senior Center. Dani Damanstein stated that helping to provide a van to the Senior Center was very important to him as his father, who passed away, enjoyed a similar service in his hometown. He thanked the City Council for believing in the Hall of Flowers event. This item was for information and discussion only and no action was taken by the City Council. The City Council recessed at 7:37 p.m. The City Council reconvened at 7:45 p.m. F. Bringas Bridge: Call for Artistic Submissions Recommendation: Authorize the Public Arts Commission to obtain proposals for the creation of 16 art works, printing selected art on tile, and printing of two portraits on tile in a total amount not to exceed $50,000.00. The cost of the project would be covered by the Art in Public Places Fund. M.O. 2022-09 A motion was made by Mayor Pro Tem Lamb and seconded by Councilmember Carnevale to authorize the Public Arts Commission to obtain proposals for the creation of 16 art works, printing selected art on tile, and printing of two portraits on tile in a total amount not to exceed $50,000.00. The cost of the project would be covered by the Art in Public Places Fund. City Manager provided an overview of the recommendation to terminate the lease for billboards on City property. City Manager Charles McClendon provided an overview of the DAP/Revivals Volunteer Appreciation Dinner proposed to be held in the Cathedral City Community Amphitheater on Sunday April 3, 2022, from 4:00 to 6:00 p.m. Councilmember Raymond Gregory and Councilmember Mark Carnevale would like to donate $255 each from their discretionary funds towards the SUP 21-015 application fee for this event. Marcie Lerner, Volunteer Coordinator DAP Health, thanked the City Council for their offer to sponsor the SUP application fee. She provided a brief overview of their organization. City Manager Charles McClendon provided an update on Emergency Actions Related to COV1D-19. He reported that this has been the most challenging three weeks of the entire pandemic for our organization. He stated that there are many employees out sick and thanked Eugenia Torres, Human Resources Manager, for all her hard work during this time. He feels we may be turning the corner and hopes to continue in that direction. He provided the recent seven-day average and noted that we are covered under the State mask mandate and doesn't feel a need for the City Council to act on anything at this time. He thanked Councilmember Nancy Ross for providing city employees with N95 masks. Terry Applegate expressed her concern with the City Council voting to rescind the mask mandate. She also expressed her concern with the Omnicron variant and urged everyone to wear a mask, get vaccinated and get boosted. Councilmember Raymond Gregory stated for the record that the City Council did not act to rescind the mask mandate, it was allowed to expire. There was no formal action taken by the City Council. 7.
