• AGENDA FINALIZATION
1. PUBLIC COMMENT
Juan Mejia expressed his concern about food and security in the community, which
he feels is a long-term issue. He wanted to bring awareness to the City Council
about SB 108 State Healthy Food Access Policy.
2. STUDY SESSION
A. Review of Municipal Code for Contracts and Purchasing
Recommendation: This item is provided for information, discussion and
direction.
Tami Scott, Administrative Services Director provided an overview on the
Municipal Code as it relates to Contracts and Purchasing. She presented the
following points:

Mayor Raymond Gregory expressed concern related to the current practice for
checks and balances for centralized purchases.
Tami Scott provided an overview of the current practices and the reasons behind
those practices.
Mayor Raymond Gregory inquired about the "best value" and who oversees that
process. He would like this better defined and a process for determining "best
value".
Tami Scott responded that either she or Deputy Finance Director Kevin Biersack
make the determination for "best value".
City Manager Charles McClendon feels the provisions in the current ordinance
are valuable. He suggested as an interim step, that staff, within their
departments, put in place a checks and balances process to ensure that they
follow the provisions of the current ordinance.

B. SB 1383 Ordinance and Commercial Organics Recycling Campaign
Recommendation: The SB 1383 Ordinance and Commercial Organics
Recycling Campaign is presented for information, discussion
and direction only.
Deanna Pressgrove, Environmental Conservation and Public Works Manager
provided an update on the SB 1383 Ordinance and Commercial Organics
Recycling Campaign.
Mayor Raymond Gregory requested clarification on the next steps and
definitions.
Deanna Pressgrove provided further clarification on the definitions of different
types of waste and the plans for next steps.
Councilmember Nancy Ross questioned the plan to define who is participating in
multi-family communities and expressed her concern with the potential rate
increases for the multi-family units.
Deanna Pressgrove responded that, when the program is implemented, there will
be an increase of $89.81 for commercial properties, which includes multi-family
units. This increase will be subsidized with AB 939 Funds for a period of 8
months, at which time an audit will be completed and staff will evaluate whether
or not to recommend the extension of the program. Council will receive an

update of the program once the evaluation is complete.
Frank Orlett, Vice President of Burrtec, stated that Cathedral City already has a
green waste program in place so the increase will not be as significant as in other
areas.
Councilmember Mark Carnevale inquired about the plans for marketing and
education for the residents.
Clara Vera, Municipal Marketing Manager of Burrtec, provided a brief overview of
thep lans for outreach and education for residents.
Denise Cross expressed her concern with flies, which are already a big issue.
She questioned how residents are going to be able to separate the trash.
This item was presented for information and discussion only and there was no
action taken by the City Council.
3. CLOSED SESSION
City Attorney Eric Vail announced that the City Council will recess to Closed Session
to discuss the following items on the agenda.

54956.6 regarding CCPOA - Cathedral City Police Department. There was no
reportable action taken. The following items will be heard at the end of the
December 8, 2021, Regular City Council Meeting and will be reflected in the
minutes.

Recommendation: To approve the Council Rotation List and appoint, in

B. Oath of Office - Mayor
City Clerk Tracey Martinez administered the Oath of Office to Ernesto Gutierrez,
who was appointed to serve as Mayor for a period of one-year.
Mayor Ernesto Gutierrez thanked outgoing Mayor Raymond Gregory for his service
and leadership as Mayor and presented him with a small gift. He thanked his fellow
City Councilmembers and past Mayors of Cathedral City for all their support and
expressed how very proud he is to serve beside them. He thanked his family and
friends for all their support during the sad and wonderful times. He believes he is
who he is because of them. He thanked Aphrodite for everything she has done for
him and Tony Marisca for all his help during his campaign when running for City
Council. He also thanked City staff for their help and support. He stated that he was
an immigrant kid who did not speak a word of English. He had a strong mother of 11
children, who was tough and taught him everything he knows. He feels that his
mother did a great job, and he wishes she could be here to see all that he has
accomplished. He now wishes to inspire the new generation of kids to teach them
that anything is possible with hard work. If you make sacrifices now, you will reap the
benefits later. He believes the American dream is alive, and if he did it anyone can.
Councilmember Mark Carnevale thanked Councilmember Raymond Gregory for his
leadership as Mayor. His style was always spot on and to the point and he really
appreciated that. He feels that he makes the City Council and the City better. He
feels he did a fine job, especially during the pandemic. He believes Mayor Ernesto
Gutierrez will do a fine job and will get us to where we need to be with his
progressive thinking.
Councilmember Nancy Ross thanked Councilmember Raymond Gregory for his
service as Mayor. She appreciates his leadership and congratulated both him and
Mayor Gutierrez.
Councilmember Raymond Gregory thanked Mayor Ernesto Gutierrez and his fellow
Councilmembers. He stated that he is very proud to have served as Mayor and
proud of the teamwork of the Council and staff this last year, especially during the

anoverview of all the accomplishments of the CityCouncil
pandemic. He provided p
and City events during 2021. He thanked his husband Eric for his support and
patience. He stated that he looks forward to working with Mayor Ernesto Gutierrez
and he believes that the entire Council's hearts are in the right place.
• SPECIAL PRESENTATION - APWA So Cal Award for the Cathedral City
Community Amphitheater
John Corella, Director of Engineering and Public Works, presented the APWA So
Cal 2021 Project of the Year Award that was awarded to Cathedral City for the
Cathedral City Community Amphitheater. He also announced that Cathedral City
was awarded a grant in the amount of 8.498 million dollars for the construction of the
Dream Homes Park.
Denise Cross expressed her excitement and thanked the City Council and staff. She
congratulated Mayor Ernesto Gutierrez and Councilmember Raymond Gregory.
2. PUBLIC COMMENT
There were no members of the public that wished to speak.
3. COUNCIL REPORTS
Councilmember Raymond Gregory thanked all those involved in the 40th
Anniversary Celebration, which he feels went very well. He reported that he attended
the Palm Springs Equality Awards and the Chanukah celebration at Boomers. He
reported that the City Council held a Special City Council Meeting where they
discussed the Hall of Flowers Event, shopping carts, billboards, and the dog park.
He reported that he attended his last meeting with the SunLine Transit Agency and
the CVAG Executive Committee. He reported that he attended the Mayor's Golf
Tournament and the Riverside County Transportation Commission meeting. He also
reported on the Mayor's Tree Lighting Ceremony earlier today, which was his last
event as Mayor. He wished everyone a happy and safe holiday.
Councilmember Nancy Ross reported that she attended many meetings with
community leaders and staff related to ideas for 2022. She reported that she
attended multiple National League of Cities meetings, a City Hall at Your Corner,
CVAG Energy and Environment Resources Committee meeting, and the Hot Air
Balloon Festival. She stated that the Balloon Festival was very successful and noted
how beautiful Mayor Pro Tem Rita Lamb's singing voice was during Council
Karaoke. She expressed her excitement to be taking over as the City's
representative on the SunLine Transit Agency Board and feels she will learn a great
deal. She also reported on the Special City Council Meeting and feels these special
meetings have been a great asset to the City Council. She reported that she
attended the Mayor's Golf Tournament, Senior Center Food Bank, and the Boys and
Girls Club's Spirit of Aloha event. She provided a brief update on the Jurassic
Wonders Exhibit and the timeline for installation, which is set to begin in January
2022. She also reported that she will be meeting with Public Arts Commissioner
Sunshine Edwards and Tribe representatives to discuss a possible cultural event at
the Cathedral City Community Amphitheater. She reported that she will going on a
cruise with her family for the holidays and when she returns, she may have to serve
on jury duty.

Councilmember Mark Carnevale stated that the 40th Anniversary Celebration was
great and thanked all those involved. He reported that he attended the Chanukah
event held at Boomers, which was a pleasure to attend. He, along with
Councilmember Nancy Ross, attended a meeting with Deanna Pressgrove,
Environmental and Public Works Manager, and Burrtec to discuss SB 1383. He also
reported on the Special City Council Meeting where they discussed shopping carts
and billboards. He reported that he attended the Senior Center's Food Bank, the
Boys and Girls Club's Spirit of Aloha event and the Date Palm Country Club Golf
Cart Parade. He also reported that he will be attending the next City Hall at Your
Corner on December 14, 2021. He along with Mayor Gutierrez toured the Hall of
Flowers event, and he was very impressed with all the details. He indicated that he
was approached by Officer Powers and Officer Brooks, who are the homeless
liaisons, regarding CVAG's mobile outreach vehicle potentially being parked on the
basketball courts behind Napa, which he would like to seek approval on. He stated
that he will no longer be sitting on the CVAG Public Safety Committee,
Councilmember Raymond Gregory will be taking over. He is looking forward to the
coming year and wished everyone happy holidays.
Mayor Ernesto Gutierrez hopes everyone had a great Thanksgiving Holiday. He
thanked Councilmember Raymond Gregory and staff for their help and support
during his transition as Mayor. He reported that he attended the Balloon Festival, the
Chanukah event at Boomers, and had lunch with Assistant City Manager Katherine
Fuentes. He also reported that he participated in the 3rd Annual Mayor's Cup and
was impressed with Mayor Pro Tern Rita Lamb. He along with Councilmember
Carnevale toured the Hall of Flowers event. He feels the event was state of the art
and expressed how impressed he was. This coming Friday he will be attending the
Date Palm Country Club Golf Cart Parade, which is always a lot of fun and is looking
forward to it. He also reported that he attended the Senior Center's food bank, which
was impressive. He believes Tommy Kocan does a wonderful job. He also reported
that he attended the Boys and Girls Club's Spirit of Aloha event, which was a great
event. He wished everyone a Merry Christmas and a Happy New Year.

6. PUBLIC HEARING 7:00 PM
A. Consideration of Revised City Council District Electoral Boundaries as
required by Elections Code Section 21621.
Recommendation: Receive a report from staff and the City's redistricting
consultant on the redistricting process and permissible
criteria to be considered to redraw district boundaries; and
conduct a public hearing to receive public input on district
boundaries.
City Manager Charles McClendon indicated that pursuant to Elections Code
21621, the City is required to go through the re-districting process after each
census. He indicated that the City awarded a contract with Best Best & Krieger
to provide the redistricting services. He introduced Geremy Holm, Best Best and
Krieger, who will be providingan overview of the process and what to expect in

the coming months.
Geremy Holm provided an overview of the following points for the redistricting
process:
• Project timelines
• Key deadlines
• Next Steps and hearings
Councilmember Nancy Ross requested clarification on "racial gerrymandering"
and "one person one vote" as they relate to the redistricting processing.
Geremy Holm provided clarification and stated that these guidelines ensure that
all people have a voice.

Councilmember Raymond Gregory expressed his concern with certain areas that
were split up into two different districts. He feels the Rio Vista area should be
evaluated and inquired on the appropriate time to raise these concerns and voice
options.
Geremy Holm provided an overview on the opportunities for the City Council and
the public to provide input during the redistricting process. He stated that the Rio
Vista area will be evaluated.
Councilmember Nancy Ross expressed her concern with the homes bordering
Date Palm Country Club, which are in a different district.
Councilmember Mark Carnevale feels it should be left up to the professionals to
figure out how to redistrict the areas of concern.
Mayor Ernesto Gutierrez questioned if the number of voters is considered during
the redistricting process.
Geremy Holm provided clarification on how voting age plays a role in
considerations for redistricting.
Councilmember Nancy Ross requested clarification on the timeline for adopting a
map and the effect it will have on the next election.
Geremy Holm provided further clarification on the timeline and the requirement of
adopting a map for the upcoming election.
City Attorney Eric Vail requested clarification on the requirements for adopting
the maps by way of ordinance.
Geremy Holm provided an overview of the requirements for adopting the
ordinance, which takes legal affect immediately, which differs from adopting a
regular ordinance which takes 30 days to take legal affect after the second
reading.
Mayor Ernesto Gutierrez opened the public hearing to receive input from the
general public related to the consideration of Revised City Council District
Electoral Boundaries as required by Election Code Section 21621.
Denise Cross expressed her concern with the redistricting information not getting
out to the public. She expressed her concern with neighborhoods that are split
into two different districts. She urged the City to get the information out to the
public.
There were no other members of the public who wished to provide public
comments. Mayor Emesto Gutierrez closed the Public Hearing and returned
discussion to the City Council.

7. LEGISLATIVE ACTIONS
A. Agreement between Cathedral City and AYSO for Operation,
Maintenance and Use of the Dennis Keat Soccer Park
Recommendation: Approve an Agreement with the American Youth Soccer
Organizations (AYSO) Region 1200 for the Operation,
Maintenance and Use of the Dennis Keat Soccer Park
located on 30th Avenue east of Date Palm Drive; and,
authorize the City Manager to execute the Agreement.

Settlement with the Big Three Distributors and Johnson & Johnson and
consider and adopt either: (1) [Direct Receipt of Funds] Resolution
No. Authorizing settlement, approving all necessary agreements,
electing direct receipt of Local Allocation Funds, and authorizing all
implementing actions related thereto; Or in the alternative (2) [Use
Agreement with County of Riverside] Resolution No. Authorizing
settlement, approving all necessary agreements, and electing
distribution of City's Local Allocation Amount to the County of
Riverside subject to negotiation and execution of a Use Agreement with
the County of Riverside.

Councilmember Carnevale to adopt a Resolution authorizing opting into the
National Opioid Settlement with the Big Three Distributors and Johnson &
Johnson and the direct receipt of funds, approving all necessary agreements,
electing direct receipt of Local Allocation Funds and authorizing all implementing
actions related thereto.

F. Update on Emergency Actions Related to COVID-19
Recommendation: Update on Status of Emergency Proclamation. Possible

rescind Emergency Order 5B.

City Manager Charles McClendon provided an update on emergency actions
related to COVID-19. He indicated that the number of confirmed cases is
trending up as it is in Riverside County and much of the Nation. He also reported
that staff is working on the re-opening of City Hall to the public after the first of
the year as well as working on implementing a five-day work week. He stated
that Emergency Order 58 is set to expire on December 10, 2021, and the City
Council will need to either let it expire or act to rescind, revise or extend it.
Enoch Ludlow congratulated Mayor Ernesto Gutierrez on his new appointment.
He urged the City Council to let Emergency Order 58 expire.
Denise Cross thanked City Manager Charles McClendon for being on top of this
issue.
The City Council did not take action on Emergency Order 58 and will expire on
December 10, 2021.

existence of an emergency situation and local emergency due to the worldwide
spread of COVID-19.

Recommendation: To adopt a resolution authorizing the City Council and
Commissions to meet via teleconference pursuant to
Assembly Bill (AB) 361 .
City Manager McClendon stated that the City Council will need to discuss
whether or not to approve a resolution allowing for continued teleconferencing for
public meetings for another 30 days, pursuant to AB 361.
