PUBLIC COMMENT Marty Vistica expressed her concern about illegal fireworks during the last 4th of July Holiday and fears the same for the upcoming New Year's Eve Holiday. 2. CLOSED SESSION City Attorney Eric Vail announced that the City Council will meet in closed session to discuss the following items on the agenda. A. Conference with Real Property Negotiator Pursuant to Government Code Section 54956.8. Property Location: Approximately 1 .8 acres directly south and adjacent to the CVREP building, East of Cathedral Canyon Drive and North of East Palm Canyon Drive, with APN 687-475-001 Negotiating Parties: City of Cathedral City and the Coachella Valley Repertory Theatre Property Owner: City of Cathedral City Under Negotiations: Price and Terms for potential sale of real property B. Conference with Labor Negotiator Pursuant to Government Code Section 54956.6 Agency Negotiator: Charles McClendon, City Manager Represented Employees: CCPOA - Cathedral City Police Officers Association The City Council recessed to Closed Session at 3:06 p.m. The City Council reconvened at 3:50 p.m. City Attorney Eric Vail announced that the City Council met in Closed session to discuss Items 2A. Conference with Real Property Negotiator for approximately 1.8 acres directly south and adjacent to the CVREP building, and 2B. Conference with Labor Negotiator and Cathedral City Police Officers Association. There was no reportable action taken. 3. STUDY SESSION A. Update on the Student Creative Recycle Art Program (S.C.R.A.P.) Recommendation: This item is presented for information, discussion and direction only. Deanna Pressgrove, Environmental Conservation and Public Works Manager and Karen Riley, Executive Director of the S.C.R.A.P. Gallery, together, provided an update on the Student Creative Recycle Art Program (S.C.R.A.P.) and the various programs that they work on throughout the year. They also provided an overview of the first three months of the project-based learning and programming at the schools. The City Council expressed their appreciation for all of the hard work that goes into the various programs they provide for the Community, especially the children. B. Local Roadway Safety Plan (LRSP) Presentation Recommendation: The Local Roadway Safety Plan (LRSP) is presented for the City Council's information, discussion and direction only. Crystal Sandoval, Assistant Civil Engineer, provided a brief overview of the Local Roadway Safety Plan and introduced Stephan Manganiello, STC Traffic, Inc. who will provide an overview of the specifics that were used when preparing the plan. Stephan Manganiello, STC. Traffic, Inc. provided an overview of the Local Roadway Safety Plan that was prepared by working with stakeholders from the Engineering Department, Police Department, Fire Department and Public Works to gather data and discuss road safety countermeasures. The prepared LRSP consists of a prioritized list of issues, risks, actions, and improvements that can be used to reduce fatalities and serious injuries on the local road network. The City Council expressed their appreciation for the presentation of the Local Roadway Safety Plan. Adding Directional Signage to City Parks on Nearby Streets Recommendation: The presentation on Directional Signage to City Parks on nearby streets is for City Council information, discussion and direction only. John Corella, Director of Engineering and Public Works, presented the proposal to add additional directional signage to City Parks on nearby streets. He indicated that the Parks and Community Events Commission heard the same proposal, and they are in full support of the additional signage. Nancy Ross expressed the need for more signage for Ocotillo Park and suggested adding signage to Ramon Road and Dinah Shore. Mayor Pro Tem Ernesto Gutierrez concurs with Councilmember Ross and also suggested adding a sign on 33rd as well. City Manager stated that signage for Ocotillo Park will be added to Dinah Shore and staff will evaluate additional signage on either Ramon Road or 33rd. After discussion, it was the consensus of the City Council to direct staff to move forward with the additional directional signage to City Parks on nearby streets. PUBLIC COMMENT Mark Durkton expressed the need for an event center in the City of Cathedral City. He has seen the improvements made to the new Amazon building and indicated that Mr. Herman would like to do the same type of improvements to his property. 2. COUNCIL REPORTS Councilmember Nancy Ross reported that she attended the Cathedral City High School Homecoming parade, which had a Wizard of Oz theme. She announced that she is doing a column "Notes from Nancy" that is offered to the gated communities in her district. She reported that she attended the Architectural Review Committee to provide her Council Introduction and the Dinner with Patsi fundraiser held at the Barrel District. She announced that she will be getting her vaccine booster soon and she is happy to do what she can to protect herself and others around her. She also announced that she is working on a new city-wide project that has be supported by the Parks and Community Events Commission, and she plans to have more information to share soon. She stated that she feels it is very important to have good working relationships with neighboring agencies, which includes the Agua Caliente Band of Cahuilla Indians. She reported that she has had the opportunity to meet with the Tribe twice this month and feels we can do great things together. She also reported that she met with several constituents to discuss a variety of issues related to security, climate change, and economic recovery. She also met with two business owners to do a check in to see how they are doing and if they needed any assistance. She reported that the Parks and Community Events Commission has some great ideas for the next year and feels all the Commissions are coming out of the pandemic ready to implement and go. She feels we are fortunate to have such quality volunteers sitting on our Commissions and thanked them publicly. Councilmember Rita Lamb stated that being a part of the Cathedral City High School Homecoming Parade was a blast, and she thanked the drama students for dressing up as the Wizard of Oz characters. She reported that she attended the Cathedral City High School Homecoming Football game, along with Mayor Pro Tern Ernesto Gutierrez. Although they lost, it was a close game, and she quoted a famous fighter "You become a champion by fighting one more round" and encouraged the team to never give up. She also reported that she attended the unveiling of the Coachella Valley Rescue Mission's outreach team command center's mobile shower, which is located at the Calvary Christian Center. She stated that the shower will be available every Monday from 8:30 am to 6:30 p.m. She announced that the Noon Rotary will be hosting a Hero's Dinner on October 28, 2021, and the names of those being recognized for their community contributions. She reported that she is in the planning stages of the next Emergency Preparedness event, which will be held at the Cathedral City Library on January 8, 2022, at 11:00 a.m. She reminded everyone that the 40th Anniversary Celebration is coming up on November 20, 2021. She reported that Dave Fessel, who retired from the City but works part-time, shared with her that the Desert Shadow Resort has a street named after the R-Gang kids. She also reported that she will be meeting with Parks and Community Events Commissioner Robert Puentes to discuss a program to partner Veterans with guitars. She reported that she taped the latest Cathedral City Storytime, a shorten version of The Wizard of Oz, and thanked Chris Parman for his help. She stated that Matty Rosales will be filming a version in Spanish soon. She also reported that she spoke to many residents about a variety of issues related to noise, security lights, abandoned trailers and the growing homeless encampments. Councilmember Mark Carnevale reported that he attended the Cathedral City High School Parade, which is always fun. He also reported that he attended the Ad-Hoc Homeless Committee meeting and the unveiling of the Coachella Valley Rescue Mission's outreach team command center's mobile shower and noted that they have many services and supplies for the homeless. He also met with City Manager McClendon, Assistant City Manager Fuentes, and Administrative Services Director Cathedral City Page 2 Printed on 11/08/2021 Tami Scott for an overview on the City's computer backup and security measures in place and was very surprised at all the work that goes into that process. He also reported that he spoke to many residents about concerns related to noise complaints, homeless issues, new businesses, and spectrum issues. He announced that he will be attending the upcoming Coachella Valley Animal Campus meeting and the CVAG Public Safety Committee meeting. He encouraged those interested in joining the Citizens on Patrol program to reach out to Bill Kelly at (909)915-7907. He announced that a new business named Kings Court, a local barbershop, is offering free haircuts for Christmas in conjunction with the Cathedral City Boys and Girls Club on December 12, 2021, and more information will be available soon. Mayor Pro Tem Ernesto Gutierrez thanked all those joining the meeting via Zoom. He reported that he attended the Cathedral City High School Homecoming parade, along with his colleagues. He reported that he met with several restaurant owners in the City and will be referring one of them to Stone James, Economic Development Director, for assistance with applying for grant money. He also reported that he attended a City Hall at Your corner, along with Mayor Gregory, which was a lot of fun. He met with Police Chief Crum for an update on the Police Department. He thanked Chief Crum for his assistance with an abandoned gardening trailer that was reported to him by a concerned resident. He met with Stone James, Economic Development Director, for an update on his department. He also met with City Manager McClendon and Assistant City Manager Fuentes to review tonight's agenda. He received calls from individuals expressing their concerns about vendors in neighborhoods who did not have a valid license and thanked City Manager McClendon for his assistance in making sure they were removed from the neighborhoods. He hopes all the kids in the City have a fun and safe Halloween and reminded everyone to attend the City's Spooktacular event. Mayor Raymond Gregory reported that he, along with his colleagues, attended the Cathedral City High School Homecoming Parade and rode on the float, which was very nice. He reported that he attended the Desert X 2021 Film at the Rancho Mirage Amphitheater. He also attended the unveiling of the Coachella Valley Rescue Mission's outreach team command center's mobile shower at Calvary Christian Center, and thanked Councilmember Carnevale for all his work with the Homeless in the City. He reported on the City Hall at Your Corner he attended, along with Mayor Pro Tem Gutierrez, which was fun. He attended an exhibit opening at the Museum of Ancient Wonders where he ran into Councilmember Carnevale and Councilmember Ross. He reported that he represented the City on October 25, 2021, at the Riverside Transportation Budget and Implementation Committee meeting, where they discussed financial data and future projects. He stated that there has been some progress made on the Coachella Valley San Gorgonio Rail project and he attributed some of the progress on the project to the contributions of the late Greg Pettis. He reported that he attended the Parks and Community Events Commission and the Historic Preservation Committee meeting to provide his Council Introductions. He also reported that he attended the Sunline Transit Agency meeting and announced that they are hiring and encouraged those interested to apply. He reminded everyone of the upcoming Spooktacular event on Halloween and the Special City Council workshop meeting on November 3, 2021. He announced that Day Light Savings is on November 7, 2021, and reminded everyone to set their clocks accordingly. He reported that the College of the Desert has shelved the planned Roadrunner Motor program that was set to be located in Cathedral City and expressed his concern with their decision. He encouraged the Community to voice their opinions to the College of the Desert Board of Trustees. He stated that his name has been mentioned as a possible candidate to run in the upcoming election for Sheriff, and he has no intention on running and is dedicated to serving on this City Council. 3. Update on Emergency Actions Related to COVID-19 Recommendation: Update on Status of Emergency Proclamation. Possible action to continue or rescind Resolution 2020-06. Council will consider and may act to extend, revise or rescind Emergency Order 5A (facial covering requirement). Possible consideration of additional measures to be taken. Council may add items not listed on the agenda pursuant to Government Code section 54954.2 by majority vote. City Manager Charles McClendon reported that there are currently no confirmed COVID-19 cases with city staff. He feels our process of having employees stay home if they have any symptoms is working well, and he thanked Human Resources Manager, Eugenia Torres, for her work on this process. He stated that in the broader community, we have settled into a pattern, over the last 4 weeks or so, having 5-6 confirmed cases per day. This number is higher than he would like to see, however, it is much better than what we have seen at some points over the last 18 months. He indicated that Emergency Order No. 5A is set to expire on October 31, 2021, and he is looking to the City Council for direction on whether or not they want to extend Emergency Order 5A or allow it to expire on October 31, 2021. Danielle Mead expressed her support for extending Emergency Order 5A. She also expressed her concern with members on the City Council who own restaurants having the ability to vote on items that affect restaurants. Linda Anderson expressed her support of allowing Emergency Order 5A to expire on October 31, 2021 Danny Lee expressed his support of extending Emergency Order 5A. Rosalind Holbrook expressed her support of rescinding Emergency Order 5A. Bob Ohda expressed his support of extending Emergency Order 5A. Denise Cross expressed her support of extending Emergency Order 5A. Councilmember Mark Carnevale asked that the City Attorney provide direction on his ability to vote on the Emergency Orders. City Attorney Eric Vail provided an overview on FPPC Regulation 18703 "Public Generally" Exception, which provides exceptions that apply to State of Emergency Orders. When a decision is made, pursuant to an emergency, mitigating the effects of that emergency, a condition is created under the law where the financial effects of a Council Member is deemed indistinguishable from that of the public, causing no conflict of interest. Councilmember Rita Lamb expressed her support of extending Emergency Order 5A. Mayor Pro Tem Ernesto Gutierrez expressed his support of rescinding Emergency Order 5A.
