AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CATHEDRAL CITY, CALIFORNIA AMENDING SECTIONS
2.06.010, 2.18.030, 2.18.040, 2.19.040, AND 2.30.040 OF THE
CATHEDRAL CITY MUNICIPAL CODE
WHEREAS, the City Council of the City of Cathedral City desires to amend the Cathedral
City Municipal code to clarify certain commission and committee functions; and
WHEREAS, the City Council finds that the proposed amendments are consistent with the
purposes of each commission and committee as provided in Chapters 2.06, 2.18, 2.19 and 2.30
of the Cathedral City Municipal Code; and
WHEREAS, the City Council finds that the establishment and regulation of certain
committees and commissions are in the best interest of the public health, safety and general
welfare;
THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY DOES ORDAIN AS
FOLLOWS:
SECTION 1. AMENDMENT OF SECTION 2.06.010 OF THE CATHEDRAL CITY MUNICIPAL
CODE
Section 2.06.010(B) of Chapter 2.06 (Boards and Commissions — General Provisions) of
Title 2 of the Cathedral City Municipal Code is amended to read as follows:
"B. Any member of a board or commission may be removed from office at any time,
with or without cause, by a majority vote of the city council, except in cases where the
mayor or city council are not the appointing authority (in which cases such regular
appointing authority may exercise this power of removal). If a member is absent from three
consecutive regular meetings or from twenty five percent of the duly scheduled meetings
of the board or commission within one fiscal year, the matter will be brought before the
City Council for consideration of the possible removal of the member. Except in cases
where the mayor or city council are not the appointing authority, no person shall be
appointed to and serve substantially more than two full consecutive terms upon any single
board or commission, and any person who has served substantially two full consecutive
terms shall not be reappointed to the same board or commission until at least the time
equal to one full term has elapsed."
SECTION 2. AMENDMENT OF SECTION 2.18.030 OF THE CATHEDRAL CITY MUNICIPAL
CODE
Section 2.18.030 of Chapter 2.18 (Parks and Community Events Commission) of Title 2
of the Cathedral City Municipal Code is amended to read as follows:
"Meetings of the Parks and Community Events Commission shall be held as necessary to
fulfill the Commission's duties at such time and place as shall be fixed by the Commission.
A majority of the existing appointed members of the Commission shall be considered a
quorum for the transaction of business. The Commission may establish such rules and
regulations as it deems necessary for the conduct of its business. In matters relating to
holding and conducting regular and special meetings, the Commission shall be bound by
the provisions of the Ralph M. Brown Act of the state (Government Code Section 54950
et seq.), as it may be amended."
SECTION 3. AMENDMENT OF SECTION 2.18.040 OF THE CATHEDRAL CITY MUNICIPAL
CODE
Section 2.18.040(E) of Chapter 2.18 (Parks and Community Events Commission) of Title
2 of the Cathedral City Municipal Code is amended to read as follows:
"E. To submit, prior to December 1st of each year, annual priorities and requests to the
city council for review;"
Section 2.18.040(D) of Chapter 2.18 (Parks and Community Events Commission) of Title
2 of the Cathedral City Municipal Code is hereby deleted in its entirety.
Sections 2.18.040(E), (F), and (G) of Chapter 2.18 (Parks and Community Events
Commission) of Title 2 of the Cathedral City Municipal Code are hereby renumbered as Sections
2.18.040(D), (E), and (F), respectively.
SECTION 4. AMENDMENT OF SECTION 2.19.040 OF THE CATHEDRAL CITY MUNICIPAL
CODE
Section 2.19.040(B) of Chapter 2.19 (Public Arts Commission) of Title 2 of the Cathedral
City Municipal Code is amended to read as follows:
"B. Prior to December 1st of each year, submit an annual report on priorities and requests
and advise on long range capital improvement programs pertaining to public art to the city
council for review;"
Section 2.19.040(E) of Chapter 2.19 (Public Arts Commission) of Title 2 of the Cathedral
City Municipal Code is amended to read as follows:
"E. Recommend grants and other financial support programs that may be applicable to
the acquisition, maintenance, restoration, exhibition and display of public art on public
property;"
Section 2.19.040(G) of Chapter 2.19 (Public Arts Commission) of Title 2 of the Cathedral
City Municipal Code is hereby deleted in its entirety.
Section 2.18.040(H) of Chapter 2.19 (Public Arts Commission) of Title 2 of the Cathedral
City Municipal Code is hereby renumbered as Section 2.18.040(G).
SECTION 5. AMENDMENT OF SECTION 2.30.040 OF THE CATHEDRAL CITY MUNICIPAL
CODE
Section 2.30.040 of Chapter 2.30 (Architectural Review Committee) of Title 2 of the
Cathedral City Municipal Code is amended to read as follows:
"The architectural review committee shall review projects for compliance with the
applicable provisions of the Development Code. The architectural review committee will
ensure the following:"
Section 2.30.040(A) of Chapter 2.30 (Architectural Review Committee) of Title 2 of the
Cathedral City Municipal Code is amended to read as follows:
"A. That all projects will create an image with a high degree of quality that improves the
built environment and incorporates quality amenities with regard to architecture,
landscaping, the streetscape, site plan review and analysis, lighting (aesthetics and
safety), master sign programs, walls and fences, bus shelters, and individual signs (as
forwarded by staff)."
SECTION 6. EFFECTIVE DATE.
This Ordinance shall be effective 30 days from and after its final passage.
SECTION 7. SEVERABILITY.
If any section, subsection, subdivision, sentence, clause, phrase, or portion of this
Ordinance, is for any reason held to be invalid or unconstitutional by the decision of any court of
competent jurisdiction, then such decision shall not affect the validity of the remaining portions of
this Ordinance. The City Council of the City of Cathedral City hereby declare they would have
adopted this Ordinance, and each section, subsection, subdivision, sentence, clause, phrase, or
portion thereof, irrespective of the fact that anyone or more sections, subsections, subdivisions,
sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional.
SECTION 8. PUBLICATION.
The City clerk is authorized and directed to cause this Ordinance to be published within
fifteen (15) days after its passage in a newspaper of general circulation and circulated within the
City in accordance with Government Code Section 36933(a) or, to cause this Ordinance to be
published in the manner required by law using the alternative summary and pasting procedure
authorized under Government Code Section 39633(c).
The foregoing Ordinance was introduced on September 8, 2021 and approved and
adopted at a meeting of the City Council held on the 29th day of September, 2021 by the following
vote:

and Mayor Gregory
