CLOSED SESSION City Attorney Eric Vail announced that the City Council will meet in Closed Session to discuss the following item listed on the Agenda. A. Conference with Legal Counsel - Anticipated Litigation Pursuant to Government Code Section 54956.9(d)(2). Number of Potential Cases: One The City Council recessed to Closed Session at 3:00 pm. The City Council reconvened at 3:30 pm. City Attorney Eric Vail announced that the City Council met in Closed Session to discuss item 1A. Conference with Legal Counsel for one case of anticipated litigation. There was no reportable action taken. 2. PUBLIC COMMENT Alan Carvalho thanked the City and the Council for their support of the painting of the Rainbow Crossing, which will take place on Saturday March 13, 2021 at 10:00 am. 3. STUDY SESSION A. Coachella Valley Association of Governments (CVAG) Presentation on the results of the Flood and Blowsand Risk Assessment and Improvement Plan Recommendation: This is a presentation only, there is no formal action required. City Manager Charles McClendon introduced Tom Kirk, Executive Director of the Coachella Valley Association of Governments. Tom Kirk, Executive Director of the Coachella Valley Association of Governments provided an overview of the results of the "Flood and Blowsand Risk Assessment and Improvement Plan for the Western Coachella Valley," which was finalized by CVAG in December 2020. B. Council Liaison to Commissions Recommendation: This item is presented for information, discussion and direction only. City Manager Charles McClendon stated that the City Council has established goals for 2021. The following two goals were among the goals adopted: 3. Finance and General Government e. Assign a Councilmember (or two) to serve as liaison to the Public Arts Commission, Parks and Community Events Commission and the Historic Preservation Committee for the purpose of meeting periodically with the Chair to help facilitate Commission work. f. Develop a mechanism for Councilmembers to be able to introduce themselves and interact with Commissions on a scheduled basis. City Manager McClendon indicated that Mayor Raymond Gregory and Mayor Pro Tem Ernesto Gutierrez have been serving as the liaisons to the Parks and Community Events Commission, it is recommended that they be assigned as the official liaison to that Commission. He also indicated that he has proposed a schedule for each Councilmember to attend a Commission meeting where they can introduce themselves, provide some information on their vision for the City, thank Commissioners for their service, and answer questions. He stated that staff is seeking direction from the City Council for both items. The City Council discussed what they see the objectives and purpose of the Council liaisons to the Commissions are. City Manager Charles McClendon stated that there are times when the Commissioners may need guidance on processes and information that may be required to accomplish their goals. Having Councilmember Liaisons to Commissions will provide an opportunity to advise and guide the Commission through problem solving. Cathedral City Page 2 Printed on 3/17/2021 City Attorney Eric Vail stated that having a Councilmember, or two, as a liaison to the Commissions is a helpful tool if done correctly and guidance can be provided without violating the Brown Act. It was the consensus of the City Council to support having assigned Councilmembers to serve as liaisons to the Public Arts Commission, Parks and Community Events Commission and the Historic Preservation Committee. The following are the proposed assignments, which will be added to the Local Agency Assignment List and reviewed annually. These assignments will be ratified by formal Council action at the March 24, 2021 Council Meeting: • Public Arts Commission- Councilmember Rita Lamb and Councilmember Mark Carnevale • Historic Preservation Committee- Councilmember Nancy Ross and Councilmember Mark Carnevale • Parks and Community Events Commission- Mayor Raymond Gregory and Mayor Pro Tem Ernesto Gutierrez It was also the consensus of the City Council to approve the proposed schedule outlined in the staff report for the Council to introduce themselves to the Commissioners and their meetings. PUBLIC COMMENT Alan Carvalho thanked the City and the City Council for their support of the repainting of the Rainbow Crossing, which will take place on March 13, 2021. Tammy Gordon, Representative for the Coachella Valley Mosquito and Vector Control District, provided a brief update on the 2020 mosquito control season. Sammy Flores advocated for the City Council to consider passing an ordinance requiring Hero pay for grocery store employees. 2. COUNCIL REPORTS Councilmember Nancy Ross reported that she attended Supervisor Perez's Corona Virus Update. She also reported that she attended a luncheon for the Greater Coachella Valley Chamber of Commerce along with Councilmember Mark Carnevale and Stone James, Economic Development Director. She announced that she met with City Manager Charles McClendon to discuss City Council related issues and with Administrative Services Director Tami Scott to review budgetary items. She reported on the biweekly City Council workshop held March 3, 2021. She indicated that she was able to assist several citizens with their concerns, attended a 2-hour long sexual harassment course, and toured the City with Mayor Pro Tem Ernesto Gutierrez. She announced that the Cathedral City Community Amphitheater is now open to the public. She stated that she participated in the Riverside County Division training, where the focus was on speed limits, and The Lift to Rise meeting where they discussed their affordable housing program. Councilmember Rita Lamb stated that it was recently Employee Appreciation Day and wanted to take a moment to acknowledge the City employees. She provided the current number of reported residents that have been vaccinated for COVID-19. She reported that she attended a webinar where the speaker was the California State University Chancellor, who discussed the efforts to adjust during the COVID-19 pandemic. She announced that the ground-breaking of the Veteran's Village will be on April 9, 2021, which she is looking forward to. She reported that she attended the League of California Cities Division Meeting and the CVAG Conservation Committee meeting. She announced that the Red Cross will be having their annual Hero Award recognition, where a local resident will be acknowledged. She also announced that the Great Coachella Valley Chamber of Commerce will be having the California Insurance Commission as a speaker at their next meeting. She stated that she was able to assist with some resident concerns regarding building and parking and that she plans to go out and distribute more personal protective equipment this coming week. Councilmember Mark Carnevale reported that he has been in contact with the Police Department regarding updates on the homeless in the City and thanked them for all they are doing. He spoke with the Chair of the Public Arts Sue Townsley regarding Century Park, which needs some attention. He attended meetings with Lift to Rise, Vector Control, and Administrative Services Director Tami Scott. He spoke with a representative from the new hockey stadium and indicated that the project is moving along. He reminded everyone that the repainting of the Rainbow Crossing is on Saturday, and he will be providing pepperoni pizza to those volunteering. He thanked everyone for their efforts with Measure B. Mayor Pro Tem Ernesto Gutierrez reported that he received his COVID-19 vaccine. He stated that he was able to tour the City with Councilmember Nancy Ross. He reported that he volunteered to educate the public about Measure B and made several phone calls. He also reported on the City Council workshop held on March 3, 2021. He thanked those involved in the efforts to solve the Outpost Market shooting. He stated that he was able to help many residents with their concerns. He urged everyone to continue to social distance. He is looking forward to when the numbers decline, and he can see everyone in Council Chambers again. Mayor Raymond Gregory stated that it has been a busy couple of weeks. He was honored to present at the Women's Council of Realtors, where he discussed all the great things in Cathedral City. He thanked staff and the Council for all their extra effort regarding the Council workshops, which have been very informative. He participated with other Mayors around the State at the California's Mayor's Coalition. He was also able to participate in the League of California Cities Riverside Division meeting, where the topic was speed limits. He thanked Councilmember Ross for putting together ecards to staff from the Council for Employee Appreciation Day. He reminded everyone of the upcoming repainting of the Rainbow Crossing and day lights savings. He encouraged those who are interested to join the next City Council workshop on March 17, 2021 via Zoom. 3. Receive and file Payment of Claims and Demands for February 2021 Recommendation: The City Council acting in its capacity for the City, the Successor Agency to the former Redevelopment Agency, the Housing Successor Agency, and the Cathedral City Public Finance Authority Board receive and file payment of claims and demands in the aggregate sum of$4,821,836 for the month of February 2021. M.O. 2021-25 4. ITEMS PULLED FROM CONSENT A. Police Department Application for Agua Caliente Band of Cahuilla Indians Donation Recommendation: Staff recommends the City Council approve accepting the $25,000.00 donation from the Agua Caliente Band of Cahuilla Indians to fund computer upgrades and two Flock ALPR cameras. Mayor Pro Tem Ernesto Gutierrez requested further information regarding the costs and placement of Flock ALPR cameras. Police Chief George Crum provided the costs, placement, and further clarification on Flock ALPR cameras. Councilmember Nancy Ross questioned how long data is stored from the cameras. Chief Crum responded that the data is kept for 30 days and then it is cycled out. M.O. 2021-22 A motion was made by Mayor Pro Tem Gutierrez and seconded by Councilmember Carnevale to accept the $25,000.00 donation from the Agua Caliente Band of Cahuilla Indians to fund computer upgrades and two Flock ALPR cameras. First Reading Amending Municipal Code 8.30 Underground Wires Recommendation: To introduce and provide First Reading by title only; and waive further reading of an Ordinance Amending Municipal Code 8.30 to revise sections relating to undergrounding wires, specifically Local Lines for infill lots within residential neighborhoods. M.O. 2021-28 A motion was made by Councilmember Carnevale and seconded by Councilmember Lamb to introduce and provide first reading, by title only; and waive further reading of an Ordinance Amending Sections 8.30.020 [Definitions] and Section 8.30.100 [Appeal] of Chapter 8.30 [Underground Wires] of Title 8 [Buildings and Construction] of the City of Cathedral City Municipal Code with the following amended language under 8.30.100 section (a) of Exhibit "A": Cathedral City Page 5 Printed on 3/17/2021 (a) The owner or developer of an infill lot, as defined in this chapter, may apply to the City Engineer to pay a fee, as may be established from time to time by resolution of the City Council, in lieu of actually undergrounding local lines as would otherwise be required under this chapter, if the infill lot is not adjacent to an arterial roadway, the undergrounding required by the power utility includes area outside the property boundary and are more than 200 lineal feet but less than 600 lineal feet. The City Engineer may additionally consider conditions that make undergrounding impractical if the proposed development will be income restricted by means of a recorded affordability covenant to persons of low or moderate income as defined under state law. Update on Emergency Actions Related to COVID-19 Recommendation: Update on Status of Emergency Proclamation. Possible action to continue or Rescind Resolution 2020-06. Update on Emergency Actions taken by City, County, State of Federal Agencies. Possible consideration of additional measures to be taken. Council may add items not listed on the agenda pursuant to Government Code section 54954.2 by majority vote. City Manager Charles McClendon provided an update on Emergency Actions Related to COVID-19. He stated that the City is doing much better, which is also reflected at the County and State levels. The seven-day average is the lowest it has been since last May. He urged everyone to stay vigilant in what they know is working. He indicated that he will be bringing an item to the City Council for consideration on March 24, 2021 related to the Emergency Order on the Cathedral City Page 6 Printed on 3/17/2021 requirement of face coverings and social distancing, which will be expiring on March 31, 2021. He stated that it appears Riverside County will be moving into the Red Tier soon, which will allow more re-opening of businesses with conditions. He reminded the Council that CVREP's conditional use permit to have events at the Cathedral City Community Amphitheater has expired, however, once outdoor events are allowed once again the City Council may want to consider extending their permit. 7.
