Deputy City Attorney Al Ford announced that the City Council met in Closed Session
to discuss item 1A. Conference with Real Property Negotiator for approximately 2.5
acres south of A Street, East of Buddy Rogers APN's 687-199-001, 687-199-002,
687-212-001, 698-212-002, 687-212-003, 687-212-004, 687-212-005, portions of
687-212-026, 687-212-019, 687-212-009, 687-212-010, 687-212-011, 687-212-022,

Counsel regarding one case of anticipated litigation. There was no reportable action

3. STUDY SESSION
A. Update on Graffiti Abatement Services
Recommendation: The update on Graffiti Abatement Services is presented for
information and discussion.
John Corella, Director of Engineering and Public Works, provided an overview of
the Graffiti Abatement Program.
Councilmember Ernesto Gutierrez questioned if graffiti abatement services are
done in areas that are not reported if it is in close proximity of a reported area.
Mr. Corella responded in the affirmative.
Councilmember Gutierrez provided suggestions for the GoRequest application to
make it more user friendly. He also inquired on how graffiti is removed from
sidewalks.
Mr. Corella gave an overview of how graffiti is removed from sidewalks.
Councilmember Mark Carnevale questioned what the cost is for these services
and questioned if there would be a cost savings if it was done in house.
City Manager Charlie McClendon responded that the cost to do it in house is
about the same. He indicated that when it was done in house there were lapses

in staff availability to remove the graffiti and the company is more effective at
paint matching.
Councilmember Mark Carnevale questioned who is responsible for graffiti on
private property.
Mr. Corella responded that the City will take care of graffiti on private property
when it is visible.
Mayor Pro Tem Raymond Gregory questioned how GoRequests are processed
and whether the City screens them. He also questioned if evaluations are done
on graffiti in the same areas.
Mr. Corella explained the process and indicated that the departments work
together to manage and screen the GoRequests. He also explained that they
have not had many issues with graffiti repeated in the same areas.
B. SB 1383 Compliance Update
Recommendation: The SB 1383 Compliance Update is presented for
information and discussion.
Deanna Pressgrove, Environmental Conservation and Public Works Manager,
gave an update on SB 1383 Compliance.
Mayor John Aguilar questioned if there will be any funding assistance available
from the State.
Ms. Pressgrove responded in the negative.
Councilmember Ernesto Gutierrez questioned what constitutes organic waste,
how multifamily units are affected and if other states have similar compliances in
place.
Ms. Pressgrove gave an overview on what organic waste is. She explained how
the thresholds, implementation and exemptions work for multifamily units. She
also indicated that California is the only state with this type of compliance.
Councilmember Rita Lamb asked for clarification on edible food recovery
programs.
Ms. Pressgrove explained what edible food recovery programs are and how the
documenting process works.
Councilmember Mark Carnevale feels this will be an interesting and positive
move in the right direction. He would like to offer his services if he is appointed to
serve on the committee.
Mayor Pro Tem Raymond Gregory inquired about any programs in place to
recover food waste.
Ms. Pressgrove responded in the negative.

Councilmember Ernesto Gutierrez inquired about a local composting station.
Ms. Pressgrove gave a brief description of the Edom Hill Transfer Station and
indicated that the station will be opening soon.
C. Cathedral City Small Business COVID-19 Physical Adaption Grant Program
UPDATE
Recommendation: Informational update only. No action is requested.
Stone James, Economic Development Director, gave an update on the Cathedral
City Small Business COVID-19 Physical Adaption Grant Program.
Councilmember Mark Carnevale feels this is getting more complicated and
questioned what can be done to help the small businesses that are in need.
Mr. James explained the process and complications. He understands the need is
now and explained that staff if working together to get the program up and
running.
Councilmember Rita Lamb requested clarification on how the process works for
awarding grants to businesses and how the compliance works.
Mr. James gave an overview of what the City is doing to make sure they are in
compliance when awarding the grants.
Mayor Pro Tem Raymond Gregory thanked Mr. James for his efforts and for
trying to do this the right way. He feels this funding will have a lot of strings
attached. He feels that having a consultant handle the applications is the way to
go. He expressed the importance of setting the program up correctly but as
quickly as possible.
Councilmember Ernesto Gutierrez thanked Mr. James for his efforts, and he
concurs with Mayor Pro Tern Gregory's remarks.
Mayor John Aguilar requested information on what the City is doing in relation to
outdoor dining for restaurants.
City Manager Charles McClendon indicated that they are only focusing on public
health and safety issues and expediting them through the process as quickly as
possible.
D. Update on the Cannabis Task Force Meeting of October 19, 2020
Recommendation: This item is presented for information, discussion and
direction only.
City Manager Charles McClendon gave an overview of the Cannabis Task Force
Meeting of October 19, 2020. He provided an update on the status of the industry
which included information on new operators and taxes received for 2018
through 2020. He provided an overview on the East Palm Canyon Separation
Requirement and reported that the Task Force was split in their decision on

whether to continue with the separation. He provided an overview of the outdoor
lounge concept at the Hall of Flowers event, which was canceled due to COVID-
19. He reported that the Task Force was in favor of allowing outdoor
consumption lounges and recommended a pilot program in certain areas of the
City. He also provided an overview of the current regulations and processes for
businesses to operate a drive-thru and reported that the Task Force decided not
to make any recommendations to Council at this time. He also presented the
Task Force's recommendation for the composition of the Cannabis Task Force,
which would more closely mirror other City commission/committees.
Mayor Pro Tem Raymond Gregory suggested that the Task Force continue to
consider the East Palm Canyon separation requirement and eventually provide
City Council with a recommendation. He stated that he is not prepared to move
forward on consumption lounges and suggested staff bring back a study session
item to evaluate further. He also feels the Task Force should remain an advisory
committee and not a voting body.
Councilmember Rita Lamb is in favor of the Cannabis Task Force becoming a
Committee. She is also in favor of having further discussion on the items
presented.
Councilmember Mark Carnevale feels the set-back requirement should remain in
place. He is not in favor of outdoor consumption lounges as they could pose
issues with odor. He also feels that it is not the City's job to monitor cannabis. He
feels that they need to form a group and present proposals to the City.
Mayor John Aguiar concurs with Councilmember Carnevale that the set-back
should remain in place and feels the Council does not need to take action on the
other items presented.
Councilmember Ernesto Gutierrez concurs with Councilmember Carnevale
regarding the East Palm Canyon set-back and lounges. He also indicated that he
is not sold on drive-thrus. He agrees with the composition of the committee.
It was the consensus of the City Council to direct staff to prepare a Study
Session item for options on how the committee will be configured and an update
on the status of the industry.

• SPECIAL PRESENTATIONS
1. Oath of Office New Fire Chief John Muhr
City Manager Charles McClendon introduced John Muhr the new Fire Chief and
gave a brief overview of his background.
City Clerk Tracey Martinez swore-in Fire Chief John Muhr.
Fire Chief John Muhr expressed his gratitude. He stated that he is proud to take on
his new role as Fire Chief and looks forward to working with everyone.
Mayor John Aguilar congratulated Fire Chief Muhr.
Councilmember Ernesto Gutierrez congratulated Fire Chief Muhr.
Councilmember Rita Lamb wished Fire Chief Muhr much success.
2. Certificate of Appreciation - Outgoing Interim Fire Chief Blake Goetz
City Manager Charles McClendon thanked Blake Goetz for his service as Interim
Fire Chief.
Councilmember Ernesto Gutierrez presented Mr. Goetz with a Certificate of
Appreciation.
Mr. Goetz expressed his appreciation and thanked the City for the opportunity to
serve as Interim Fire Chief.
Mayor John Aguilar thanked Mr. Goetz for his service and wished him a happy
retirement.
3. Plaque Presentation to Council - Date Palm Bridge
John Corella, Director of Engineering and Public Works, gave an overview of the
completed Date Palm Bridge Project and presented the City Council with an Award
of Merit from the American Public Works Association recognizing the project.
4. Presentation - Dr. Cameron Kaiser, Riverside County Health Officer
Mayor John Aguilar introduced Dr. Cameron Kaiser and gave an overview of his
background and career.
Dr. Cameron Kaiser, Riverside County Health Officer, provided an update on
COVID-19 cases and the testing done in the Coachella Valley and Cathedral City.
He gave an update on potential vaccines. He also gave a status update of Riverside
County and neighboring counties. He reminded the community that as cases
continue to rise it is recommended that groups from different households do not
gather to help control the spread of COVID-19.
Mayor Pro Tern Raymond Gregory questioned what the prevalent location types and
ways that the virus is being spread. He also questioned if there is any evidence of
community spread related to short-term vacation rentals, even circumstantially or
through staff or visitors.
Dr. Kaiser reported on the percentages of case exposures from grocery stores,
restaurants, retail, healthcare, vacation rentals/hotels, and other areas for the
County and Cathedral City. He stated that there is evidence of exposures from short-
term vacation rentals, however, the percentage seems to be in the middle compared

to other areas of exposure.
Mayor Pro Tern Raymond Gregory inquired if there are any additional programs or
orders that he believes the City could do during this pandemic.
Dr. Kaiser responded that he does not have any further recommendations for orders
on top of what the City already has in place. He feels that ensuring that businesses
and residents adhere to the State's guidelines, advocating for testing and contact
tracing are all things the City should continue to do.
Councilmember Rita Lamb questioned how the contact tracing process works.
Dr. Kaiser explained how the process of contact tracing works and the issues related
to the process. He stated that those who have tested positive for COVID-19 should
not get re-tested too soon.
Councilmember Rita Lamb feels the Coachella Valley lacks a level of coordination
and she questioned if Dr. Kaiser has any recommendations for the next emergency.
Dr. Kaiser responded that regular robust communication between cities,
interventions collectively, and a valley wide approach would be the most effective.
Councilmember Ernesto Gutierrez requested the statistics on death rates and
survival rates of COVID-19.
Dr. Kaiser responded that the death rate has dropped, as younger populations who
are more able to sustain levels of the virus become infected and hospitals have
made great strides in their ability to manage the virus.
Councilmember Ernesto Gutierrez questioned if Dr. Kaiser anticipates complications
or a rise in COVID-19 and the flu as the flu season approaches.
Dr. Kaiser stated that social distancing and masks are also effective in preventing
the spread of the flu. Based on data from other areas around the world, the flu
season may not be as bad this year and he feels we may be able to avoid some
spread if the community gets a flu shot.
Councilmember Mark Carnevale inquired about the safety of children returning to
school and what the percentage of COVID-19 infection is in youth verses adults.
Dr. Kaiser indicated that children contract COVID-19 at the same rate as adults.
Children can get COVID-19 and spread it, although there have not been any
pediatric deaths from the virus in Riverside County. He stated that a contact tracing
study out of India indicated that children spread COVID-19 to 20% of their
classmates, which is significant. He noted that there have been wavier schools
allowed to open with approval of the State and the Health Officer which will offer
some experience with how spread occurs in a school setting. They have a policy in
place should an outbreak occur in a school, but there has not been an outbreak so
far. Waivers are not offered at certain thresholds, which unfortunately we are
approaching. Waivers can also be revoked if necessary. He further explained that

schools will need to enforce 6 feet distance between children, which is a challenge
for students.
Mayor John Aguilar requested that Cathedral City have a consistent local testing
center.
Dr. Kaiser responded that the Inland Empire is priority due to their current numbers,
however, he will relay the request.
• AGENDA FINALIZATION
Item 68. Accept Land Donation- South of East Palm Canyon and East of Buddy
Rogers, was continued to a future meeting.
• STATEMENT OF PARTICIPATION BY THE CITY CLERK
1. PUBLIC COMMENT
The following individual submitted a public comment for the record. Their comment
was read for three minutes and the full comment will be made part of the record
according to our standard procedures:
Sue Townsley commented on her jazz ventures. She thanked Stan Henry, John
Aguilar, Greg Pettis, and Shelley Kaplan who have all supported her efforts. She
announced that the American Jazz Institute in Palm Desert runs a 24/7 internet jazz
radio station on 95.3 FM-KAJI, which has close to 200,000 listeners around the
world. She also announced that April was deemed "Jazz Appreciation Month" by
Smithsonian. She commented that International Jazz Day will be held on April 30,
which was created by Herbie Hancock and UNESCO. She stated that the Coachella
Valley has never participated in it, however, she plans to put Coachella Valley on the
2021 UNESCO jazz map with the help of the Herbie Hancock Institute and the
American Jazz Institute. She thanked the Council for their support.
2. COUNCIL REPORTS
Mayor Pro Tem Raymond Gregory noted that it has been a busy couple of weeks
with Halloween, the time change and the Election. He reported that he was able to
meet with residents and staff. He participated in the Coachella Valley Association of
Governments Transportation Committee meeting, where the discussion was
centered around future projects and funding. He, along with Councilmember Ernesto
Gutierrez, met with City Council Members from Palm Desert regarding a project in
the City's sphere of influence. Once he learns more about the project he will report
back to the rest of the Council. He announced that Veteran's Day is coming up and
he reminded everyone to take a moment to remember our Veterans and the
sacrifices they have made. He announced that Dinner with Patsy will be held at La
Tablita with proceeds benefiting the Senior Center. With Thanksgiving coming up
it's a good time to reflect on everything we are thankful for. He thanked the Mayor
and his colleagues for everything they have done to keep things moving forward.
Councilmember Ernesto Gutierrez thanked all those that participated in the recent
Election. He feels it was his duty to study the issues and the candidates and his
privilege to vote. He reported that he participated along with Mayor Pro Tem

Raymond Gregory in a meeting with Palm Desert City Council members in regard to
a project in the City's sphere of influence. He noted that they are contemplating
taking over the area where the hockey arena was going to be located. He also noted
that the City will do its best to protect the interest of the City. He stated that he
recently got tested for COVID-19, which was thankfully negative. He reminded
everyone of the importance of people getting tested to help get out of the purple tier.
He reported that he attended a meeting with the Cathedral City Police Officers
Association, which was a great meeting, where they discussed issues within the
City. He stated that he drove around the City and feels that there are a lot of blighted
areas and he can't wait to get started on working on those areas. He had a meeting
with City Manager Charles McClendon and they discussed a possible Volunteer
Code Enforcement on Patrol Program. He spoke with a local dispensary owner that
needed assistance and guidance. He also spoke with quite a few residents on where
the polling locations were located. He stated that Veteran's day is coming, and he
thanked all those that paid the ultimate price for our freedom. He reminded everyone
to shop local and get tested.
Councilmember Mark Carnevale congratulated Councilmember Rita Lamb and
Nancy Ross for their success in the recent Election. He reported that he attended a
small meeting to celebrate the Volunteer Award for Sue Townsley. He feels she
does a great job and has done so much for the City. He attended a Zoom meeting
for Lift-to-Rise and discussed the rental assistance fund, which had great success
helping families in the Valley among other assistance. He reported that he attended
the CVR Sub-Committee meeting. He noted that CVAG approved the Housing First
operation, which will be regulated for one year to see how it goes. He stated that
they will be using locally based staff. He reported on the County-wide effort to
prevent green waste fires. He announced that the California Office of Emergency
Services has launched a community engagement campaign for early earthquake
detection, and that they have a new App called My Shake App. He noted that we
continue to address race, diversity and police. He also announced that Cathedral
City is doing a promotion to shop local.
Councilmember Rita Lamb reported that she joined the Zoom meeting for the
League of California Cities. She stated that part of the meeting was dedicated to
individuals from different municipalities discussing goals and priorities. They also
discussed pulling together to support County, State and Federal efforts to save the
Salton Sea, affordable housing and wild-fire prevention. Thursday she will be
representing the City at the Conservation Committee Meeting, which she is looking
forward to. She announced the new Tower market and the Veteran's Village is
moving forward and College of the Desert has a full-time fire academy and she is
looking forward to their new auto technology facility. She stated that she is thankful
for everything.
Mayor John Aguilar would like to honor our veterans on Veteran's Day. He
announced that the City was awarded the Magic Maker Award for outstanding
community partner from CVREP today.

Recommendation: To approve a Substantial Amendment to the City's CDBG
FY 2020-2021 Annual Action Plan to include and allocate
the City's additional CARES Act funding to the Small
Business Economic Relief Program for submittal to the U.S.
Department of Housing and Urban Development (HUD).
Vince Lopez, CDBG Program Manager, presented the Substantial Amendment of
the City's CDBG FY 2019-2020 Annual Action Plan.
Mayor John Aguilar opened the Public Hearing for comments, there being none,

Recommendation: Staff recommends approval of (I) the amended Greater
Coachella Valley Chamber of Commerce Service Provider

Payment Program for FY20/21, (ii) authorize the City

C. Update on Emergency Actions Related to COVID-19
Recommendation: Update on Status of Emergency Proclamation. Possible
action to continue or rescind Resolution 2020-06.
Update on Emergency Actions taken by City, County, State
of Federal Agencies.
Possible consideration of additional measures to be taken.
Council may add items not listed on the agenda pursuant to
Government Code section 54954.2 by majority vote.
City Manager Charles McClendon gave an update on Emergency Actions related
to COVID-19. He provided the seven-day average for confirmed cases, which is
rising. He encouraged the community to think long and hard about the activities
they participate in this year for the Holidays.
Councilmember Mark Carnevale questioned if short-term vacation rentals should
be operating during this time with the numbers rising.
Mayor Pro Tem Raymond Gregory has observed occupancy limits in short-term
vacation rentals and questioned what is in place and what can be done.
City Manager Charles McClendon responded that the recently approved changes
to the code in regard to occupancy for short-term rentals is temporality on hold
and we have reverted back to the previous occupancy limits.
Mayor Pro Tern Raymond Gregory feels occupancy limits are an issue in short-
term rentals and regular residential homes. He feels gatherings are happening
and we should explore occupancy limits, but he is unsure of how to approach it
and where the efforts should be targeted.
Councilmember Mark Carnevale indicated that they should monitor and play it by
ear to see how things go when the new short-term vacation rental public safety
personnel begin enforcement.
Mayor Pro Tern Raymond Gregory feels we should educate and see if more
restrictions are needed if that is not effective.

Mayor John Aguilar feels we should be more aggressive in our education efforts.
Councilmember Ernesto Gutierrez questioned if staff is trained on the new and
old code, so they know what to enforce.
City Manager McClendon responded in the affirmative.
