The City Council reconvened at 3:30 p.m.
Mayor John Aguilar announced that the City Council met in Closed Session and will
resume discussion following the Regular City Council Meeting.

A. Proposition 20 "Reducing Crime and Keeping California Safe Act of 2020"
Recommendation: Presentation only
City Manager Charles McClendon introduced Riverside County District Attorney
Michael Hestrin who will be providing an overview of Proposition 20, an initiative
that has been placed on the ballot for the November 2020 Election.
Riverside County District Attorney Michael Hestrin provided and overview of
Proposition 20 Reducing Crime and Keeping California Safe Act of 2020, from
his perspective. He encouraged individuals to check out the website
keepcalsafe.org to find out more information.
Sgt. Jon Enos provided an overview of statistics for the PAC team.
B. Automated License Plate Reader (ALPR) Program Discussion
Recommendation: To continue established Automated License Plate Reader
(ALPR) program and consider the potential for future static
camera deployments in Cathedral City.
Sgt. Jon Enos provided an overview of the Automated License Plate Reader
(ALPR) Program. He stated that the Department utilizes both fixed and mobile
systems and that the technology is a vital tool in crime reduction. He reported
that in 2018, California had 155,211 stolen vehicles reported. California ranked
#1 nationally in stolen vehicles. The identification of stolen vehicles allows the
Department the ability to recover stolen vehicles quicker and return them to their
owners. It was noted that the Department does have a policy related to the use of
Automated License Plate Reader's.
C. Discussion on Architectural Review Committee Requirements

Recommendation: To discuss the requirements of the Architectural Review
Committee and provide direction to staff on whether or not to
amend the Code.
City Manager Charles McClendon and City Clerk Tracey Martinez provided a
review of the Architectural Review Committee and the make-up of the
membership according to the current Code. At the Council Meeting of June 30,
2020, Council requested that a discussion item be brought back to the City
Council to discuss whether they want to continue requiring that the Committee
have one licensed landscape architect and one licensed architect.
After hearing the presentation and input from staff and Council expressing their
concerns and thoughts, it was the consensus of the City Council to direct staff to
amend the municipal code as follows:
Maintain the requirement of a Licensed Architect
Maintain the requirement of a Licensed Landscape Architect with tiered priority
for flexibility as follows:
Licensed Landscape Architect
Professional Landscape Designer
Landscape Maintenance Contractor
D. Resolution Supporting Funding for Engineering Study of Salton Sea Water
Import Alternative
Recommendation: To adopt a resolution requesting that the State allocate
approved funding for an engineering study of the salt water
import alternative.
Charles McClendon introduced Chuck Parker, advocate for the Salton Sea, who
will be presenting an overview of the issues associated with the evaporation of
the Salton Sea.
Chuck Parker, stated that this is a follow-up to the Resolution that the City
Council approved in October 2019, urging state officials to consider all options for
restoration of the Salton Sea including the import of salt water. He provided an
overview of the current situation of the Salton Sea and the issues surrounding it.
He indicated that they are seeking support from the City Council to approve a
Resolution requesting the State to allocate funds to do the required engineering
studies necessary to appropriately consider a water import alternative.
Mayor Pro Tem Raymond Gregory expressed his support of the Resolution
without the inclusion of a dollar amount.
Councilmember Mark Carnevale encouraged the group to reach out to CVAG for
assistance.
Councilmember Ernesto Gutierrez stated that this issue should have been
addressed a long time ago and can't wait for the project to get started.
It was the consensus of the Council to direct staff to bring back a Resolution for

consideration, at a future meeting, to request the State allocate funds to do the
required engineering studies necessary to appropriately consider a water import
alternative with no dollar amount included.

• STATEMENT OF PARTICIPATION BY THE CITY CLERK
1. PUBLIC COMMENT
The following individual provided their public comment via phone call:
Sandra Richter thanked the City Council for phasing-out short-term vacation rentals.
She expressed her concern with petition signature collectors threatening residents.
She also expressed her concern with the short-term vacation rental located behind
her home. She supports the City Council's decision and urged them to stand strong
in their decision.
The following individuals provided a public comment for the record. Their comment
was read for three minutes and the full comment will be made part of the record
according to our standard procedure:
Andrew Foster commented on proposed State Measure 16. He urged the City
Council to reject the measure in the November Election.
Alan Carvalho thanked the City for their responsiveness to his calls regarding an
issue a resident had while trying to drop their ballot off at City Hall. He suggested
that the City include in their Fall mailer, in English and Spanish, all information for
ballot drop off locations and times for the next election.
2. COUNCIL REPORTS
Councilmember Rita Lamb reported that she attended the United Lift pop up events,
which were offering rental assistance to Coachella Valley residents. She announced
that the next event will be held the following Saturday and more information could be
found at unitedlift.org. She was able to visit the Cathedral Palms Senior Living
apartments and reported that they are well into the first phase of their rehab project.
She announced that she participated in the League of California Cities Annual
Conference via Zoom. She reported on the session she attended on the City of
Santee branding and the session related to COVID-19, where they discussed what
has and has not worked for different Cities in their response to the pandemic. She
gave a shout out to the City of Indio for receiving the Helen Putnam Award. She
reported that she participated in a meeting with City Manager McClendon and Police
Chief Crum. She announced that she attended the Salton Sea Kayak event put on
by students to raise awareness. She also met with Cimarron Golf Resort staff and
discussed their safety protocols. She thanked Sandra Molina, Code
Compliance/Development Manager for assisting a resident with a code enforcement
issue. She reminded everyone to go out and cast their votes for the upcoming
election.
Councilmember Ernesto Gutierrez reminded everyone that it is allergy and flu
season and suggested everyone get a flu shot. He reported that he participated in a
meeting hosted by County Supervisor Perez and urged people to get tested for
COVID-19. He stated that the County may be headed back to the purple tier which
could cause businesses to be shut down. It is his hope that the County is able to
stay in the red tier and remain open. He participated, along with Councilmember Rita
Lamb, in a City Hall at Your Corner via Zoom. He also met with City Manager
McClendon prior to the City Council meeting. He reported that he met with City
Engineer John Corella to get an update on current projects and he also met with
Police Chief Crum for an update. He shared an experience that he had this past
weekend at Stater Bros with petition signature collectors, and feels they are
misleading residents and it is unethical. He announced the grand opening of the new

Fire Station located on Date Palm on October 24, 2020.
Mayor Pro Tem Raymond Gregory stated that it has been a busy three weeks. He
reported on the All Valley Mayors and Tribal Chair Town Hall put on by the Greater
Coachella Valley Chamber of Commerce, where Mayor Aguilar did a great job
representing the City. He attended a virtual summit with leadership in the State. He
reported on the Boys and Girls Club Meatball Festival that took place on October 4,
2020 and encouraged everyone to view videos on their website. He participated in
the League of California Cities Annual Conference and training sessions via Zoom,
where he received many updates and good information. He also participated in the
Riverside County Transportation Commission meeting and received updates on
many projects including the interstate 15 project. He announced the upcoming City
Hall at Your Corner, which will be held on October 20, 2020 at 4:00 pm, and the first
ever Parks and Community Events Commission at Your Corner on October 22, 2020
at 2:00 pm. He noted that the Fire Station grand opening event will be a virtual
event. He reminded everyone to continue to wear their masks, keep their distance
and vote.
Councilmember Mark Carnevale was happy to report that the Great Plates program
was extended until November 9, 2020, which made a lot of people happy. He stated
that he had a similar experience with petition signature collectors as Councilmember
Gutierrez and also feels they were misleading residents. He reminded everyone to
help support local small businesses in the City. He announced that the next Dinner
with Patsy will be held on October 21, 2020 at Nicolino's. He reported that he will be
meeting, along with City Manager McClendon and Planning Director Robert
Rodriguez, with a group of developers interested in coming into the City.
Mayor John Aguilar thanked everyone for their comments. He reported that the
United Lift rental assistance program was able to distribute $750,000 of financial
assistance to residents in the Coachella Valley. He also reported the California Tax
Credit Allocation Committee in Sacramento, who deals with funding of affordable
housing projects, approved the final funding for the Veteran's Village Housing
Project. He noted that this project has transitioned over a few Councils along with
the hard work of Administrative Services Director Tami Scott, and thanked everyone
who helped make this project happen.

C. Resolution Adopting an Amended Conflict-of-Interest Code for Cathedral
City
Recommendation: Staff recommends that the City Council approve a
Resolution rescinding Resolution 2018-48 and adopting a
Conflict-of-interest Code applicable to designated positions
by incorporating Regulation 2, California Code of
Regulations, Section 8730 - the Standardized Conflict-of-
interest Code as well as Appendices in which members and
employees are designated and disclosure categories are set
forth.

A. Consider Resolution Establishing Campaign Contribution
Recommendation: To approve a Resolution of the City Council of the City of
Cathedral City, California, establishing campaign
contribution limits and penalties.
Councilmember Mark Carnevale stated that he was not at the Council Meeting
where this item was discussed. He indicated that he feels the contribution limit of
$1500 is too low and he would like to see it at the same level as the State's limit.
Councilmember Ernesto Gutierrez stated that he would support a higher
contribution limit.
MayorPro Tem Raymond Gregory indicated that he does not support the same
limit as the State and he would support a higher limit than $1500, however, he
would not support anything higher than $2,500.
Councilmember Mark Carnevale stated that he would support a limit of $2,500
and a penalty in the amount of$500.
Councilmember Rita Lamb stated that she would support a $2,500 limit.
Councilmember Ernesto Gutierrez stated that he would support a $2,500 limit.

Eric Vail, City Attorney, noted that this Resolution will not be in effect for the
upcoming election and this will allow the City Council to gage the numbers after
the conclusion of the election, and make amendments as needed.

Tem Gregory to approve a Resolution of the City Council of the City of Cathedral
City, California, establishing campaign contribution limits in the amount of$2,500

It was the consensus of the City Council to direct staff to advertise the vacant
seats on the Finance Advisory Committee and to revisit the appointment of the
Coachella Valley Mosquito and Vector Control Board of Trustees in December of
2020.

Recommendation: To appoint two Councilmembers to serve on a subcommittee
with City of Palm Desert Councilmembers to review and
discuss the role of Cathedral City regarding development
within the Cathedral City Sphere of Influence area.

A motion was made by Mayor Aguilar and seconded by Councilmember Lamb to
appoint Mayor Pro Tern Raymond Gregory and Councilmember Ernesto
Gutierrez to serve on a subcommittee with Councilmembers of the City of Palm
Desert to review and discuss the role of Cathedral City regarding development
within the Cathedral City Sphere of Influence area. It was also noted that
Councilmember Mark Carnevale would serve as an alternate in the event one of
the other members was unable to attend.

Road.
Recommendation: To approve a contract with Petrochem Materials Innovation,
LLC. for $313,431.86 to supply and apply Type II, Rubber
Emulsion Aggregate Slurry (REAS) on Ramon Road
between Landau Boulevard and Date Palm Drive, including
traffic control, crack sealing, and striping; and, approve a
fifteen percent (15%) contingency in the amount of$47,015
for unforeseeable construction costs, making the total
encumbrance $360,446.86; and, authorize the City Manager
(or designee) to execute the required contract documents.

F. Urgency Ordinance - Moratorium Prohibiting New Short-Term Vacation
Rental Licenses
Recommendation: To waive reading beyond the title and adopt an Urgency
Ordinance readopting and continuing Ordinance 825
establishing a moratorium on the issuance of Short Term
Vacation Rental permits.
The following individuals submitted a public comment for the record. Their
comment was read for three minutes and the full comment will be made part of
the record according to our standard procedure:
Cyndie and Bruce Swauger thanked the City Council for continuing to support the
phasing out of short-term vacation rentals. They support the proposed urgency
ordinance and suggested the City Council put forth a stronger resolution to

strengthen the protocol for the reporting process.
Matthew Alvarez commented on the current referendum submitted to the City
Clerk and expressed his concern with the City Council considering the proposed
urgency ordinance re-adopting and continuing Ordinance 825 establishing a
moratorium on the issuance of short-term vacation rental permits. He urged the
City Council to reject the urgency ordinance.

K. Update on Emergency Actions Related to COVID-19
Recommendation: Ratify Emergency Order No. 3B - Order Requiring Face
Coverings and Social Distancing in Public Settings
through December 31, 2020.
Update on Status of Emergency Proclamation. Possible
action to continue or rescind Resolution 2020-06.
Update on Emergency Actions taken by City, County,
State of Federal Agencies.
Possible consideration of additional measures to be
taken. Council may add items not listed on the agenda
pursuant to Government Code section 54954.2 by
majority vote.
City Manager Charles McClendon gave an update on actions related to COV1D-
19 and gave an overview on the proposed ratification of Emergency Order No.
38. He encouraged the residents of the City to continue to follow mask and social
distancing requirements.

A motion was made by Mayor Pro Tem Gregory and seconded by
Councilmember Lamb to ratify Emergency Order No. 38 an Order Requiring
Face Coverings and Social Distancing in Public Settings through December 31,
2020.

7. CLOSED SESSION
City Attorney Eric Vail announced that the City Council will meet in closed session to
continue discussion on the following items of the agenda:
• Conference with Real Property Negotiator for approximately 13.5 acres south of
East Palm Canyon Drive.
• Conference with Real Property Negotiator and Warrior Asset Management.
• Public Employee Appointment for Fire Chief
The City Council adjourned to Closed Session at 8:18 p.m.
The City Council reconvened at 9:00 pm.

The City Council met in Closed Session to hold a Conference with Real Property
Negotiator for approximately 13.5 acres south of East Palm Canyon Drive, a
conference with Real Property Negotiator and Warrior Asset Management, and to
discuss Public Employee Appointment for Fire Chief. There was no reportable action
taken.
