DEED OF RESCISSION AND QUITCLAIM DEED WHEREAS, the City of Cathedral City ("City") executed a Quitclaim Deed in favor of the Redevelopment Agency of the City of Cathedral City ("RDA") as Grantee, dated March 5, 2007 and recorded on March 28, 2007, as Instrument No. 2007-0210494 (the "Original Quitclaim Deed")in Official Records of Riverside County, California; and WHEREAS, the RDA was dissolved in accord with the provisions of ABX126 and its assets were transferred to the City in its capacity as the RDA's successor agency ("Successor Agency")under Health and Safety Code section 34173; and WHEREAS, pursuant to California Civil Code Section 1689(a), the City and the Successor Agency (on behalf of the RDA) have agreed to rescind the transfer of the Original Quitclaim Deed with the effect of voiding the transfer ad initio as though the Original Quitclaim Deed had never been executed and recorded (as provided in California Civil Code Section 1688). NOW THEREFORE, the Successor Agency of the former Redevelopment Agency of the City of Cathedral City ("Grantor") hereby remises, releases and forever quitclaims to the City of Cathedral City("Grantee"), all right,title and interest in the following described real property in the County of Riverside, State of California, more particularly described on Exhibit A, which is attached hereto and incorporated herein by this reference. This Deed of Rescission is given and accepted as such in order to rescind the Original Quitclaim Deed.
