1. CLOSED SESSION
Deputy City Attorney Al Ford announced that the City Council will meet in Closed
Session to discuss the following items on the Agenda.
A. Conference with Legal Counsel -Anticipated Litigation - Consideration of
whether to Initiate Litigation Pursuant to Government Code 54956.9(d)(4)

The City Council recessed to Closed Session at 5:32 pm.
The City Council reconvened at 5:48 pm.
Deputy City Attorney Al Ford announced that the City Council met in Closed Session
to discuss Item 1A. Conference with Legal Counsel for anticipated litigation for one
case, and Item 18. Conference with Labor Negotiator and AFSCME. There was no
reportable action taken.

There were no public comments submitted for the record.
3. STUDY SESSION
A. Discussion of Council Meeting Times
Recommendation: This item is presented for information, discussion and
direction only.
Councilmember Ernesto Gutierrez, stated that he brought up this item due to the
fact that some of the meetings go late into the evening. He feels the hours are
long for both the City Council and for staff. He indicated that he some research
and many other cities start earlier in the day. He stated that he would like to start
the meetings a little earlier in the day.
Councilmember Mark Carnevale, stated that some of the nights are long but he is
willing to put in the time, however, he is not opposed to starting earlier. He feels
staff works long hours and starting earlier may be a good idea. He is open to
possibly starting at 3:00 pm for Study Session and 4:00 pm for the Regular
Meeting but he is open to other suggestions.
Councilmember Rita Lamb would be open to any change. She stated that as a
constituent who worked, she found the 6:30 pm hour was appropriate for her to
attend meetings, however, she would support a start time of 3:00 pm or 4:00 pm
as well.
Mayor Pro Tern Raymond Gregory expressed his concern with starting meetings
too early and feels it could be problematic for those people who work. He would
support moving the Regular meeting to 5:30 pm or 5:00 pm, if public comment
was moved to the end of the Agenda. He also expressed his concern with earlier
times possibly prohibiting someone from running for City Council. He stated that
he attends the Riverside County Transportation Committee meetings and
Sun Line meetings which are on Wednesdays and starting earlier than 3:00 pm
could be problematic for him.
Mayor John Aguilar, stated that Council Meeting start times has been discussed
in the past. He has a general concern with public access to the meetings if the
start too early, however, he is open to some modification as long as it can be
revisited.

City Manager Charles McClendon stated that the City Could would need to
approve a Resolution establishing dates and times of the Council Meetings,
which can be revisited at any time.
Councilmember Ernesto Gutierrez suggested starting the Study Session
meetings at 3:00 pm and the Regular meeting at 4:00 pm.
Councilmember Mark Carnevale would support starting Study Session Meeting
at 3:00 pm and Regular meeting at 4:00. He also suggested having varying start
times for the Study Session meetings depending on the amount of Closed
Session items.
Mayor Pro Tem Raymond Gregory supports starting the Regular meeting at 5:30
pm or 5:00 pm if public comment can be moved to the end of the Agenda. He
does not support anything earlier than 5:00 pm.
Councilmember Mark Carnevale concurred with Mayor Pro Tem Raymond
Gregory and would support a start time of 5:00 pm for the Regular Meeting.
Mayor John Aguilar supports a 5:00 pm or 5:30 pm start time for a trial period.
It was the consensus of the City Council to direct staff to bring forward a
Resolution establishing the Regular City Council Meeting start time to be 5:00
p.m. with Public Comment at the end of the Agenda.

• SPECIAL PRESENTATION FOR OUTGOING COMMISSIONERS
City Manager Charles McClendon thanked the outgoing Commissioners for their
service to the City and the community. He introduced each outgoing Commissioner
and gave a brief background of their service.
Councilmember Mark Carnevale and Councilmember Ernesto Gutierrez presented
each outgoing Commissioner with a certificate of recognition.
• STATEMENT OF PARTICIPATION BY THE CITY CLERK
1. PUBLIC COMMENT
The following individuals provided public comment via phone call:
Jonathan Dearin, spoke on short-term vacation rentals, which he feels are a viable
revenue source for the City. He urged the City Council not to implement a cap on the
number of rentals per property per year and instead devote resources to better
enforcement.
Teri Hargreaves, Cathedral City, described a recent incident where a short-term
vacation renter entered her backyard. She feels this is the problem with short-term
vacation rentals, as they bring strangers into the neighborhoods and she never
knows who is coming next. She also feels that no amount of money for enforcement
can solve this issue and urged the City Council to put themselves in her shoes when
they make their final decision.
Sandra Richter, thanked the City Council for their efforts during the current
pandemic. She expressed her concern with short-term vacation rentals allowing
people from other places to come in with this dangerous disease. She stated that a
short-term vacation rental near her is not following State guidelines for time between
occupancy. She also described and incident with an owner of a short-term vacation
rental which resulted in the owner threatening her and the police coming to her door.
She urged the City Council to eliminate short-term vacation rentals.
Brad Anderson, Rancho Mirage, spoke about the mosquitoes in the Coachella
Valley and feels the Vector Control District has been poor managed for many years.
He urged the public to voice their opinions at the next board meeting.
2. COUNCIL REPORTS
Councilmember Rita Lamb stated that she had a busy week. She reported that she
met with residents from Tierra Del Sol and with Public Arts Commissioner Sue
Townsley. She stated that the recent City Hall at Your Corner via Zoom was a
success. She also participated in Conferences with the League of California Cities
via Zoom. She welcomed Quick Quack Car Wash to the community. She reported
that she received a call from a concerned gentleman regarding the state of Varner
Road.
Councilmember Mark Carnevale hopes everyone had a happy 4th of July Holiday.
He stated that he also participated in the City Hall at Your Corner Zoom meeting,
which went well, and feels a lot was accomplished. He also received the update
from Supervisor Perez. He reported that he, along with Greg Rodriguez, spoke to
the Palm Springs Elks Lodge Board regarding having a possible cooling center. He
feels they are more interested in what we can do for them instead of what they can
do for us. but they haven't said no yet. He noted that last week a few employees
were laid off due to reductions related to COVID-19. It is his hope that we start to
recover and can bring those employees back.

He saw a lot of fireworks and believes that many residents do not realize that
fireworks are illegal in the City now. He participated in the Greater Palms Springs
Visitors Bureau Meeting via Zoom, where they discussed their budget adjustments,
layoffs, the "Safer Together Greater Together"health campaign and their advertising
campaign. He indicated that the advertising campaign is limited due to the new State
orders related to restaurants and bars. He feels that the City relies too much on the
hospitality industry and there is a need to diversify and stabilize the economy. He
reported that he met with City Manager Charles McClendon and Police Chief
George Crum and plans to have regular meetings with the Chief so he knows what
is going on and what the needs of the Police Department are. He stated that over
the last two weeks he has received a lot of complaints regarding short-term vacation
rentals and loud music. He reminded everyone that on July 29, 2020 at 8:00 a.m.
there will be a special meeting to discuss short-term vacation rentals and the future
of them. He reminded everyone to support local businesses.
Mayor Pro Tem Raymond Gregory reported that he has been busy over the last two
weeks. He attended online training for the League of California Cities, which was
very helpful. He along with Councilmember Gutierrez and City Manager McClendon
attended a sub-committee meeting with the members of the Parks and Community
Events Commission. He feels that they have some great ideas. He attended the
CVAG Executive meeting, which was done on-line. He stated that he was pleased
with the number and quality of applicants that were interviewed at the recent special
meeting to fill the vacant seats on the Commissions. He feels that the City Council
made some great appointments and looks forward to working with these individuals.
He welcomed Quick Quack Car Wash to the community and wished them the very
best. He thanked the Police and Fire Departments for all that they have done related
to Fireworks. He reminded everyone to stay cool and hydrated.
Mayor John Aguilar commended the Council for all of their work during this trying
time. He reported that his focus has been to protect the community and he urged the
community to watch the numbers as they are increasing. He stated that the City is
doing what they can to get information out to the community. He thanked the Great
Plates program for providing meals and thanked all of the restaurants that
participated in the program.

City Manager Charles McClendon introduced Public Works Manager Deanna
Pressgrove.
Ms. Pressgrove presented the staff report on the Burrtec 2021 Rate Increase.
Mayor John Aguilar opened the Public Hearing.
City Clerk Tracey Martinez stated that there were no public comments received.
There were seven valid written protest to the rate increase that was received.

Mayor Pro Tern Raymond Gregory thanked staff and Burrtec for all their work on
this agreement.
Councilmember Rita Lamb thanked Deanna Pressgrove for the wonderful
presentation. She expressed her happiness that some services are being
modified to continue.
Councilmember Mark Carnevale thanked staff and Burrtec. He feels people don't
like rate increases but for what they do there is value for the amount paid.
Councilmember Ernesto Gutierrez thanked Burrtec for delaying the rate increase
for residents and businesses. He feels they offer many great services to the
residents.
Mayor John Aguilar concurs with his colleagues' comments.

C. Zone Ordinance Amendment No. 20-001 Cannabis Billboard Advertising
Recommendation: To hold a public hearing and introduce and provide first
reading, by title only, to an ordinance amending Section
9.62.070A (Billboard Signs) of the Municipal Code regulating
the placement of billboards advertising cannabis within the
City of Cathedral City.
City Manager introduced Planning Director Robert Rodriguez.
Mr. Rodriguez presented the staff report on the ZOA 20-001 Cannabis Billboard
Ordinance.
Mayor John Aguilar opened the Public Hearing.
City Clerk Tracey Martinez stated that there were no public comments received
for this item.
Mayor John Aguilar closed the Public Hearing and returned discussion to the
Council.
Councilmember Ernesto Gutierrez feels that churches and rehabilitation facilities
should be included. He also feels that if we require a 250 feet distance from
single family homes for dispensaries, we should also require the same distance
for billboards that advertise cannabis. He questioned which billboards are located
on tribal land.
Mr. Rodriguez gave a brief overview of where the billboards are located.
Councilmember Mark Carnevale questioned if there are restrictions on cannabis

billboard clusters in one area.
Mr. Rodriguez responded that it is staffs intent to be consistent with the Business
and Professional Code, and there are no restrictions. He stated that the City's
Billboard Ordinance does limit the number of billboards in the City.
Councilmember Mark Carnevale stated that he is not a fan of billboards in the
City and feels that the cannabis billboards give the wrong image for the City. He
questioned what can legally be done to add prohibitions.
Assistant City Attorney Al Ford responded that the City cannot authorize
something that could amount to a functional outright ban. He stated that
approving too many restrictions will increase the risk of being challenged on that
basis. The ordinance presented tonight seems to fall within the constitutional and
legal musters. If the City Council would like to further restrict, we would have to
go back and further evaluate. He also stated that the restrictions proposed by
Councilmember Gutierrez could become problematic.
There was some question regarding the limits on tobacco billboards in 1999.
Assistant City Attorney Al Ford explained that in those cases the restrictions on
tobacco and alcohol billboards did not amount to outright bans.
Councilmember Rita Lamb questioned who is responsible for regulating the
billboards.
Mr. Rodriguez responded that they have worked very closely with Lamar and
they are in agreement and aware of the restrictions.
Mayor Pro Tem Gregory asked for clarification on the proposed changes
compared to current State law.
Mr. Rodriguez referred to the Business and Professions Code. He also gave a
brief overview of the Library details that were added. He also stated that by
adopting this ordinance, the City will be able to cite using our code. He also
clarified that the depiction of characters attracting and advertising to children will
affect all twenty billboards.
Mayor Pro Tem Raymond Gregory would like to continue to explore the
possibility of further prohibitions including the recommendations by
Councilmember Gutierrez. However, he does not want to scrap what is being
proposed tonight after a year-long effort.
Mayor John Aguilar endorsed Mayor Pro Tem Raymond Gregory's comments.
He stated that this has been a multi-year process, and he along with other
members of the Council have been a strong component of doing something
about the content and density of these billboards. He would like staff to do further
research on expanding the prohibitions, however, he strongly recommends the
Council approve the proposed version tonight.

only, an ordinance amending Section 9.62.070A (Billboard Signs) of the
Municipal Code regulating the placement of billboards advertising cannabis
within the City of Cathedral City.

Recommendation: To approve the Public Arts Commission's recommendation
to accept two mounted photographs memorializing Artist
Cristopher Cichocki's 2019 Desert Abyss project.
The following individual provided public comment via phone call:
Brad Anderson, Rancho Mirage, urged the City Council to table this item until
there are sufficient resources and focus on essential items only during this critical
time.
A motion was made Councilmember Gutierrez not to approve the acceptance of
mounted photographs memorializing Artist Cristopher Cichocki's 2019 Desert
Abyss project.
Motion fails due to a lack of a second.

D. Update on Emergency Actions Related to COVID-19
City Manager Charles McClendon provided an update on Emergency actions related
to COVID-19. He gave an overview on the educational campaign, which is well
underway. He stated that graphics have been finalized and Mayor Aguilar has filmed
a video, which is available on DiscoverCathedralCity.com, Facebook, Nextdoor,
Youtube, and Channel 17. There will be bilingual posters placed at twenty SunLine
terminals, which should go up next week. A digital ad has gone up in the festival
lawn and auto center billboards and they have secured one digital and three print

billboards from Lamar. A bilingual postcard will be sent out to residents within 2-3
weeks. There will be three large banners placed in the parks tomorrow. The City will
also print posters in house and provide the key stakeholders and community benefit
organizations.
He stated that today was the single highest day in terms of new COVID-19 cases in
Cathedral City. The average over the last ten days has not shown an increase, and
we remain in the 20-24% range of new cases a day over the last 10 days. He
indicated that due to the pandemic the volume of traffic at the emergency rooms has
increased and has significantly increased our ambulance services need. The City is
recommending that we staff up a third ambulance and overtime, which should be
reimbursed through FEMA and money allocated from the State.
The following individual provided public comment via phone call:
Terry Applegate, Cathedral City, stated that Eisenhower Hospital just converted their
entire second floor into a COVID unit. She quoted a medical doctor and stated that
she shares his rage. She gave a brief update on the current case numbers. She also
expressed her concern with Councilmember Gutierrez voting against wearing masks
and feels it is a disservice to the community. She also expressed her concern with
testing and results procedures currently in place and the lack of mask for medical
personnel.
Councilmember Ernesto Gutierrez requested that staff update the Council in a
month on figures and expenditures related to the fire department and ambulance
services.
Mayor Pro Tem Raymond Gregory questioned if the Council is legally dotting their
"l's" and crossing their "T's" and questioned if the City should declare a fiscal
emergency.
Assistant City Attorney Al Ford responded that there have been discussions about
the possibility of declaring a fiscal emergency and what would mean. He stated that
it would allow for transparency, however, from a legal standpoint it would not change
any of the obligations or rules the City Council still has to follow.
Mayor John Aguilar concurs with Mayor Pro Tem Raymond Gregory and would like
staff to look into it.
City Manager Charles McClendon stated that it is just a matter of preparing the
declaration and bringing it forward on an agenda. He stated that the City has the
authority to implement the recommendations for the Fire Department needs with the
general support of the City Council.
Councilmember Rita Lamb asked for clarification on the possible reimbursements.
City Manager McClendon gave a brief overview on the eligible reimbursements.
