• CALL TO ORDER
Mayor Stan Henry called the Study Session Meeting of March 8, 2017 to order at 4:30 p.m.

1. PUBLIC COMMENT
Alan Carvalho, Cathedral City, was called to speak.He announced that there will be a Woman's March in Palm
Springs today at 5:00 p.m.
2. STUDY SESSION
2.A. 2017-89 Short Term Vacation Rental (STVR)Task Force Recommendations
Charles McClendon, City Manger,reported that the City Council directed staff to appoint an ad-hoc task force to
study issues related to short term vacation rentals in Cathedral City and to report back to the Council with
recommendation. The Task Force held their first meeting on October 19, 2016 and has been meeting twice a
month since that time. He provided an overview of their discussions and their recommendations from the Task
Force for Council to discuss. He indicated that it is Staff's plan to bring an Ordinance to the City Council for
consideration on March 22, 2017.
Chris Harami, Cathedral City, was called to speak. He stated that he owns two STVR properties. He stated that
they have been playing by the rules. Generally he does not have a problem with the Ordinance, however, he feels
that it will be hard to inspect the properties, there could be different rules for different size of rentals, the fee is
high and the noise levels should be the same whether it is a vacation rental or property owner.
J. Dove, Cathedral City, was called to speak. He expressed his concern with punishing everyone. He feels that
those who are breaking the rules should be paying the higher fines. He feels that the fines should be substantial
instead of raising the fees for everyone.
Jeremy Ogul, Home Away, was called to speak. He stated that Home Away would like to be a strong partner with
the City and will provide any assistance they can.
Bethany Ballard, Cathedral City, was called to speak. She feels that the restrictions on the short term vacation

rental properties are going too far. She feels that there are plenty of laws already in place that should be
enforced.
Mayor Henry stated that the City will consider all of the comments that were made when preparing the final
Ordinance.
2.B. 2017-85 2016 Crime Statistics Update
George Crum, Chief of Police,presented the 2016 Crime Statistics to the City Council.
2.C. 2017-92 Biennial Budget Overview Presentation
Tami Scott,Administrative Services Director,gave an overview of the biennial budget process for FY 2017-2018
and FY 2018-2019. She also went over some of the additions that were incorporated in the proposed budget
workbook.
Alan Carvalho, Cathedral City, was called to speak. Questioned why the dance center is still getting funded by
the City. He questioned how the City compares to what other cities charging for cultivation of cannabis and that
this should be considered when setting the fees moving forward.
3. CLOSED SESSION
Eric Vail, City Attorney, announced that the City Council will meet in Closed Session to discuss the items listed
on the Agenda.
The City Council recessed to Closed Session at 6:05 p.m.
3.A. 2017-87 Conference with Real Property Negotiator Pursuant to Government
Code Section 54956.8.
Property Location: Approximately 12.5 acres at the Northwest Corner of
East Palm Canyon Drive and Date Palm Drive.
Negotiating Parties: City of Cathedral City as Successor Agency to the
former Redevelopment Agency and the City Urban Revitalization
Corporation,
Property Owners: City Urban Revitalization Corporation
Under Negotiations: Price and Terms for potential purchase of real
property.
3.B. 2017-88 Conference with Real Property Negotiator Pursuant to Government
Code Section 54956.8.
Property Location: Approximately 1.8 acres north on Mission Drive by
APN's 677-382-005 through 008
Negotiating Parties: City of Cathedral as the Housing Successor
Agency and Mario Perez, Inc.
Property Owner: City of Cathedral City as Housing Successor Agency
Under Negotiations: Price and Terms for potential sale of real property

3.D. 2017-54 City Council: Public Employee Performance Evaluation Per
Government Code Section 54957 (B)Title: City Manager
The City Council recessed to Closed Session at 6:05 p.m.
The City Council reconvened at 6:30 p.m.
City Attorney Eric Vail announced that the City Council met in Closed Session to discuss the following:
Conference with Legal Counsel-Anticipated Litigation Significant exposure to litigation pursuant to paragraphs(d)
(2)and(e)(1)of the Government Code. Two(2)matters
There was no reportable action taken.
He also stated that item 38. Conference with Real Property Negotiator Pursuant to Government Code Section
54956.8. regarding property located approximately 1.8 acres north on Mission Drive by APN's 677-382-005 through
008. The remaining items will be herd following the Regular Meeting Agenda of March 8, 2017 and will be
reflected in the minutes.

Mayor Stan Henry called the March 8, 2017 Regular Meeting of the City Council to order at 6:37 p.m.

1. PUBLIC COMMENT
Roger Culbertson, Cathedral City, was called to speak. He announced that March 10th is the Second Annual
Chamber of Commerce Day. It is the desire of the Chamber to continue maintaining their great working
relationship with the City.
Pastor Jeff Osborne, Pastor at Destiny Church in Palm Desert, was called to speak. He reported that they are
launching a campus in Cathedral City. The first service will be held on April 9th at 9:00 a.m. and 11:00 a.m. at
the Pickford Theater.
Rosario Avila, Cathedral City, was called to speak. She stated that the Agreement attached to Item 2C on the
Agenda listed Palm Springs as a Charter City and Cathedral City as a Municipal Corporation. She questioned why
Cathedral City was not listed at a Charter City. She stated that this is a big project and wants to make sure we
are involved in the discussions and the affect it will have on Cathedral City and the businesses in the area.
Bethany Ballard, Cathedral City, was called to speak. She questioned if the City requires inspections for the short
term vacation rentals and adopts an Ordinance to manage them can the City be liable for them if something
happens.

2.A. 2016-569 Authorization for Roof Replacement on the Public Works Building
and Adjacent Maintenance Utility Building
A motion was made by Council Member Aguilar,seconded by Council Member Kaplan,to approve the
authorization of a complete reroofing of the Public Works Building and the adjacent Maintenance
Utility Building located at 68385 Kieley Road for an amount not to exceed$54,144.The motion carried
by the following vote:

Pat Milos, Community Development Director,presented the Appeal of Planning Commission denial of Conditional
Use Permit 16-007 for Sunshine Coast Wellness, 28201 Date Palm Drive, Suite B&C. He stated that the City
Council may affirm, modify or reverse the Planning Commission decision.
Allen Cooper, applicant for Sunshine Wellness. He indicated that modifications have been made by the property
owner that will be in compliance to the set-back requirement from a residential zone.
Mayor Henry opened the Public Hearing for discussion.
Clint Jackson, Cathedral City, was called to speak. He indicated that he looked at this particular piece of
property himself and was told it did not meet the set-back requirements. He has had a professional survey done
on the property and feels that it does not meet the requirements of the code.
Council Member John Aguilar stated that he has a growing concern with the number of dispensaries and
cultivation sites as well as the billboards that are displaying cannibas ads.
Council Member Mark Carnevale expressed his concern with the advertsing on billboards regarding cannabis and
some of the cannabis businesses that have large signs on their business.
Mayor Pro Tem Greg Pettis stated that the signs are not the issue of this appeal. The question is does his
application meet the code.
Mayor Henry closed the Public Hearing.
A motion was made by Council Member Kaplan,seconded by Mayor Pro Tem Pettis,to accept the
appeal of Planning Commission denial of Conditional Use Permit 16-007 for Sunshine Coast Wellness,
28201 Date Palm Drive,Suite B&C and to issue a Conditional USe Permit.The motion carried by the
following vote:
Aye: 3- Mayor Pro Tern Pettis, Council Member Kaplan, and Council Member Carnevale
Nay: 2- Mayor Henry, and Council Member Aguilar

4. LEGISLATIVE ACTIONS
4.A. 2017-95 Adoption of Resolutions Initiating Procedures for Establishing and
Implementing By-District Elections for City Council Members and
Specifying the Criteria to Guide the Establishment of Electoral
Districts
Vera Martinez, Cathedral City, was called to speak. She indicated that she is interested in getting involved and
questioned if there will be an opportunity for the community to engage in the process.
Bethany Ballard, Cathedral City, was called to speak. She requested what the definition of protected class is.
A motion was made by Council Member Aguilar,seconded by Council Member Carnevale,to approve
a Resolution Initiating Procedures for Establishing and Implementing By-District Elections for City
Council Members and a Resolution Specifying the Criteria to Guide the Establishment of Electoral
Districts.The motion carried by the following vote:

5. COUNCIL REPORTS
Council Member John Aguilar, announced that today is International Woman's Day. He congratulated Chris
Parman and all those involved in the Big Dashy. He attended the California Jazz Foundation that was held. It
was an amazing event. The jazz performance at the end of the day was wonderful.
Council Member Mark Carnevale, thanked the Fire Department and Police Chief for doing a great job. He feels
that all woman should be recognized on this day, International Woman's Day and every day.
Council Member Shelley Kaplan stated that College of the Desert has be giving presentation on their master plan.
He would love to see COD come to Cathedral City. He reported that a program, hosted by Wells Fargo Bank, for
new home buyers was held. There was not a great turn-out but another one will be held at the Cathedral City
Library. He attended the Coachella Valley Symphony Event, which was great event.He also reported Citizen's on
Patrol will be holding a pancake breakfast on Saturday at the Date Palm County Club. The Day of the Young
Child Event will also be held on the same day. He reminded everyone that Day Light Savings will begin this
weekend. He announced that the Relay for Life event will be held on March 18, 2017 at Cathedral City High
School. The Historical Society Event will be holding a modified antique road show at the Senior Center. The
State of the City will be held on March 21, 2017 at 11:00 a.m. and Palm Springs Unified School District will be
dedicating the new swimming pool at Cathedral City High School at 3:00 p.m.
Mayor Stan Henry reported that he attended the CVAG Executive Meeting last Monday and they voted to approve
10 million dollars in grants for Pedestrian and Bicycle Safety projects. Staff will be looking at opportunities to
apply for these grant monies. On Friday he participated in the Read Across American Program at Cathedral City
Elementary School,he read Cat in the Hat to a second grade class. He reported that within the next 30 days
ground breaking should take place on CVLink. He requested that on a future Study Session Agenda an item to
discuss naming a landmark in honor of Supervisor John Benoit.

City Attorney Eric Vail announced that the City Council will meet in Closed Session to discuss Items 6A. and 6D.
The City Council adjourned to Closed Session at 8:02 p.m.
