HomeMy WebLinkAboutRecorded doc 2016-059 2016-059 oa O I!o DOC# 2016-0145236 04/13/2016 12:41 PM Fees: $24.00 Page 1 of 4 Recorded in Official Records County of Riverside Peter Aldana Assessor-County Clerk-Recorder When Recorded Return to: } CITY OF CATHEDRAL CITY } **This document was electronically submitted CITY CLERK } to the County of Riverside for recording" 68700 Avenida Lalo Guerrero } Receipted by: LINDA#922 Cathedral City, CA 92234 } } CERTIFICATE OF COMPLIANCE • NO. 2016-482 (Government Code Sec. 66499.35) WHEREAS, an application for a Certificate of Compliance No. 2016-482, to determine that nine (9) parcels of real property located on the south side of Rio Pecos Drive and on the north side of Rio Vista Drive, in the City of Cathedral City, comply with the provisions of the Subdivision Map Act and local ordinances was received by the City of Cathedral City from the record owner of said parcels:Verano Recovery, LLC, a California limited liability company; and WHEREAS, the said nine parcels consist of all or portions of Lots 3,4, 5,6, 7, 8,65, 66, 67, and 68, all of Tract No. 28639-1, as per map filed in Book 300,at Pages 53 through 66, inclusive, of Maps, Records of Riverside County, California (Assessor Parcels APN 677-551-025, 027, 028, 029, 031, 032, 033 and a portion of APN 677-551-030); and WHEREAS, prior owners of said parcels applied to the City of Cathedral City for approval of lot line adjustments on said parcels, to change their sizes and configurations for development, and as a result of such applications, the following lot line adjustments were approved and recorded: Certificate of Compliance for Lot Line Adjustment No. 2004-400, recorded on April 15, 2005, as Instrument No. 2005-0297757, in Official Records of Riverside County, California; and Certificate of Compliance for Lot Line Adjustment No.2004-401, recorded on March 11, 2005, as Instrument No. 2005-0197073, in Official Records of Riverside County, California; and Certificate of Compliance for Lot Line Adjustment No. 2005-402, recorded on March 11, 2005, as Instrument No. 2005-0197074, in Official Records of Riverside County, California; and Certificate of Compliance for Lot Line Adjustment No.2004-409, recorded on March 11, 2005, as Instrument No. 2005-0197075, in Official Records of Riverside County, California; and • Certificate of Compliance for Lot Line Adjustment No. 2005-431, recorded on August 3,2006, as Instrument No. 2006-0569754, in Official Records of Riverside County, California; and 1 DOC#2016-0145236 Page 2 of 4 WHEREAS, the provisions of Section 66412 (d) of the State Government Code (Subdivision Map Act) require that the adjustment of land in a lot line adjustment shall be reflected in a deed which shall be recorded; and WHEREAS, the prior owners recorded deeds to effectuate the creation of Parcels "A", "B" and "C" as described in the above Lot Line Adjustment No. 2004-401, involving Lots 1, 2, and a portion of Lot 3 of said Tract No. 28639-1, but did not record deeds to effectuate the creation of Parcel "D" as described in Lot Line Adjustment No. 2004-401; and WHEREAS, approval of the above listed lot line adjustments was contingent upon the prior owners of the parcels to record deeds to effectuate the adjustments, but the recordation of the needed deeds to effectuate the adjustments never took place on Lot Line Adjustments No. LLA 2004-400, LLA 2004-402, LLA 2004-409,or LLA 2005-431; and WHEREAS, the present owners of said parcels now wish the City of Cathedral City to rescind the former approved lot line adjustments LLA 2004-400, LLA 2004-402, LLA 2004-409, and LLA 2005-431, and to return the parcels involved in these adjustments to their original status as existed prior to the said lot line adjustments, by the issuance of a Certificate of Compliance to that effect; and WHEREAS,the present owners also wish to have Parcel"D"of Lot Line Adjustment No. 2004-401, recognized as a legal parcel, and desire the City to issue a Certificate of Compliance to that effect; and WHEREAS, said application for a Certificate of Compliance has been duly reviewed in accordance with the Municipal Code of the City of Cathedral City. NOW, THEREFORE, in accordance with the applicable provisions of the State Subdivision Map Act and with local ordinances enacted pursuant thereto, the following findings and approvals are hereby made: 1. The approvals of Lots Line Adjustments No. LLA 2004-400, LLA 2004-402, LLA 2004-409, and LLA 2005-431 are hereby rescinded, and the adjusted parcels as described in the following listed Certificates of Compliance for said lot line adjustments shall be deemed null and void upon the recordation of this instrument: Certificates of Compliance for: Lot Line Adjustment No. 2004-400, recorded on April 15, 2005, as Instrument No. 2005-0297757; and for Lot Line Adjustment No. 2004-402, recorded on March 11, 2005, as Instrument No. 2005-0197074; and for Lot Line Adjustment No. 2004-409, recorded on March 11, 2005, as Instrument No. 2005-0197075; and for Lot Line Adjustment No. 2005-431, recorded on August 3, 2006, as Instrument No. 2006-0569754, all in Official Records of Riverside County, California; 2 DOC#2016-0145236 Page 3 of 4 2. Lots 5, 6, 7, 8, 65, 66, 67, and 68 of Tract No. 28639-1, as per map filed in Book 300, at Pages 53 through 66, inclusive, of Maps, Records of Riverside County, California, are hereby restored to their original configuration,size and status as shown on the recorded map of Tract No. 28639-1 and are hereinafter designated as legal lots, entitled to such rights and privileges as are accorded them by law: 3. Parcel "0" as described in the Certificate of Compliance for Lot Line Adjustment No. LLA 2004-401, recorded on March 11, 2005, as Instrument No. 2005- 0197073, in Official Records of Riverside County, and as described in Exhibit"A",which is attached hereto and made a part hereof, is hereby designated as a legal parcel,entitled to such rights and privileges as are accorded it by law. This Certificate of Compliance relates only to issues of compliance or noncompliance with the Subdivision Map Act and local ordinances enacted pursuant thereto. The lots and parcels as described in Subparagraphs 2 and 3 above may be sold, leased, or financed without further compliance with the Subdivision Map Act or any local ordinance enacted pursuant thereto. Development of the said parcels described above or their subdivision, adjustment or merger may require issuance of a permit or permits, or other grants or conditions of approval.
