HomeMy WebLinkAboutCC Reso 2020-01 RESOLUTION NO. 2020-01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY, CALIFORNIA ACKNOWLEDGING RECEIPT OF A REPORT, MADE BY THE FIRE CHIEF OF THE CATHEDRAL CITY FIRE DEPARTMENT, REGARDING THE REQUIRED INSPECTION OF CERTAIN OCCUPANCIES AND THE PERFORMANCE OF ANNUAL INSPECTIONS IN SUCH OCCUPANCIES PURSUANT TO SECTIONS 13146.2 AND 13146.3 OF THE CALIFORNIA HEALTH AND SAFETY CODE. WHEREAS, California Health & Safety Code Section 13146.4 was added in 2018, and became effective on September 27, 2018; and, WHEREAS, California Health & Safety Code Sections 13146.2 and 13146.3 requires all fire departments, including the Cathedral City Fire Department, that provide fire protection services to perform annual inspections in every building used as a public or private school, hotel, motel, lodging house, apartment house, and certain residential care facilities for compliance with building standards, as provided and, WHEREAS, California Health & Safety Code Section 13146.2 requires all fire departments, including the Cathedral City Fire Department, that provide fire protection services to report annually to its administering authority on its compliance with Sections 13146.2 and 13146.3 and, WHEREAS, the City Council of the City of Cathedral City intends this Resolution to fulfill the requirements of the California Health & Safety Code regarding acknowledgment of the Cathedral City Fire Department's compliance with California Health and Sections 13146.2 and 13146.3. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cathedral City that said City Council expressly acknowledges the measure of compliance of the Cathedral City Fire Department with California Health and Safety Code Sections 13146.2 and 13146.3 in the area encompassed by the City of Cathedral City, as follows: A. EDUCATIONAL GROUP E OCCUPANCIES: Educational Group E occupancies are generally those public and private schools, used by more than six persons at any one time for educational purposes through the 12th grade. Within the City of Cathedral City, there are 11 Group E occupancies, buildings, structures and/or facilities. 1 1. Cathedral City High School, 69250 Dinah Shore Dr. 2. San Jacinto High School, 30800 Landau Blvd. 3. James Workman Middle School, 69300 30th Ave. 4. Nellie Coffman Middle School, 34603 Plumley Ave. 5. Cathedral City Elementary School, 69300 Converse Rd. 6. Sunny Sands Elementary School, 69310 McCallum Way. 7. Landau Elementary School, 30310 Landau Blvd. 8. Agua Caliente Elementary School, 30800 San Luis Rey Dr. 9. Rio Vista Elementary School, 67700 Verona Rd. 10. First School of the Desert, 69440 McCallum Way. 11. Kings School, 67675 Bolero Rd. During calendar year 2019, the Cathedral City Fire Department completed the annual inspection of 11 Group E occupancies, buildings, structures and/or facilities. This is a compliance rate of 100 % for this reporting period. B. RESIDENTIAL GROUP R OCCUPANCIES: Residential Group R occupancies, for the purposes of this resolution, are generally those occupancies containing sleeping units, and include hotels, motels, apartments (three units or more), etc. as well as other residential occupancies (including residential care facilities). These residential care facilities have a-number-of different sub-classifications, and they may contain residents or clients that have a range of needs, including those related to custodial care, mobility impairments, cognitive disabilities, etc. The residents may also be non-ambulatory or bedridden. Within the City of Cathedral City there are 499 Group R (and their associated sub-categories) occupancies of this nature. • 425 Short Term Vacation Rentals • 49 Residential Care Facilities • 19 Apartment Buildings (greater than 3 units) • 6 Hotels or Motels 499 Total Group R Occupancies During calendar year 2019, the Cathedral City Fire Department completed the annual inspection of 499 Group R occupancies, buildings, structures and/or facilities, totaling 1,206 actual inspections that include follow-ups for compliance. This is a compliance rate of 100 % for this reporting period. FISCAL IMPACT: There is no fiscal impact in completing the fire inspections for Group E and Group R occupancies, as these services are performed by a full-time fire inspector. The Group E and Group R occupancies inspections have been within the scope of the fire inspector's annual responsibilities, prior to the State mandate. The 499 residential care facilities are a new legislated occupancy type requiring an annual inspection.
