INTERVIEWS FOR HISTORIC PRESERVATION COMMITTEE 3:30 PM A. Interview Applicants for the Historic Preservation Committee Recommendation: To interview the applicants that have submitted applications for possible appointment to fill two vacant seats on the Historic Preservation Committee. Charles McClendon, City Manager, announced that applicant John Harper notified staff that he was unable to attend interviews. He stated that applicant John Rivera wished to be considered for an appointment and has agreed to submit his resignation from the Planning Commission if appointed to the Historical Preservation Committee. Applicant Julianne Middleton was interviewed for the Historical Preservation Committee. The City Council will consider making appointments to the Historical Preservation Committee during the Regular Meeting of January 8, 2020. Mayor John Aguilar announced that the City Council will recess to Closed Session at 3:45 pm. 2. CLOSED SESSION Eric Vail, City Attorney, announced that the City Council will meet in Closed Session to discuss the following items on the agenda. A. Conference with Labor Negotiator Pursuant to Government Code Section 54956.6 Agency Negotiator: Charles McClendon, City Manager Represented Employees: AFSCME - The American Federation of State, County and Municipal Employees CCPOA - Cathedral City Police Officers Association CCPMA - Cathedral City Police Management Association CCPFA - Cathedral City Firefighters Association CCFMA - Cathedral City Fire Management Association The City Council recessed to Closed Session at 3:45 pm. The City Council reconvened at 4:08 pm. Eric Vail, City Attorney, announced that City Council met in Closed Session to discuss item 2A. Conference with Labor Negotiator and AFSCME, CCPOA, CCPMA, CCPFA and CCFMA, there was no reportable action taken. • STATEMENT OF PARTICIPATION BY THE CITY CLERK 3. PUBLIC COMMENT 4. STUDY SESSION A. Update from SunLine Transit Agency Recommendation: This is a presentation only, there is no action required with this item. Lauren Skiver, General Manager/CEO of Sunline Transit Agency, thanked Mayor Pro Tern Gregory for his leadership and support of their organization. She provided an update on the services SunLine Transit Agency and their alternative fuel solutions. Councilmember Ernesto Gutierrez questioned if there are other agencies that are also operating hydrogen vehicles. He also questioned how many miles a hydrogen vehicle can travel on a full tank and the cost per mile. Lauren Skiver stated that there are other transit agencies operating hydrogen vehicles in Oakland, Orange County and Ohio. She stated that a vehicle on a full fill of hydrogen can travel 350 miles and an all battery electric bus on a full charge can travel from 120-140 miles. She stated that zero emission vehicles are more expensive, however, hydrogen is more stable and the economy on a Cathedral City Page 2 Printed on 1/16/2020 hydrogen vehicle is better which allows you to set your budget in a certain way. The more vehicles you produce and use the cost goes down. Councilmember Mark Carnevale asked for clarification on the future super stop facilities. Lauren Skiver gave a brief description of what the super stop facilities could be and discussed the possibility of working in partnerships with the City and developers in conjunction with grant funding to build them. Councilmember Rita Lamb discussed her recent trip to Croatia and what she learned about hygroden. Mayor Pro Tern Gregory thanked Ms. Skiver for her presentation. He stated that SunLine was near and dear to the heart of former Mayor Greg Pettis and he is going to do his best to continue the work. He reminded everyone that SunLine is a Joint Powers Authority and is the City's transit agency. Alan Carvalho, Cathedral City, was called to speak. He stated that former Mayor Greg Pettis loved transportation, was instrumental in SunLine and transportation regionally. He appreciates the kind words of Mayor Pro Tern Gregory. B. Review of Cannabis Tax Rates Recommendation: This item is presented for information, discussion and direction only. City Manager Charles McClendon provided a review of the Cannabis Taxes. He stated that the Cannabis Task Force recommended that the City Council develop language to clarify the existing practice related to the payment of distribution taxes. Councilmember Rita Lamb asked for clarification on distribution and the process. Charles McClendon, City Manager, explained the cannabis manufacturing and distribution process and tax associated with it. He stated that currently the City does not charge a distribution tax. Mayor Pro Tern Raymond Gregory stated that he would like to maintain a healthy industry and remain competitive. He feels there needs to be clarification in the code pertaining to what taxes the City is charging. Mayor John Aguilar stated that the Task Force needs to look at the structure of the current ordinance. He requested City Manager McClendon give a brief overview of the Cannabis Task Force members. Charles McClendon stated that the Cannabis Task Force includes three members from the industry, City Staff and Community members. Stephan Brown and Charles Burrell, Owners of Attitude Adjustment, expressed their concern with the cannabis tax rates and how it has affected their company. They described the types of products they distribute, how they process products, Cathedral City Page 3 Printed on 1/16/2020 and the amount of taxes they pay. Nancy Ross, Cathedral City resident, was called to speak. She feels that what the City is doing is great. She commended those that had the forethought to put the taxes in place and does not see a need for major change. It was the consensus of the City Council to formalize the recommendation of the Task Force to develop language to clarify the existing practice related to payment of distribution taxes in a Resolution for consideration. C. Plan to Provide Limited Services at City Hall on Fridays Recommendation: This item is presented for information, discussion and direction only. Charles McClendon gave an overview of the plan to provide limited services at City Hall on Fridays. He indicated that the costs associated with the services provided on Fridays also includes additional staff members that are necessary for the day to day operations of the City. Mayor Pro Tem Gregory stated the proposed cost improves the service to residents throughout the week. He feels that this is a good compromise and supports moving forward. He encouraged the City to have services done at City Hall on Fridays instead of the weekend when possible. Councilmember Rita Lamb stated that when she first heard the proposal, she thought it was just to rearrange staff to accommodate Fridays. She appreciates all of the information that was presented. She feels that what is proposed is a lot of money. Councilmember Ernesto Gutierrez thanked the City Manager for his efforts and realizes that this plan may have to be adjusted over time. He stated that a lot of cities work 8 to 5 and close for lunch and suggested looking into that in the future to save money. He supports moving forward and making adjustments as necessary. Mayor John Aguilar expressed his concern about being able to sustain these costs in the long run. He supports moving forward but feels we need to be cautious. He questioned the Geographic Information Systems (GIS) position. He would like to accelerate the April 1, 2020 date. Tami Scott, Administrative Services Director, explained the City's need for more IT coverage if the City is open on Fridays. She stated that City currently does not have a dedicated GIS staff member. She stated that the use of GIS is instrumental in many if not all of the Departments within the City. It was the consensus of the City Council to move forward with staff's recommendations for implementing a 5-day week for City Hall. A separate budget amendment will come before the City Council at a later date for approval. D. Review of Art in Public Places Ordinance Recommendation: This item is presented for information, discussion and Cathedral City Page 4 Printed on 1/16/2020 direction only. City Manager Charles McClendon gave an overview of the Art in Public Places Ordinance. He stated that it has been suggested that the definition in the Ordinance may preclude the use of art education funds for programs not open to the general public. He recommended Council discuss their intent for the use of the fund and provide direction. Alan Carvalho, Chair of the Public Arts Commission and Cathedral City resident, was called to speak. He stated that the Public Arts Commission feels the culture of the City and the community needs to be addressed. Whatever the need is they want to do it. And he feels they need to create a legacy. He also feels the youth needs leadership skills which they gain from acting classes. He would like the Public Arts Commission and the City Council to meet to go over the needs and what the City Council and Commission would like to do moving forward. Eric Vail, City Attorney, stated that the public arts program is funded solely by development impact fees. Under California Law you can only spend development impact fees consistent with the Mitigation Fee Act, which states that you can charge a fee for public facilities which are defined to include public improvements, public services and community amenities. There are California Case Laws that interpret the section in this code that support a piece of physical art in public facilities. He also stated that there is nothing in the Mitigation Fee Act or in California Law that allows or prohibits the City from spending Development impact fees on art education. When adopting the City's ordinance, a percentage was set at 30% for art education annually. The City has taken the position that art education falls under public services or community amenities. In his opinion it is appropriate to use public arts funds to fund art education if the public can benefit from the art education. In our ordinance, physical art must be in a public place that is open to and accessible by the public without a cost. When the ordinance was first drafted the language was broad and subject to interpretation to allow the Public Arts Commission to work on how this program would work. He would like direction from the City Council on how to proceed. Councilmember Rita Lamb feels the Public Arts Commission and the City Council need to work together to structure the program. Councilmember Ernesto Gutierrez feels the Public Arts Commission does a great job and all the events they put on have been great events. He would like to continue doing the projects as long as they stay within the law. Councilmember Mark Carnevale feels that the City Council has been very giving over the years. He feels that it is very important that these funds are spent as intended and open to the entire public. Mayor Pro Tem Raymond Gregory feels it is important to maintain the public element and the public element needs to be better defined. Mayor John Aguilar agrees with Mayor Pro Tem Gregory. He suggested developing language to be a permissive as possible but follow the public definition and set parameters. Cathedral City Page 5 Printed on 1/16/2020 The City Council directed the City Attorney to develop language to clearly define the intentions of the City Council when funding art education and to bring back an ordinance for consideration. PUBLIC COMMENT David Van Wess, Cathedral City resident, was called to speak. He stated that he has been a resident of Cathedral City for nearly 15 years and works as a realtor. He thanked everyone for everything that has been done to improve the economy and the City. He expressed his concern with the moratorium on short-term vacation Rentals. Jens Mueller, Cathedral City resident, was called to speak. He expressed his concern with short-term vacation rentals. He feels that they no longer should be allowed. He questioned where the short-term vacation rental money is going. He feels that the tax payers are getting shafted. He also expressed his concern with billboards advertising cannabis. Nathan Carlin, Senior at Cathedral City High School, was called to speak. He thanked all who have supported the choir and they are grateful for the support that they have been given thus far. They have a goal of traveling to New York to sing in a Broadway show and are in need of help. He stated that those who wish to make a donation can contact Choir Director May LeRoy or pick up a donation form at the Cathedral City High School Campus. 2. COUNCIL REPORTS Councilmember Rita Lamb stated that it has been busy for everyone. She attended the GHA Developer's Block Party and thanked them for the event. She announced that they built a home and donated it to St. Jude. She reported that she attended a memorial for Jean Benson, a long time Councilmember and Mayor from Palm Desert, the Ribbon Cutting museum of ancient wonders and the Cathedral City High School Choir performance at Northgate Church. She also attended the Salton Sea Authority meeting and the Santa for Seniors event. She announced that she will be attending the Conservation Committee Energy meeting on Thursday and will be sitting on the PSUSD Education Committee. She also reported that she had dialog with residents that had some concerns with cannabis odors. Councilmember Ernesto Gutierrez reported that he attended a Christmas gathering at Chad Mesa's office, a Christmas Celebration at the Polo Grounds and Snowfest, which Chris Parman did a wonderful job on. He also attended the Northgate Church Event where the Cathedral City High School Choir did an amazing job. He also reported that he unfortunately had to attend a family wake and funeral. He stated that he engages with residents on a daily basis to discuss different issues. He reminded that the City Council Goal setting will be coming up soon and encouraged the residents to contact your Councilmembers with their input. Councilmember Mark Carnevale reported that he attended the Snowfest event, Wreath around America event and the film GALA. Next week he will be attending the League of CA Cities Riverside Division meeting and the Greater Coachella Valley Chamber of Commerce event to welcome new businesses and residents. He also participated in the City Hall at Your Corner along with Mayor Aguilar. He plans to attend the induction of new Board Members at Desert Sands Mobile Home Park. Mayor Pro Tem Raymond Gregory thanked Chris Parman for the Snowfest event and the Emily West concert. He reported that he attended the Palm Springs Cathedral City Page 2 Printed on 1/21/2020 International Film Festival and the Riverside County Transportation Commission meeting. He reminded everyone that January 20, 2020, is Martin Luther King Day. Mayor John Aguilar stated that it is amazing that the City Council is so engaged. He announced that the City Council was presented with a plaque to recognize their attendance and support of the Boomers Hanukah Event. He reported that he attended a Dinner given by Destiny Church, where they provided toys and dinner for residents. He participated in the City Hall at Your Corner where a key topic of discussion was homelessness and Acting Chief of Police Yoakum provided statistics on the crime rate. 3. Amendment No. 1 to Cooperative Agreement with the City of Palm Springs for the Ramon Road Widening and Bridge Project Recommendation: To approve Amendment No. 1 to the Cooperative Agreement with the City of Palm Springs for the Ramon Road Widening and Bridge Project which defines the cost shares between the two Cities of the locally funded portion of the Preliminary Engineering (PE) phase, the Right of Way (RW) Phase, and the Construction (CON) Phase of the Project based upon the latest cost estimate; and, authorize the City Manager to execute the attached agreement on behalf of the City Council. ITEMS PULLED FROM CONSENT D. Extension of Tow Contracts Recommendation: To authorize the extension of the current tow company contracts and approve the Second Amendments to the Franchise Agreements with Mohica Towing and Southwest Towing. Councilmember Ernesto Gutierrez stated that after speaking with the owners of Mohica and Southwest Towing, it is his understanding that the City stopped the practice of allowing the company to tow and store unlicensed vehicles for over thirty days, which has caused the company to lose profits. He also questioned the fees and would like to ensure that we have a legitimate contract. City Manager Charles McClendon stated that all parties are aware of the extension of the contracts and have agreed and signed the amendment. Acting Police Chief Yoakum confirmed Mr. McClendon's response and further explained that all costs and fees can be renegotiated at the expiration of the contract. M.O. 2020-04 A motion was made by Councilmember Carnevale and seconded by Councilmember Gutierrez to authorize the extension of the current tow company contracts and approve the Second Amendments to the Franchise Agreements with Mohica Towing and Southwest Towing. LEGISLATIVE ACTIONS A. Appointments to the Historic Preservation Committee Recommendation: To make 2 appointments to the Historic Preservation Committee with terms expiring on June 30, 2021. A motion was made by Mayor Pro Tem Gregory and seconded by Councilmember Lamb to appoint Julianne Middleton to the Historic Preservation Committee with a term expiring June 30, 2021, and to appoint John Rivera to the Historical Preservation Committee, contingent upon him submitting his resignation from the Planning Commission, with a term expiring in June 30, 2021. Tour de Palm Springs 2020 Recommendation: To approve Special Use Permit#19-024 in order for the annual Tour de Palm Springs to utilize city streets. Christopher Parman, Community Events Manager, gave an overview on the Tour de Palm Springs 2020 and introduced Tim Esser of CVSPIN. He stated that they are requesting that all fees and costs be waived. Tim Esser, CVSPIN, stated that some Cities have waived some or all of the permit fees in the past. He stated that they now only have one paid staff member with about 2000 volunteers who pour their hearts into making this event happen. He listed all of the organizations that have benefited from the event. He stated that they appreciate the City Council's consideration to waive all costs associated with the event so that more money can go to the charitable organizations. Councilmember Mark Carnevale stated that he appreciates what this event brings to the City, but he is having a hard time waiving the entire fee. Mayor Pro Tem Raymond Gregory does not have an issue with waiving the special use permit fee, however, he is not in favor of waiving the other cost associated with the event. Councilmember Rita Lamb concurred with Mayor Pro Tern Gregory. M.O. 2020-11 A motion was made by Councilmember Carnevale and seconded by Mayor Pro Tern Gregory to approve special use permit #19-024 in order for the annual Tour de Palm Springs to utilize city streets and waive the permit application fee. Public Arts Commission installation of the City owned art sculpture "Transported" and approval of the Licensing Agreement. Recommendation: To approve the Public Arts Commission allocation of Public Art Funds not to exceed $1,500 payable to the Mary Pickford Theater for the installation of the City owned art sculpture "Transported"; and authorize the City Manager to coordinate the completion of the Licensing Agreement and execute on behalf of the City Council. Cathedral City Page 6 Printed on 1/21/2020 John Corella, Director of Engineering and Public Works, gave an overview of the recommendation to approve the Public Arts Commission allocation of Public Arts Funds for the installation of the sculpture "Transported" at the Mary Pickford Theater. Mayor Pro Tern Raymond Gregory expressed his concern with blank areas in sections 3 and 9 of the agreement. Councilmember Ernesto Gutierrez questioned what the sculpture is composed of and what the length of the contract is. John Corella responded that the sculpture is composed of plaster and acrylic and the agreement is for 10 years. Alan Carvalho, Chair of the Public Arts Commission, was called to speak. He stated that this sculpture was gifted to the City and the Public Arts Commission has been searching for a location to display it. He feels that the Mary Pickford Theater is the perfect fit for this piece. He has been told by the artist that this sculpture is durable. He stated that it will be lighted, they will be adding it to their app, and they will make sure it has press coverage. He feels that the piece can be installed within 30 days and that it would be reasonable for the City to be responsible for any extraordinary maintenance costing D'Place more than $100. M.O. 2020-12 A motion was made by Mayor Pro Tern Gregory and seconded by Councilmember Gutierrez to approve the Public Arts Commission allocation of Public Art Funds not to exceed $1,500 payable to the Mary Pickford Theater for the installation of the City owned art sculpture "Transported"; and authorize the City Manager to coordinate the completion of the Licensing Agreement and execute on behalf of the City Council with section 3 reading as follows: D'Place shall mount the Chearney Sculpture within the property where the general public may view, but not have physical access to the Chearney Sculpture. D'Place may proceed with installation once the Parties have agreed to the placement of the Chearney Sculpture within the Property. D'Place shall complete installation of the Chearney Sculpture within 30 days after the Effective Date. and, section 9 reading as follows: D'Place shall at its sole cost provide routine maintenance of the Chearney Sculpture and keep Chearney Sculpture in a clean and safe condition to the satisfaction of the City Manager. City shall provide maintenance for any extraordinary maintenance costing D'Place more than $100. Should D'Place fail to maintain the Chearney Sculpture, the City, through its City Manager, may issue a written notice to D'Place specifying the deficiency and a reasonable time period, depending on the circumstances, for D'Place to correct the deficiency. Should D'Place fail to take action as required under this section, they shall be in default of this Agreement. In the event of such default, City in addition to any and Cathedral City Page 7 Printed on 1/21/2020 all other remedies shall have the right, but not the obligation, to undertake such maintenance and repairs as it deems necessary and appropriate to ensure the Chearney Sculpture is in good condition. D'Place shall pay to City all costs incurred by City for the repair of such damage or injury. Replacement Automatic Cardiopulmonary Resuscitation Devices Recommendation: To approve the replacement of three automatic cardiopulmonary resuscitation (CPR) devices from ZOLL for a total of$29,937.68 including tax, to be paid half each fiscal year, during the fiscal years of 2019/2020 and 2020/2021, with no interest. Fire Chief Wilson gave an overview of the recommendation to approve the replacement of the three automatic cardiopulmonary resuscitation (CPR) devices.
