HomeMy WebLinkAboutCC Reso 2019-44 RESOLUTION NO. 2019-44 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY, CALIFORNIA, ACCEPTING THE OFFER OF DEDICATION OF A PORTION OF LOT "P", AS SHOWN ON THE MAP OF PALM SPRINGS COUNTRY CLUB ESTATES, FOR PUBLIC STREET PURPOSES. (RAMON ROAD) WHEREAS, in connection with the approval and recordation of the subdivision map for Palm Springs Country Club Estates in June, 1947, a certain lot was offered for dedication for public street purposes, described as: Lot "P" of Palm Springs Country Club Estates, as shown by map on file in Book 22, at Pages 40 through 44, inclusive, of Maps, Records of Riverside County, California. AND WHEREAS, said offer of dedication of Lot "P" was rejected by the Riverside County Board of Supervisors at the time the final map was approved; and WHEREAS, the said Board of Supervisors, on February 2, 1953, did accept the Westerly 60 feet of said Lot "P" for street purposes, by Resolution recorded on February 3, 1953, as Instrument No. 5293, in Official Records of Riverside County; and WHEREAS, upon incorporation, the City of Cathedral City became the successor in interest to the offer of dedication on said map; and WHEREAS, the City of Cathedral City and this City Council have determined that it is now in the best public interest and is a necessary action for the orderly development of the surrounding area to rescind the past rejection of Lot "P" and now accept the remaining portion of the said offer of dedication of Lot "P" for street purposes. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cathedral City, as follows: That pursuant to State Government Code Sec. 66477.2 (a), the previous action by the County of Riverside rejecting the offer of Lot "P" of Palm Springs Country Club Estates is hereby rescinded, and the remaining portion of Lot "P", as described below, is hereby accepted on behalf of the public for public street purposes, and pursuant to Section 1806 of the State Streets and Highways Code, is hereby accepted into the City maintained street system: Lot "P" of Palm Springs Country Club Estates, as shown by map on file in Book 22, at Pages 40 through 44, inclusive, of Maps, Records of Riverside County, California; EXCEPTING that portion thereof described in the Resolution recorded on February 3, 1953, as Instrument No. 5293, in Official Records of Riverside County. BE IT FURTHER RESOLVED that the City Clerk is hereby directed to cause a certified copy of this Resolution to be recorded in the office of the County Recorder of Riverside County. APPROVED and ADOPTED at a regular meeting of the City Council of the City of Cathedral City held on this 11th day of December, 2019, by the following vote: Ayes: Councilmembers Lamb, Gutierrez and Carnevale; Mayor Pro Tem Gregory and Mayor Aguilar Noes: None Absent: None Abstain: None Jo Aguilar, May.
