THE CITY COUNCIL WILL CONDUCT INTERVIEWS AT 3:00 PM 1. Interview Applicants for the Parks and Community Events Commission and Historical Preservation Committee Discussion Recommendation: Interview the applicants that have submitted applications for possible appointment to fill one vacant seat on the Parks and Community Events Commission and discuss and provide direction on how to proceed with the appointment process to the Historic Preservation Committee. The following individuals were interviewed by the City Council for the Parks and Community Events Commission vacancy: Dirk van Sloten, M.S. Louie "Chip" Yarborough II Bardilio Corrales, Jr. The City Council will be making an appointment to the Parks and Community Events Commission during the regular meeting on October 23, 2019. Charles McClendon, City Manager opened up discussion on the Historical Preservation Committee. He would like the Council to discuss all options for appointing members to the Historical Preservation Committee and provide direction to staff. Mayor Mark Carnevale stated that he would like to move forward with interviewing and allowing all applicants to be considered. He also stated that he does not have a problem with individuals serving on more than one commission or committee. Councilmember Raymond Gregory would like to move forward, however, he does not agree with having members serve on more that one committee or commission at a time, and feels that it is poor practice to continue. He stated that he is open to nominations from districts. Councilmember Rita Lamb concurred with Councilmember Gregory and supports nominating someone from each district. Councilmember Ernesto Gutierrez concurred with Councilmember Gregory, however, he feels that there is not enough staff members to support the commissions and committees. He also feels that there is a lack of interest in the community for the Historical Preservation Committee and there is a very small number of properties to be preserved. He would like to get rid of the Ordinance altogether. Mayor Carnevale inquired on the costs associated with the Historical Preservation Committee other than staff costs. City Manager McClendon responded that there is no additional cost other than staffing cost. Mayor Pro Tem John Aguilar feels that some sort of structure needs to be in place. He also feels that the Historical Preservation Committee will not take a lot of staff time, as it was not the intent to meet more than twice a year. He stated that he is not comfortable appointing members by district and would like to move forward with interviews of the existing applicants and continue to accept applications. Mayor Carnevale stated that he would like to make a decision on how to move forward this evening. Councilmember Gutierrez suggested interviewing the current applicants and appoint those who serve on other Commissions or Committees for a limited term and then re-advertise to fill the vacancies with members who are not serving on other Commissions or Committees. Cathedral City Page 2 Printed on 11/05/2019 Councilmember Gregory stated that he would like the process to be done the proper way, even if it is harder. He stated that he is okay with interviewing and only selecting a few people and continue to accept applications. Councilmember Lamb concurred with Councilmember Gregory. Eric Vail, City Attorney advised the City Council that they would have to appoint at least three individuals to the Historical Preservation Committee to have a quorum. City Manager McClendon stated that staff will move forward with scheduling interviews on November 13, 2019. He will include a question for the applicants regarding how they would address the issue of potential conflicts between Commissions or Committees. He stated that City Council can make appointments and if it is less than five the City will continue to post for the vacancies until filled. • THE CITY COUNCIL WILL RECESS TO CLOSED SESSION AT 4:00 PM 2. CLOSED SESSION Eric Vail, City Attorney, announced that the City Council will meet in Closed Session to discuss the following item listed on the Agenda. A. Conference with Legal Counsel - Anticipated Litigation Pursuant to Government Code Section 54956.9(d)(2). Number of Potential Cases: One The City Council recessed to Closed Session at 4:06 p.m. The City Council reconvened at 4:30 p.m. Eric Vail, City Attorney, announced that the City Council met in Closed Session to discuss item 2A. Conference with Legal Counsel - Anticipated Litigation. There was no reportable action taken. • STATEMENT OF PARTICIPATION BY THE CITY CLERK 3. PUBLIC COMMENT 4. STUDY SESSION A. Update on the Desert Recreation District and the Annexation Election Process Recommendation: This item is provided for information, discussion and direction only. Kevin Kalman, Director of the Desert Recreation District will make a presentation to Council. Kevin Kalman, Director of the Desert Recreation District, gave a update on the Desert Recreation District and the Annexation Election. Cathedral City Page 3 Printed on 11/05/2019 Rick Saldivar, Cathedral City resident, was called to speak. He stated that he has a five year old and child care is very expensive. He feels that the Desert Recreation District will be an invaluable asset to the residents of the City who have children. Shelley Kaplan, Cathedral City resident, was called to speak. He thanked Kevin Kalman for his presentation. He feels that more revenue in capital is going to be necessary to build the type of community center that is wanted by the residents. He feels that City Council needs to look at the budget to find ways to allocate additional funding. He also stated that when this measure comes before the voters it is a tax, and he feels there needs to be a proactive group to get the residents to support this measure. He encouraged the Council to assemble a campaign committee to support moving this measure forward. Alan Carvalho, Cathedral City resident, was called to speak. He feels that the average age in this community is younger and they are in need of activities. He would like to keep the City moving forward and be advocates. B. Crime Update Recommendation: This item is presented for information, discussion and direction only. Police Chief Yoakum provided a brief summary on what the Police Department is doing regarding the recent spike in violent crimes. He stated that overall the crime rate is down in the City. He stated that he has made adjustments with staff and is utilizing outside resources to help address some of the issues. He feels that positive things are happening and he is proud of the Department and how they are working together to address the issues. Rick Saldivar, Cathedral City resident, was called to speak. He expressed his concern with the crime in the City. He feels it is a concern of the citizens. He feels that eight homicides is a lot and there is sorrow in the City. He would like to be able to report back to the residents that the City is working hard to get them answers. He also feels the residents are looking for reassurance that something is being done and the Police Department showing concern would be helpful. C. Term Limits and Mayoral Rotation Ordinance Recommendation: This item is presented for information, discussion and direction only. Councilmember Raymond Gregory feels that the election process serves as a term limit itself. He stated that he is not sure there needs to be a change at this time. Councilmember Rita Lamb concurred with Councilmember Gregory. Councilmember Ernesto Gutierrez stated that he supports term limits. Mayor Pro Tern John Aguilar stated that he does not support term limits. Mayor Mark Carnevale stated that he does not support term limits. It was the consensus of the City Council that there is no need to have further discussion on terms limits. Shelley Kaplan, Cathedral City resident, was called to speak. He inquired on the rotation of the Mayor as it pertains to the City's Charter. City Attorney Vail responded with a brief overview of the Mayor Rotation as is pertains to the City's Charter and explained options for amendments. Alan Carvalho, Cathedral City resident, was called to speak. He feels that this discussion is insulting and that no one is in favor of term limits. He stated that former Mayor Greg Pettis shared a lot of knowledge with individuals. He would like to keep moving Cathedral City forward. It was the consensus of the City Council to have staff bring back a menu of choices for Mayor Rotation at a later date. D. Discussion on the Ofelia Bringas Memorial Bridge (formerly the Cathedral Canyon Drive Bridge) and CV Link Projects Recommendation: The presentation and discussion on the Ofelia Bringas Memorial Bridge and CV Link Projects are presented for the City Council's information, comment and direction. John Corella, City Engineer provided an update on the Ofelia Bringas Memorial Bridge and CV Link Projects. Alan Carvalho, Chair of the Public Arts Commission, was called to speak. He encouraged City Council to continue the relationship between bridges and art features. PUBLIC COMMENT Brad Anderson, Rancho Mirage resident, was called to speak. He suggested that there should be public have access to the stairs leading to Council Chambers and signage. Doug Evans, Cathedral City resident, was called to speak. He commented on items that were discussed at the public forum for short-term vacation rentals. Kathleen Mueller, Cathedral City resident, was called to speak. She stated that she has been adversely affected by short-term vacation rentals. She reported that she formed a group with other residents from other cities to discuss short-term vacation rental issues. She presented the Palm Desert and Palm Springs short-term vacation programs. She encouraged the City Council to listen to Mike Ziskind and Evan Tru bee. Mike Ziskind, Rancho Mirage resident, was called to speak. He stated that he left Palm Springs due to issues he had with short-term vacation rentals. He feels that strict regulations will not eliminate noise and are gas lighting tactics that divert attention from the ugly truth. He feels that neighbors near short-term vacation rentals are the first responders which is very dangerous. He encouraged the City Council to adopt the Palm Desert program. Evan Trubee, Palm Desert resident, was called to speak. He stated that he is a former short-term vacation rental owner who is now opposed to short-term vacation rentals. He stated that he is a business owner in Palm Desert and feels that he was also operating a business in a residential neighborhood when he rented out his vacation rental short term. He discussed his issues with tenants he rented his property to short-term and explained how his neighbors were disrupted. He feels the City Council can implement better regulations that have been proven to work in Palm Desert and would like the Council to think long and hard when implementing regulations. Jens Mueller, Cathedral City resident, was called to speak. He expressed his concern with short-term vacation rentals operating as mini hotels in residential neighborhoods. David Lamb, Cathedral City resident, was called to speak. He requested that the City add street lights on the corner of Park and Cathedral Canyon. He stated that the street lights will encourage bats which are natural predators for mosquitoes, which could reduce mosquitoes. Edward Holzhauer, Cathedral City resident, was called to speak. He expressed his concerns with comments made, which he felt were unbecoming of a Council Member. He encouraged the City Council to be respectful when listening to their constituents. Robert Puentes, Cathedral City resident, was called to speak. He stated that the City does not have baseball and the parks are in bad shape, and feels that we are failing the kids, which is a big problem. He also feels that the residents would help to get the parks and fields in good condition for the kids. Ronald Mendiola, Cathedral City resident, was called to speak. He expressed his frustration with short-term vacation rentals. He stated that he did not get a notification of a short-term vacation rental and did not receive the short-term vacation task force survey. He would like to participate in the short-term vacation rental discussions and feels his neighbors would too. He also stated that he has called the hotline more than 10 times and urged the City Council to help. Cathedral City Page 2 Printed on 11/07/2019 Diane Gill, Cathedral City resident, was called to speak. She reported a code enforcement issue with a property on Terrace and Porter in the Cove. She stated that the property owner does not maintain the property and it has been an ongoing issue for 2 years. She urged the City to make the owner clean up their property. 2. COUNCIL REPORTS Councilmember Rita Lamb reported that she attended the Desert Valley Builders Association Introduction, the ground breaking of the new fire station, the Tejano Festival, the Agua Caliente Dinner in the Canyons fundraiser, and the League of California Cities Conference. She also attended the Gala de Mariachi presentation and the Desert Community Energy meeting which was very informative. Councilmember Raymond Gregory reported that it has been a very busy two weeks. He reported that he attended many of the same events as Councilmember Lamb. He attended the fire station dedication, the City Hall at your Corner. He represented the City at the stonewall awards where he accepted an award honoring former Mayor Greg Pettis. He also attended the Tejano Music Festival, the Agua Caliente Dinner in the Canyons fundraiser, the League of California Cities Annual Conference, the Riverside County Division of the League of California Cities and the meetings with the LGBT caucus of the League of California Cities which he is a member of. He represented the City at the Palm Springs Equality Awards and attended the SunLine Transit Agency meeting. He announced the upcoming Cathedral City High School Homecoming Parade on October 24, 2019, and the Spooktacular Event on October 27, 2019. Councilmember Ernesto Gutierrez reported that he attended many of the events along with his colleagues. He attended the Tejano Festival and the venue was amazing. He attended the Food Truck event, the Agua Caliente Dinner in the Canyons fundraiser and the Gala de Mariachi presentation. He also met with Pastor Houston Robinson of Northgate Community Church and former Mayor DeRosa. They discussed code enforcement issues and how they want to help homeowners clean up properties that cannot afford to do so on their own. He also attended the grand opening of the Cimmeron Golf Course and stated that the homeless issue remains after the recent clean-up. He feels that the City needs to help them with the issue. He also met with a developer who is developing many homes here in the City and helped him coordinate with the Planning Department for assistance. He also attended the community short-term vacation rental forum and feels we need to work on the issues. He reported that he met with City Manager Charles McClendon, City Engineer John Corella and Planning Director Robert Rodriguez. Mayor Pro Tern John Aguilar reported that he attended the Gala de Mariachi concert where is he was able to discuss with county staff, a possible collaboration with their works. He also attended the grand opening of the JAX restaurant at Cathedral Canyon Country Club and the Shelter from the Storm annual luncheon where they will be honoring former Mayor Stan Henry for his service on the board. Mayor Mark Carnevale reported that he attended the Desert Valley Builders Association, the Cannabis Education event and the League of California Cities Annual Conference. He stated that Chief Yoakum is aware of the homeless issue at Cathedral City Page 3 Printed on 11/07/2019 the Cimmeron Golf Course and they are working vigorously on the issue. He stated that he was able to discuss the K-12 program with San Francisco Treasurer Jose Cisseneros again and would like the City Council to revisit the program. He announced the upcoming Annual Peace Officers Awards and ribbon cutting at Horizon Active Resort Living. 3. Specific Plan Amendment 87-26C, Conditional Use Permit 19-002 Recommendation: To provide second reading, by title only, and adopt an ordinance approving Specific Plan Amendment No. 87-26C and Conditional Use Permit No. 19-002 for the construction of an approximately 5,238 square-foot convenience store and an automobile service station on a 1 .74-acre site located on the northwest corner of Date Palm Drive and Cathedral City Page 4 Printed on 11/07/2019 Ortega Road. Ord 828 E. Healing Field 2019 Recommendation: To approve SUP#19-021 for the annual Healing Field event at Patriot Park and waive the Special Use Permit application fee. M.O. 2019-126 F. California Office of Transportation Safety 2020 Award Acceptance Recommendation: Recommendation To approve acceptance of a grant award from the California Office of Traffic Safety in the amount of$35,000. The fire department was awarded the grant from the Regional Collision Response and Extrication Improvement Program. The grant award provides funding for the replacement of one extrication unit (Jaws of Life tool). M.O. 2019-127 G. 2019-2020 California Office of Traffic Safety (OTS) Selective Traffic Enforcement Program (STEP) Grant Recommendation: To accept the California Office of Traffic Safety Selective Traffic Enforcement Program Grant in the amount of $70,000.00. Supporting the Analysis of Sea-Water Import Alternatives Needed to Address the Salton Sea Health Crisis Recommendation: To adopt a resolution in support of considering all alternatives, including salt water import, to address the decline of the Salton Sea. Stone James, Economic Development Director, introduced the recommendation to adopt a resolution in support of considering all alternatives, including salt water import, to address the decline of the Salton Sea. Chuck Parker, Salton Sea Coalition, was called to speak. He gave an update on the Salton Sea discussing at the State level. Feliz Nunez, volunteer for the Salton Sea Coalition, was called to speak. She expressed her concern with the health issues she feels is caused by the decline of the Salton Sea. She supports sea water import. Terry Applegate, Cathedral City resident, was called to speak. She stated that she supports importation of sea water into the Salton Sea. She feels that the Resolution won't do everything, it is a statewide issue with long term impacts. Edward Holzhauer, Cathedral City resident, was called to speak. He feels this is an issue throughout the state and encouraged the Council to reach out to Chuck Parker for information and work with other cities to get the message across. He feels every city should be invested in this issue. He supports the resolution. Chuck Parker, Salton Sea Coalition, was called to speak. He encouraged the City Council to get in touch with Councilmember Dana Hobart from Rancho Mirage, regarding this issue. Shelley Kaplan, Cathedral City resident, was called to speak. He feels that the state has failed on this issue. He also feels that this process should have started years ago and urged the City Council to support the resolution. Linda Solis was called to speak (did not state City of residence). She supports the resolution and encouraged the City Council to support it. Yasim Espinoza, Cathedral City resident, was called speak. She thanked the advocates for all that they are doing. She also wanted to bring to the City Council's attention that the sensors in the Salton Sea have not been reestablished. Reso 2019-37 A motion was made by Councilmember Gutierrez and seconded by Councilwoman Lamb to approve a resolution in support of considering all alternatives, including salt water import, to address the decline of the Salton Sea. Appointment to the Parks and Community Events Commission Recommendation: To make an appointment to the Parks and Community Events Commission with a term expiring June 30, 2021. M.O. 2019-131 A motion was made by Councilmember Gregory and seconded by Mayor Pro Tern Aguilar to appoint Louie "Chip" Yarborough I1 to the Parks and Community Events Commission to fill an unexpired term continuing to June 30, 2021. Pepsi Beverage Sales Agreement for Cathedral City Community Amphitheater and Downtown Special Events Recommendation: To approve an exclusive beverage sales agreement with Pepsi for the Cathedral City Community Amphitheater and special events in downtown for the next five years. Alan Carvalho, Cathedral City resident, was called to speak. He inquired if there are any other cities that have similar contracts. M.O. 2019-132 A motion was made by Councilmember Gutierrez and seconded by Councilmember Gregory to approve an exclusive beverage sales agreement with Pepsi for the Cathedral City Community Amphitheater and special events in downtown for the next five years contingent upon the City Manager's satisfaction with the City and Pepsi working out issues to include the following: • Venues are to be included in the agreement • Non-Pepsi products are allowed to be given away at events • We are able to sell coffee and hot chocolate • Ensure that this exclusive agreement will not cause a conflict with the food truck vendors at City Events. Terry Applegate, Cathedral City resident, was called to speak. She stated that she has attended the Mary Nutter Collegiate Classic and feels that having Team USA here is an honor. M.O. 2019-133 A motion was made by Councilmember Gregory and seconded by Mayor Pro Tem Aguilar to authorize a budget amendment and expenditure of$12,528.12 to sponsor hotel rooms for Team USA Women's Olympic Softball Team for the Mary Nutter Collegiate Classic in February 2020. Councilmember Raymond Gregory requested that moving forward, the Public Arts Commission move away from sponsoring events for prizes and that sponsorships be clearly educational. M.O. 2019-134 A motion was made by Councilmember Gutierrez and seconded by Mayor Pro Tem Aguilar to approve the Public Arts Commission sponsorship of the Dia de los Muertos (Day of the Dead) Student Art Contest in the amount of $575.00 funded by the Public Arts Educational Fund. M.O. 2019-135 A motion was made by Councilmember Gutierrez and seconded by Councilwoman Lamb to approve a purchase order for a new HP Page Wide XL 4100 printer and scanner for the City's Engineering Department to support the City's reprographic needs; and, approve a budget amendment of$23,445.71 for the purchase of this equipment. Terry Applegate, Cathedral City resident, was called to speak. She discussed the Riverside County and City library systems, including salaries. She inquired about the library staff during the roofing repairs.
