HomeMy WebLinkAboutCC Reso 2019-33 RESOLUTION NO. 2019-33 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY, CALIFORNIA, ESTABLISHING PROCEDURES FOR EXPENDITURES FROM THE PUBLIC ARTS FUND BY THE PUBLIC ARTS COMMISSION WHEREAS, Title 2, Chapter 2.19 of the Cathedral City Municipal Code establishes the Public Arts Commission for the City of Cathedral City; and WHEREAS, the Public Arts Commission serves in an advisory role to the City Council as may be appropriate; and WHEREAS, the Public Arts Commission makes recommendations to the City Council concerning the organization of any financial support programs pertaining to the acquisition, maintenance, restoration, exhibition, and display of public art on public property; and WHEREAS, Title 11, Chapter 11.45 of the Cathedral City Municipal Code establishes the "arts in public places fund"; and WHEREAS, any person constructing a commercial or industrial use building within the City is required to provide art in a public place or make an in-lieu payment; and WHEREAS, any payments collected in accordance with the in-lieu contribution provision is deposited in the arts in public places fund; and WHEREAS, the City Council desires to adopt this Resolution establishing procedures concerning expenditures of the public arts fund by the Public Arts Commission. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. Pursuant to the City of Cathedral City Municipal Code, the Public Arts Commission shall only make recommendations concerning the use of the public arts fund to purchase or commission art works and to engage in art education to the City Council. This includes the acquisition, maintenance, restoration, exhibition, and location or relocation of public art. SECTION 2. All expenditures of the public arts fund related to the acquisition, exhibition, location or relocation of public art shall be approved by City Council. All expenditures related to the regular maintenance of public art shall be approved via the biennial budget process and pursuant to the city's purchasing guidelines. 1 RIV#4827-5054-6847 v1 SECTION 3. The Public Arts Commission shall have no independent authority to approve expenditures of the public arts fund. SECTION 4. The City Manager shall ensure the public arts fund is detailed in the recommended City budget. The public arts fund budget shall list all existing funds, anticipated revenues and anticipated expenditures of the fund.
