Eric Vail, City Attorney, announced that the City Council will meet in Closed Session
to discuss the following items on the agenda.

The City Council reconvened at 4:30 p.m.
Eric Vail, City Attorney, announced that the City Council met in Closed Session to
discuss Item 1.A. Conference with Legal Counsel- Anticipated Litigation for two
cases, Item 1.B. Conference with Labor Negotiator for AFSCME, CCPOA, CCPMA,
CCPFA and CCFMA, there was no reportable action taken.
• STATEMENT OF PARTICIPATION BY THE CITY CLERK
2. PUBLIC COMMENT
Bob McKechnie, former Executive Director of the Cathedral City Senior Center, was
called to speak. He announced that he has retired from the Senior Center. He
thanked the City for saving the Senior Center and he is grateful that he had the
opportunity to serve as the director. He introduced Jeff Corbin, who will be taking his
place as the Director at the Senior Center.
Jeff Corbin, Executive Director of the Cathedral City Senior Center, was called to
speak. He stated that he is honored to be at the Senior Center. He feels the Senior
Center is thriving and he feels fortunate to be able to add to what is already working.
Mayor Mark Carnevale thanked Mr. McKechnie for everything that he has done for
Cathedral City and the Seniors.
Alan Carvalho, Cathedral City resident, was called to speak. He commended Bob
McKechnie for his work at the Senior Center. He also thanked the City for their
support.
3. STUDY SESSION
A. Update on Council Goals for 2019
Recommendation: This item is presented for information, discussion and
direction only.
Charles McClendon, City Manager, gave an update on the City Council Goals for
2019.
Mayor Pro Tern John Aguilar gave a brief update on the RUH medical clinic.
Charles McClendon, City Manager, discussed the details of the Buxton
Agreement.
John Core//a, Director of Engineering and Public Works, gave an update on the
future Los Gatos project.
Councilmember Raymond Gregory commended the City for the completion of the
new sidewalks on Date Palm Drive.

Mayor Pro Tern John Aguilar inquired about the Cathedral Palms rehab project.
Tami Scott, Administrative Services Director, explained the funding and process
of the Cathedral Palms rehab project.
Mayor Mark Carnevale thanked Charles McClendon and also commended the
City on the completion of the sidewalks on Date Palm Drive. He suggested a
portion of the cannabis revenues go towards developing a reserve.
Tami Scott, Administrative Services Director, explained how the cannabis
revenue has been utilized.
Councilmember Ernesto Gutierrez suggested including a list of the most common
code compliance violations on the City's quarterly mailer.
Councilmember Raymond Gregory commended City Manager McClendon.
Mayor Pro Tern John Aguilar commended City Manager McClendon for his
efforts and expressed his willingness to help improve the processes in City's
administration.
Alan Carvalho, Cathedral City resident, was called to speak. He stated that the
City is moving forward, and the residents are taking notice. He feels that the
Council does a great job in how they spend the money of the people and he
commended the Council for the work that they do.
B. Broadband Internet Service Update
Recommendation: This item is presented for information and discussion only.
Tami Scott, Administrative Services Director, gave an update on Broadband
Internet Service.
Councilmember Raymond Gregory wants to be business friendly and inquired
what the City is doing to become internet/broadband friendly. He suggested
exploring ways to work with internet providers and promoting technology
businesses in the north development area of the City.
Tami Scott, Administrative Services Director discussed the efforts to become
internet friendly, conversations with internet providers and the City's past
experience with Innovation Hub (iHub).

Tracey Martinez, City Clerk, announced that items 3F, 3G and 3H will be pulled from
the Consent Agenda for individual consideration.
• STATEMENT OF PARTICIPATION BY THE CITY CLERK
1. PUBLIC COMMENT
Brad Anderson, Rancho Mirage resident, was called to speak. He expressed his
concern with the work of the Coachella Valley Mosquito and Vector Control District
and feels that the District is not using their resources the way they should.
Katie Myers and Mario Aguilar, Cimmeron Golf Resort, were called to speak. They
expressed their concern with the homeless issue under the Ramon Bridge. They
stated that there are approximately 40 individuals living under the bridge. Those
individuals are approaching guests on the course and causing multiple issues for
their property. They requested assistance from the City.
2. COUNCIL REPORTS
Councilmember Ernesto Gutierrez reported he met with a resident who also owns a
local cannabis business. In order for the business to expand to include
manufacturing and cultivation, the General Plan would need to be changed. He is
working with the business owner and staff to see what assistance can be given. He
also reported that he attended the CVEP meeting in Rancho Mirage. A presentation
was given by SunLine on transportation, which was very informative, and requested
that Councilmember Gregory as our representative on SunLine arrange for them to
provide the same presentation to the Council. He announced that the Gas Company
had an incident in Temecula when a solar company cut into a gas line causing an
explosion destroying the home and killing an employee. He encouraged when
digging to call 811 (Dig Alert). He also attended a luncheon with the Building
Industry Association.
Mayor Pro Tem John Aguilar reported that he is the liaison to the Short Term
Vacation Rental Task Force and he attended their first meeting on July 15, 2019. He
announced that he attended the League of California Cities meeting where a
legislative briefing regarding AB101 was given and reminded staff to keep tracking
the RFPs so the City can receive its share.
Councilmember Raymond Gregory announced that SunLine is partnering with local
media outlets for the Stuff the Bus event on July 25, 2019 from 7:00 a.m.- 7:00 p.m.
at the Palm Desert Walmart. The event will provide school supplies to the Cathedral
City Boys and Girls Club. He encouraged all those that can to participate in the
event.

Recommendation: To approve the contracts for services for Cathedral City
LGBT Days and Taste of Jalisco.
Sergio Espericueta, Cathedral City resident, was called to speak. He stated that
he participated in the Taste of Jalisco planning committee and feels that having
Hispanic members on the committee is more effective than the event manager
themselves. He recommended that Councilmember Ernesto Gutierrez be on the
Taste of Jalisco planning committee.
A motion was made by Councilmember Ernesto Gutierrez and seconded by
Mayor Mark Carnevale to delay approving a contract for services for Taste of
Jalisco until the next City Council meeting on August 28, 2019.

Springs For Acquisition of Property Necessary to Complete the Ramon
Road Bridge Widening Project
Recommendation: To approve an agreement with the City of Palm Springs for
designating the City of Palm Springs to act as lead agency
for the property acquisition necessary for the Ramon Road
Bridge over the Whitewater River Project (Project); and,
consent to the acquisition of Cathedral City properties under
the eminent domain process as necessary for the Project;
and, authorize the City Manager to execute the attached
agreement on behalf of the City Council.
Councilmember Ernesto Gutierrez inquired about the Cooperative Agreement
between the City of Cathedral City and the City of Palm Springs.

John Corella, Director of Engineering and Public Works, gave an overview of the
Cooperative Agreement between the City of Cathedral City and the City of Palm
Springs for acquisition of properties necessary to complete the Ramon Road
Bridge Widening Project.

concern with the use of eminent domain and indicated that he is opposed to it.

A. Ordinance Establishing a Moratorium on New Short-Term Vacation Rentals
Recommendation: To waive further reading and adopt an Urgency Ordinance
establishing a moratorium on the issuance of new Short
Term Vacation Rental permits.
Charles McClendon, City Manager, introduced the item and gave an overview of
the Short Term Vacation Rental Task Force.
Mayor Pro Tem John Aguilar discussed the first Short Term Vacation Rental
Task Force meeting. He feels the Task Force is well balanced and that all of the
expressed concerns are being well vetted. He stated that he believes there will
be opportunities for updates to the City Council.
Eric Vail, City Attorney, provided an explanation of the current Ordinance and the
proposed Ordinance.
Kevin Stern, Cathedral City resident, was called to speak. He stated that he owns
two businesses in the City and is opposed to the proposed Ordinance. He feels
that a deadline needs to be included in the Ordinance.

Dean OConner, Cathedral City resident, was called to speak. He supports the
Ordinance and wants it to be extended long enough for the Short Term Vacation
Rental Task Force to do their work.
Randy Wiemer, Cathedral City resident, was called to speak. He is a realtor and
has experienced a loss of sale due to the moratorium. He would like to see an
end date on the Ordinance.
Paul Lougee, Cathedral City short term vacation rental owner, was called to
speak. He stated that he is opposed to the Ordinance and feels that it is not an
urgent matter. He would like to see a deadline included in the Ordinance. He is
in favor of the original Ordinance, which can be amended. He requested that the
City provide data that demonstrates short term vacation rentals are truly a
significant issue to the entire population.
Todd Hover, Property Manager, was called to speak. He feels that the rules are
not clear and requested clarification.
Lindsay Jones, Palm Springs resident, was called to speak. She gave an update
on the first Short Term Vacation Rental Task Force meeting. She feels that the
Ordinance is written in a way that the moratorium can be permanent and
requested that an end date be included.
Jim Franklin, Palm Springs Regional Association of Realtors, was called to
speak. He encouraged the City Council to vote no on the Ordinance and to allow
the current Ordinance to expire. He requested that if Council does move forward
with the Ordinance that an end date be included. He feels that enforcement is
key to the success of the program and is what will make it work.
Jeremy Ogul, Expedia Group, was called to speak. He encouraged the Council to
vote no on the Ordinance and feels that this is the wrong approach. He would
like to partner with the City to ensure properties are permitted.
Stephen Burchard, Cathedral City resident and Realtor, was called to speak. He
stated that he is opposed to the Ordinance but suggested including an end date if
nothing else. He feels that enforcement is the key.
Anna Muradyan, Cathedral City resident, was called to speak. She stated that
she is opposed to the Ordinance, however, if the Council decides to move
forward she requested that an end date be added. She also suggested more
regulations and rules.
Joshua Bonner, President/CEO Greater Coachella Valley Chamber of
Commerce/Cathedral City Chamber of Commerce, was called to speak. He
stated that 1 in 4 jobs are tied to tourism and short term vacation rentals are an
important part of our economy. He stated that they are not opposed to a
moratorium, however, they have a strong issue with having a moratorium without
limits and because of that they are in opposition of this Ordinance.
Nick Poghosyen, Cathedral City resident, was called to speak. He stated that he

believes short term vacation rentals are a strong back bone to the local economy.
He feels that the existing Ordinance should be repealed or at least have an end
date included in the proposed Ordinance.
Doug Evans, Cathedral City resident, was called to speak. He feels that short
term vacation rentals have an impact on housing in Cathedral City. Available
housing has been taken out of the market place. He stated that there are 15
vacation rentals on his street alone. He feels that it is out of control and it is not
going away.
Rudy Garcia, Cathedral City resident, was called to speak. He feels that there
needs to be solid rules and enforcement with regard to short term vacation
rentals. He feels that having good communication and relationships with their
neighbors is important. He would like to see an end date in the proposed
Ordinance or see the current moratoruim expire.
John Cortez, Cathedral City resident, was called to speak. He stated that he is
opposed to the moratorium and feels that short term vacation rentals stimulate
the economy. He feels that it is important to have good communication with
neighbors and strong rules and regulations. He suggested placing a time limit on
the Ordinance.
Lisa Taranto, Cathedral City resident, was called to speak. She feels that
enforcement is the key to the success of the program. She indicated that she
purchased a home with the intention of it being a short term vacation rental
property. She has invested a lot of time and money into the property and is now
unable to license it. She would like to be an exception. She would like the
moratorium to expire.
Boris Stark was called to speak. He stated that he is on the Short Term Vacation
Rental Task Force and feels it will be a 9-month process to finish their work. He
requested that the City allocate funds for enforcement in the meantime and that
acting immediately could help alleviate concerns. He urged the Council to
consider a deadline on the moratorium.
Leslie Barragan-Scott, Cathedral City resident, was called to speak. She
expressed her concern with a short term vacation rental behind her property and
her experience with City staff when she has made complaints. She stated that
she is harassed by the property owner and living a nightmare. She stated that
the moratorium does not help her because the property behind her is already
licensed. She expressed her frustration and doesn't know what to do.
Ed Emond-Worline, Cathedral City resident, was called to speak. He stated that
he is on the Short Term Vacation Rental Task Force and feels that the
moratorium needs to be extended so that they have time to do their job. He
discussed the issues with the calls for service through the hotline and feels Code
Enforcement is an area that needs to be addressed.
Teri Hargreaves, Cathedral City resident, was called to speak. She stated that
she is on the Short Term Vacation Rental Task Force Density Team and

reassured the Council that they are working diligently. She feels their work is
going to take time and encouraged the Council to approve the Ordinance.
Michael Hagedorn, Cathedral City resident, was called to speak. He feels there
are no more neighborhoods in the City. He supports the Ordinance and wants
the Council to give the Short Term Vacation Rental Task Force time to do their
job.
Bob Hargreaves, Cathedral City resident, was called to speak. He supports a
moratorium. He discussed the issues that good short term vacation rental
operators are facing and feels they cannot control some renters. He feels the
residents want quality neighborhoods and the City needs to figure out how to do
that.
Mary Moriian, Cathedral City short term vacation homeowner, was called to
speak. She discussed her experience with false complaints and the financial
investments in her home. She stated that she is opposed to the moratorium and
hopes that a deadline is included.
Carolina (Did not disclose her last name), Cathedral City resident, was called to
speak. She discussed her family's rental home and stated that they run their
business by the rules and regulations of the City.
Sergio Espericueta, Cathedral City resident, was called to speak. He expressed
his concern with the City not enforcing the zero tolerance of noise and feels this
is the main issue.
Councilmember Ernesto Gutierrez feels that there should not be a time limit on
the Ordinance. He feels that there is a lot of work that needs to be done and it
needs to be done properly. He is a strong supporter of real estate and real estate
rights, however, he also feels that the property rights of the people should be
protected. He stated that he was elected to protect the residents and that is what
he is going to do.
Pro Tem John Aguilar stated that he is not in favor of imposing a deadline on the
moratorium and does not want to rush the Short Term Vacation Rental Task
Force.
Councilmember Raymond Gregory does not support imposing a deadline on the
moratorium. He feels that the Short Term Vacation Rental Task Force needs to
take as long as it needs to, to be effective.
Mayor Mark Carnevale thanked everyone for their comments and feels there is
clearly a problem with short term vacation rentals. He stated that he does not
support imposing a time limit and feels that the Short Term Vacation Rental Task
Force has a lot of work to do and they need time to do it.
Eric Vail, City Attorney, explained the moratorium does not apply to pending
applications for short term vacation rental permits, existing short term vacation
rental permits, renewals of existing short term rental permits, or areas governed

by a homeowners association or community association and subject to
covenants, conditions, and restrictions (CC&Rs) that expressly allow for short
term vacation rentals.

A motion was made by Councilmember Gregory and seconded by Mayor Pro
Tem Aguilar to waive further reading and adopt an Urgency Ordinance
establishing a moratorium on the issuance of new Short Term Vacation Rental
permits.

B. Summary Report of Public Arts Funding for Art Educational Programs and
Public Art Works purchases during Fiscal Year 2018/2019
Recommendation: This item is presented for City Council information,
discussion and acceptance.
Alan Carvalho, Chair of the Public Arts Commission, was called to speak. He
clarified that the Public Arts Commission approves funding from the Public Arts
Fund under the set guidelines. He also stated that he is very proud of the North

It was the consensus of the City Council to direct staff to bring back a resolution
for consideration outlining the process for expenditures of the Public Arts Fund
and an item for consideration to approve an expenditure in the amount of

C. Review of Traffic Signal Preventative Maintenance Agreement with
Siemens ITS
Recommendation: Staff will be presenting information on the performance of its
current traffic signal maintenance Contractor, Siemens ITS,
and recommend that Siemens ITS continue into the second
year of the Traffic Signal Maintenance Agreement.
