HomeMy WebLinkAboutCC Min 2018-07-25 Cathedral City CITY COUNCIL STUDY SESSION MINUTES CITY COUNCIL CHAMBERS 68-700 AVENIDA LALO GUERRERO CATHEDRAL CITY, CA Wednesday July 25, 2018 STUDY SESSION 4:30 PM • CALL TO ORDER Mayor Pro Tern Greg Pettis called the Study Session of July 25, 2018, to order at 4:30 p.m. • ROLL CALL Present: 4- Mayor Pro Tern Gregory S. Pettis, Councilmember Shelley Kaplan, Councilmember Mark Carnevale, and Councilmember John Aguilar Absent: 1- Mayor Stan Henry A motion was made by Councilmember Aguilar, seconded by Councilmember Kaplan to excuse Mayor Henry from the meeting. The motion carried 4-1, Mayor Henry absent. • AGENDA FINALIZATION • STATEMENT OF PARTICIPATION BY THE DEPUTY CITY CLERK 1. PUBLIC COMMENT None. 2. STUDY SESSION 2.A. 2018-302 Progress Update on the General Plan, Imagine 2040 Pat Milos, Community Development Director provided an update on the General Plan Update. He indicated that a statement on historic preservation would be included in the General Plan. He also stated the Historic Preservation Committee Task Force would be reconvened to bring back a recommendation to the Council. He introduced John Criste, Terra Nova Planning. John Criste, Terra Nova, discussed public workshops held and provided feedback on land use, public services and facilities, circulation and mobility, and environmental resources and hazards. He went over the new requirements mandated by the Office of Planning and Research and how the General Plan was being drafted to coincide with those demands. He presented the preliminary schedule for the General Plan Update. He stated he would look into making Cathedral City's General Plan more competitive regarding the strategic growth. He also stated that healthy and sustainable community was a part of the General Plan. Denise Cross, Historic Preservation Committee Task Force, noted that there is still no ordinance related to Historic Preservation and there are flaws in the report regarding Historic Preservation. 2.B. 2018-299 Update on the CV Link Project and the adjacent Dream Homes Neighborhood Area City Engineer John Corella introduced the item and Martin Magana, CVAG Transportation Director. He also discussed the Dream Homes Community. Martin Magana, CVAG Transportation Director, provided an update on the CV Link project. He indicated that he expects construction to begin by the end of 2018. He also noted that Palm Springs began construction on its segment, which is scheduled to be complete by the end of September. Alan Carvalho, Cathedral City resident, was called to speak. He suggested bike and scooter rentals along the CV Link path. Rosario Avila, Cathedral City resident, was called to speak. She stated that many residents were affected by the path. She also discussed the Beverly Hills ban on electric scooters. City Manager McClendon stated that Assembly Member Garcia would provide more information once the guidance was out on the parks bond issue. Police Chief Walker indicated that there had been no calls for service to the CV Link regarding the homeless concern. 2.C. 2018-301 Cannabis Industry Projects Update Pat Milos, Community Development Director, provided a brief overview of the cannabis industries and the effects on the City. He provided a brief history of the industry in the city, business potential, current dispensaries, facilities under construction and management of odor issues. The subcommittee will be reviewing billboards. He also stated that Cathedral City allows onsite consumption. Lisa Slaughter, attorney representing cannabis businesses, was called to speak. She discussed Staff's knowledge and experience within the cannabis industry. She also discussed the issue of billboards and State inspections. Alan Carvalho, Cathedral City resident, was called to speak. He thanked Rosario Avila for her comments, voiced his support for Council and Staff for their work on cannabis issues, and encouraged community members to vote in November. Nick Hughes, Palm Desert resident, was called to speak. He thanked Staff for their work and noted the billboards were in Palm Springs. He introduced his dispensary, Cathedral City Care Collective North. Benjamin Maestes, Cathedral City resident, was called to speak. He encouraged civility at City Council meetings. 2.D. 2018-300 Discussion of Cathedral City Municipal Code 9.100.030 Pigs and Livestock, as it relates to "Pet Mini Pigs" Pat Milos, Community Development Director introduced the item and provided an overview of the municipal code related to pigs and livestock. He stated that a comprehensive look at the issue could be beneficial. Mayor Pro Tern Greg Pettis summarized the complaint filed by a resident regarding a pig. Samantha Aruda, Cathedral City resident, was called to speak. She spoke about her pet pig. She stated that they are quiet, do not smell, and compared them to dogs. She encouraged Council to incorporate mini pigs into the list of allowed animals in the City. She stated that her pig was rescued from adoptapig.com and that veterinarians in the area were qualified to care for pigs. Denise Cross, Cathedral City resident, was called to speak. She reflected on her time trying to attain a pig in the 80's. She supports having pigs as pets in the City. Alan Carvalho, Cathedral City resident, was called to speak. He voiced his support for the progressive actions being taken regarding farm animals. He also noted that there are wild boars that live in the cove. Charles McClendon, City Manager stated there is a need for clear definitions and staff would work on a draft amendment to the code. 3. David Bremudez, La Michoacana Ice Cream Parlor, introduced himself. Scott Robinson, Boys and Girls Club of Cathedral City, introduced himself. Stephen Burchard, Stephen Burchard Real Estate, introduce himself. Michael Sousa, RPM Mortgage, introduced himself. Andrew Bond, First Call Security, introduced himself. Joe Frazier, Frazier Pest Control, introduced himself and his business. Hadden Libby, Winslow Drake Investment Management, introduced himself and his business. Mr. Bonner added that Gary Levingston was unable to attend the meeting. • STATEMENT OF PARTICIPATION BY THE DEPUTY CITY CLERK 1. PUBLIC COMMENT Scott Robinson, Boys and Girls Club of Cathedral City, was called to speak. He announced the International Meatball Festival will be held on October 7, 2018. He also thanked the community for supporting the Boys and Girls Club of Cathedral City. John Wesley, Cathedral City resident, was called to speak. He discussed his time volunteering and working for Noah's Arc Pot Belly Pig Farm. He spoke about the size and personalities of pigs and feels that the City is not ready for breeding pigs. Rosario Avila, Cathedral City resident, was called to speak. She requested a written response to her public records request indicating there are no documents available regarding eminent domain of her family's business. She stated that she does not support road diets. She referred to an article from the Associated Press regarding transparency of social media. Mayor Pro Tern Greg Pettis announced that Council Members would be attending the League of California Cities Conference where social media legislation would be discussed. Alan Carvalho, Cathedral City resident, was called to speak. He spoke about individuals sharing social media accounts. 2. COUNCIL REPORTS Councilmember John Aguilar discussed the Job/Career Fair sponsored by the Cathedral City Community Coalition on July 26, 2018. Councilmember Shelley Kaplan announced the ribbon cutting ceremony that will take place at State Farm Insurance on July 26, 2018. He reported that he represented the City and Council at a press conference regarding the Veteran's LGBT state memorial. Councilmember Mark Carnevale discussed a meeting regarding the tribute destination for Ophelia Bringas. He reported that he was the keynote speaker at the Mayfield College graduation. He stated that the American Youth Soccer Organization lighting issue has been resolved. He also discussed his encounter with a homeless family who was able to find housing. Mayor Pro Tern Greg Pettis discussed a meeting with Senator Feinstein who voiced her support for the Los Angeles to Indio Train project. He also announced that Council would be attending a 100th birthday celebration for a Cathedral City resident. 3. CONSENT AGENDA 3.A. 2018- 296 Adoption of the MSRC Local Government Partnership Program Requirements for$50,000 MSRC Matching Funds. Recommendation: Staff recommends the approval of a Resolution of the City of Cathedral City adopting the MSRC Local Government Partnership Program Requirements for the $50,000 MSRC Matching Funds. Mayor Pro Tem Pettis disclosed that he was on the Board of the MSRC and that there was no financial benefit to him, so he was able to vote on the matter. Reso 2018-33 3.B. 2018- 298 Purchase Agreement Second Amendment and Performance Agreement First Amendment for Downtown Mixed-Use Project Recommendation: Staff recommends the City Council, as the Housing Successor Agency, authorize the City Manager to execute a Second Amendment to Purchase and Sale and Escrow Instructions Agreement between the City as the Housing Successor Agency and Cathedral Canyon Development LLC; and authorize the City Manager to execute the First Amendment to the Performance Agreement between the City as the Housing Successor Agency, Cathedral Canyon Development LLC, and the City Urban Revitalization Corporation. M.O. 6994A A motion was made by Councilmember Aguilar, seconded by Councilmember Carnevale, to approve the Consent Calendar. PUBLIC HEARINGS 4.A. 2018-260 Resolution Approving Tax Roll Billing, the New Adjusted Rate schedule of Fees for the Collection, Recycling, and Disposal of Municipal Solid Waste. Recommendation: Staff recommends the adoption of a Resolution of the City Council of the City of Cathedral City approving tax roll billing and the increase on the service rates charged to all roll-off, residential, multifamily and commercial customers for cost of living increase based on the Consumer Price Index (CPI) and Riverside County's gate fee increase. Mayor Pro Tern Pettis opened the Public Hearing for discussion, there being none, he closed the Public Hearing. Reso 2018-32 A motion was made by Councilmember Kaplan, seconded by Councilmember Aguilar to adopt a Resolution approving tax roll billing, the new adjusted rate schedule of fees for residents, commercial, and roll-off, for the collection, recycling, and disposal of municipal solid waste and residential/commercial recycling. The motion carried by the following vote: Aye: 4- Mayor Pro Tern Pettis, Councilmember Kaplan, Councilmember Carnevale, and Councilmember Aguilar Absent: 1- Mayor Henry 5. LEGISLATIVE ACTIONS S.A. 2018-297 Summary Report of Public Arts Funding for Art Education Programs During the Fiscal Year 2017/2018 Recommendation: This item presented for information, discussion and direction only. Deanna Pressgrove, Staff Liaison for the Public Arts Commission, provided a summary on the funding amounts of the projects supported by the Arts Education Fund during FY 2017/2018. Mayor Pro Tern Pettis questioned why the City participates in the Chalk Event. Deanna Pressgrove, Staff Liaison for the Public Arts Commission, gave an overview of the Chalk Event and stated that Cathedral City students participate in the event. Councilmember Mark Carnevale requested clarification on the outcome and the fees associated with the Transgender Humanitarian Stone Wall Event. Charles McClendon, City Manager, clarified that the Transgender Humanitarian Stone Wall Event was a success and he discussed the costs associated with the event. Alan Carvalho, Cathedral City resident and Chair of Public Arts Commission, thanked the Council for increasing the budget for art education funding. He confirmed that the cost for the Transgender Humanitarian Stone Wall Event is not an annual expense. Scott Robinson, Boys and Girls Club of Cathedral City, thanked the Public Arts Commission. 6.
