A. Landscape & Lighting District- Panorama & Century Park
Recommendation: This item is presented for information, discussion and
direction only.
Tami Scott, Administrative Services Director introduced the item and gave a brief
background on the formation of Landscape and Lighting Maintenance District 1.
She presented information on Century Park zone 16 and Panorama Park zone
17 including the background, annual assessment, engineers annual levy report,
improvements and maintenance, and improvement costs. She explained the
options for eliminating the assessment if the City Council gave direction to do so.
Councilmember Raymond Gregory thanked those who spoke and emailed the
Council Members. He commended the residents and feels that they are unfairly
taxed, and the assessment should be removed. He stated that it is a blessing
that the amount is small, and the City can absorb the removal of the assessment.
He urged the City Council to set the tax to zero for as long as the City is able.
Councilmember Ernesto Gutierrez stated that he agrees with Councilmember
Gregory and he also agrees that the City needs to be wise when it comes to the
General Fund. He stated that he supports the removal of the tax.
Mayor Mark Carnevale stated that he would like to see the tax removed.
George Brain, Cathedral City homeowner, reported that he sent a document
through email that summarizes his position on this item. He stated that voters
who originally voted for the tax felt pressured. He is opposed to the assessment
and would like to see the entire assessment removed not just the park portion.
Pattie Hagedorn, Cathedral City resident, stated that she lives in the Panorama
Park area and she loves the parks. She stated that she would like to see the
assessment on the park maintenance removed or everyone should have to pay.
Chip Yarborough, Cathedral City resident, stated that he concurs with Pattie
Hagedorn and George Brain. He believes that there are people that can use the
savings from the removal of the assessment. He feels that if the City can afford
to have events they should be able to remove this assessment. He feels that
everyone should be assessed for the parks because the community uses the
parks and not just the residents that pay the assessment. He proposed finding
the money in the budget to cover these expenses.
It was the consensus of the City Council to remove the Park Maintenance
Assessments for Panorama Park and Century Park.
B. 2019 City Wide Speed Limits Survey Results Review
Recommendation: Results of the 2019 City Wide Speed Limits Survey will be
presented for review, discussion and comment.
John Corella, Director of Engineering and Public Works, introduced the item and
provided an overview of the 2019 City Wide Speed Limits Survey. He presented
the requirements, uniform procedures, 85th percentile, results, and examples.
It was the consensus of the City Council that the speed limit on Landau Blvd. be
45 mph and to move forward with the remaining proposed speed limits based on
the survey that was conducted by Albert A. Webb Associates, including
Cathedral Canyon at 35 mph.
C. Update and Information on Potential Sewer Assessment Districts
Recommendation: Staff will present the locations within the City that are not
connected to a Sewer System and provide information on
Assessment District formation, landowner participation
requirements and Staff efforts. Presentation is for City
Council information, discussion and direction.
John Corella, Director of Engineering and Public Works, introduced the item and

gave an update on Sewer Assessment Districts. He gave an overview of the
areas that have and do not have sewer, and the community meetings in areas
that do not have sewer to discuss sewer assessments.
Mayor Mark Carnevale requested that staff invite Council Members who
represent the district where community meetings are held when discussing sewer
assessment districts.
D. Economic Development 2019 Strategic Plan
Recommendation: This item is presented for information and discussion only.
It was the consensus of the City Council to continue this item to the Regular
Meeting if time permits.
3. CLOSED SESSION
Eric Vail, City Attorney announced that the City Council will meet in Closed Session
to discuss the following items on the Agenda.
A. Conference with Legal Counsel - Anticipated Litigation Pursuant to
Government Code Section 54956.9(d)(2).
Number of Potential Cases: Two
B. Conference with Real Property Negotiator Pursuant to Government Code
Section 54956.8.
Property Location: Approximately 13.5 acres south of East Palm Canyon Drive
at Date Palm Drive
Negotiating Parties: City of Cathedral City as the Successor Agency to the
former Redevelopment Agency and the City Urban Revitalization Corporation
Property Owner: City Urban Revitalization Corporation
Under Negotiations: Price and Terms for potential sale of real property
City Council adjourned to Closed Session at 5:45 p.m.
The City Council reconvened at 6:30 p.m.
City Attorney Eric Vail announced that the Council met in Closed Session to discuss
item 3A. Conference with Legal Counsel - Anticipated Litigation Pursuant to
Government Code Section 54956.9(d)(2), two potential cases. There was no
reportable action. He indicated that item 3B. Conference with Real Property
Negotiator Pursuant to Government Code Section 54956.8, approximately 13.5
acres south of East Palm Canyon Drive at Date Palm Drive will be heard during the
Regular Meeting and will be reflected in the minutes of February 27, 2019.

1. PUBLIC COMMENT
George Brain, Cathedral City homeowner was called to speak. He thanked the City
Council for eliminating the Panorama Park zone 17 and Century Park zone 16
Landscape and Lighting District assessment.
Monica Castillo, PSUSD Early Childhood Education Teacher was called to speak.
She invited the City Council to attend the 10th annual Day of the Young Child event
on March 9, 2019 and gave an overview of the event. She thanked the City Council
for their support over the last 8 years. She provided a flyer on the event for more
information.
Shine Nissar, Consortium ELS was called to speak. She invited the City Council to
the 18th Annual Legislative Breakfast on March 22, 2019. She thanked the City
Council for their support.
Chip Yarborough, Cathedral City resident was called to speak. He congratulated the
Fire Chief, his staff, and the Union President on the Fire Department Strategic Plan.
He feels that there are items in the plan that can be easily funded and it is his hope
that the City Council approves them.
2. COUNCIL REPORTS
Councilmember Raymond Gregory stated he continues to have meetings with
residents and staff and he thanked everyone who has taken the time to meet with
him. He reported that he attended the International Brotherhood of Electrical
Workers and congratulated them on opening an office in the Valley. He toured the
Suniva facilities on Friday, February 15, 2019, and reported that it was quite
impressive. He thanked them for the tour. He also attended "The Desert Sea Project"
by artist Christopher Cichocki, which was spectacular. He encouraged everyone to
see it. He reported that he attended the Chili Cook Off at the Senior Center, the
Agnes Pelton Museum open house, and the Desert Community Energy Board
Meeting.
Council Member Gutierrez reported that he attended his first CVAG Energy
Commission Meeting, the new Agua Caliente School campus grand opening and the
Suniva tour with Council Member Gregory, which is an amazing state of the art
facility. He reported that he met with Police Chief Walker and is looking forward to
many more productive meetings. He also reported that he has met with many
residents regarding code enforcement issues.
Mayor Carnevale met with representatives regarding ERICA. He reported that he
attended the Executive Meeting with CVAG. He also attended the Homeless
Committee Meeting where they voted in Housing First. He announced that he was a
volunteer for the Mary Nutter Tournament, which was a successful event. He
reported that he attended the Chili Cook Off at the Senior Center. He announced the
State of the City will be held on March 5, 2019.

Recommendation: The City Council acting in its capacity for the City, the

Foundation Board receive and file payment of claims and

B. Reject Bids for the Construction of the Stage Structure for
Commons/Heritage Park Project and Authorize the City Manager to
Negotiate and Secure a Proposal from a Qualified Contractor to Construct
the Stage Structure.
Recommendation: Staff recommends the City Council reject the bid proposals
received for the construction of the Stage Structure for
Commons/Heritage Park; and authorize the City Manager to
negotiate a proposal from a qualified contractor for the
construction of the Stage Structure.

C. Police Department Application for Agua Caliente Band of Cahuilla Indians
Donation
Recommendation: Staff recommends the City Council approve accepting a
$25,000 donation from the Agua Caliente Band of Cahuilla
Indians to provide funding for the Honor Guard program and
to purchase equipment to better serve the community.
These purchases will be in the form of a computer terminal
kiosk in the lobby for public access, Law Enforcement
Command Boards, computerized citation writers,
Communication Boxes, and an unmanned aerial vehicle.

D. Resolution Adopting Council Goals for 2019
Recommendation: Staff recommends the City Council approve a resolution
adopting the City Council goals for 2019.
Reso 2019-01
E. Resolution Adjusting Cannabis Dispensary Tax
Recommendation: Staff recommends the City Council adopt a resolution
adjusting the tax on Cannabis Dispensaries to exempt the
sale of non-cannabis merchandise from the tax.

F. Award a contract to All American Asphalt for the construction of the Ortega
Road Widening and Sidewalk Gap Closure.
Recommendation: Staff recommends the City Council award a contract to All
American Asphalt in the amount of$459,998.00 for the
construction of the Ortega Road Widening and Sidewalk
Gap Closure; and approve a contingency of$28,985.00 for
any unforeseeable construction costs; thereby, making the
total encumbrance for this project $488,983.00; and

authorize the City Engineer to issue the Notice of Proceed
and request bonds and insurance for the Project; and
authorize the City Manager to execute the contract
documents.

H. Reject the Bids for the Date Palm Dr. & Gerald Ford Dr. Sidewalk Gap
Closure Project
Recommendation: Staff is recommending that the City Council reject the bids
for construction of the Date Palm Drive & Gerald Ford Drive
Sidewalk Gap Closure Project and direct staff to re-advertise
for construction bids.

A. Appointment to Fill the Vacant Council Seat
Recommendation: Staff recommends the City Council review the materials
submitted by the candidates for appointment to the vacant

Council seat and make an appointment.
Mayor Mark Carnevale announced that Eric Vail, City Attorney will read rules and
conduct for the meeting. He stated that the individuals who submitted a questionnaire
will have the opportunity to address the City Council for 3 minutes if they desire,
followed by any public comments. He explained that staff would do a randomized
number draw to pick the order in which the individuals would be called to speak.
Eric Vail, City Attorney, read sections from the City Council Administrative Policy
regarding decorum. He reminded everyone that decorum will help the City Council get
through the meeting in an orderly manner and allow the public an opportunity to
exercise their right to speak in a civil manner.
Charles McClendon, City Manager conducted the randomized number draw and read the
order in which the applicants would be called to speak.
Stanley E. Henry, City Council applicant, was called to speak. He stated that former
Mayor Greg Pettis was a friend and loyal to Cathedral City. With his passing there is now
a void of knowledge and historical data. He believes the City needs to know where we
have been to know where we are going. He stated that he has the background, loyalty,
knowledge, and understanding of all the City Council goals. He stated that he has no
desire to go back on former actions taken by the Council, he wants to keep Cathedral
City moving forward.
Shelley Kaplan, City Council applicant, was called to speak. He expressed his appreciation
for all those that came out to discuss this important issue. He believes this process is a
sham and that some members of the Council have lost the trust of their constituents. He
supports the appointment of someone who resides in district one, and he believes Greg
Pettis would have wanted the same. He feels the City Council is hesitant to appoint him
to fill the vacant seat on Council not because of his lack of abilities but because of who
he is married to, which he finds to be naive, short sided, and narrow-minded. He
indicated that there are three women who reside in district one, he believes that
choosing one of them would avoid any concerns that may arise by appointing him or
another candidate from another district and feels that it would be good to have the
gender diversity.
Elmer Diaz, City Council applicant, was called to speak. He stated that he is a Union
Electrician and his interest in pursuing the vacant seat on the City Council is to represent
the working families of Cathedral City. His personal agenda will be to bring jobs and
good paying careers into the City. He has two children who attend school in town, so he
has a vested interest. He believes the regular working-class family is not currently
represented on the City Council and he can be that representation. He offered to answer
any questions and thanked the City Council for their time.
Paul Spencer, City Council applicant was called to speak. He stated that this process has
been tainted and the City Council's only option is to hold a special election. He asked that
the City Council honor democracy and abandon the appointment process and call a
special election.

Louie "Chip" Yarborough, City Council applicant, was called to speak. He stated that this
appointment process has been flawed and unfair. He is in favor of a special election. He
expressed concern about not letting the candidates know about the opportunity to speak
for 3 minutes. Those not present would miss their opportunity to speak on their behalf.
He cited information from a video on ethical unfair processes that a City will institute. He
stated that the City Council has the ability to stop the process and do it the right way.
Jamie Lynn Birch, City Council applicant, was called to speak. She had hoped to be
appointed to fill the vacant City Council seat. She stated that there has been a shadow
cast on the process and is concerned that the process is not fair, but rather a back-door
deal done between friends. She requested the process be delayed and investigated. She
suggested the City Council let the people of Cathedral City speak and call a special
election.
Rebecca Sameroff Robinson, City Council applicant, was called to speak. She expressed
her disappointment with the City Council. She stated that her glass is usually half full but
prepares for when the glass is half empty. She supports an appointment to fill the vacant
seat by the City Council.
Rita Lamb, City Council applicant, was called to speak. She gave a brief background
about herself. She stated that she was a retired school principal and a former member of
the Cathedral City Public Arts Commission. During her time at Desert Sands Unified
School district, she was an Action Team Leader on their Strategic Planning Process. She
stated she was very impressed with the 2018 goals of the City. She thanked the City
Council for their consideration and recited her favorite slogan "if you want to go fast go
alone, and if you want to go safely go together."
Enrique Saldivar, City Council applicant, was called to speak. He thanked the City Council
for allowing him to address them today. He explained that he was not there to blame,
judge or point fingers but rather to help with the sad situation our city is in. He loves the
City and its residents. He stated he still holds a ray of trust that the City Council will act
on the good of the community. He feels he has a balance that connects him with the
diverse community that makes Cathedral City and that balance is good for the
community. He hopes the City Council makes the right choice for the good of the
community.

Lynne O'Neil, Cathedral City resident was called to speak. She thanked Mayor Pro Tem
John Aguilar and Council Member Raymond Gregory for the comments made regarding
Shelley Kaplan. She expressed her concern with the character assassination that has

taken place. She is also concerned with how people rise to power not who rises to power.
She would like to have someone from district one appointed to serve and represent the
residents in district one. District one deserves representation. She encouraged the City
Council to do the right thing.
Art Gregoire, Cathedral City resident, was called to speak. He thanked Council Member
Raymond Gregory and stated that he has given him hope for the current City Council. He
expressed concerned about the application process, he believes the questionnaire was
written to expedite the process because the decision had already been made. He believes
that all the applicants have done a great job here tonight addressing the City Council. He
apologized to the applicants for the lack of their due process and thanked them for
stepping up to represent their city. He employed the City Council to delay this process
and believes the City and district one deserves better.
Dan Bowe, Cathedral City resident, was called to speak. He apologized to Mayor Mark
Carnevale for appearing as if he was trying to speak out of order, he feels the process is
so unclear and he needed clarification. He believes that the City Council has a lot of
learning to do, and that Staff holds some of the responsibility. He expressed his concern
with the application process and proposed the City Council reconsider moving forward
with the appointment process.
John Rivera, Cathedral City resident, was called to speak. He believes that district one
should be represented by someone who resides there. He indicated he has reached out
to the City Council urging them to tread lightly and stated public perception can be
damaging. He stated that he has a lot of respect for the City Council and it is a shame
that we are where we are today. He encouraged the City Council to honor the districts.
Peter Maietta, Candidate for Palm Springs City Council, was called to speak. He endorsed
Shelley Kaplan and is in favor of an appointment to the vacant seat because it is faster,
cheaper, and allows the public to participate. He encouraged the City Council to choose
someone that is aligned with the values of former Mayor Greg Pettis.
Tom Kuhn, Palm Springs resident, was called to speak. He stated that he is concerned
about the governments in the Coachella Valley. He supports the City Council appointing
someone from district one. He believes there are plenty of qualified candidates from
district one that the Council could consider. He thanked the City Council.
Kathleen Patterson, Cathedral City district one resident, was called to speak. She stated
that a woman's presence could compliment the City Council. She thanked the City
Council and hopes they make the appointment to fill the vacant seat. She supports the
appointment of Stan Henry.
Sonja Marchand, Cathedral City resident, was called to speak. She stated that district
one deserves a district one representative. She urged the Council City to call for a district
one election. She warned that the cost of the election will be a lot less than the legal fees
the City could face.

Ana Cabral, United Food and Commercial Workers Union, was called to speak. She
supports the City Council calling for a district one special election so that the process is
fair and transparent. She also indicated that the UFCWU does support the appointment
of Shelley Kaplan.
Peter Palladino, Cathedral City resident, was called to speak. He discussed his personal
friendship with former Mayor Greg Pettis. He stated that the City Council can spin it
anyway they want, but people are going to see what is happening. He urged the Mayor
to do the right thing.
Simeon Den, Cathedral City resident, was called to speak. He does not believe the City
Council had a devious plan. He believes everyone can agree that this process has been
flawed. Everyone loves the City, and everyone has different ideas. He comes to the City
Council as a friend and he wants them to do what is best for the City, so they can be
proud again.
Denise Rodriguez Bowman, Cathedral City resident, was called to speak. She stated that
she has lived in Cathedral City, in district one for 40 years. She is disappointed with what
has unfolded with the City Council. She would like a representative on the City Council
that understands the needs of those that live there and will advocate for them. Most of
the people in the lower Cove are middle to low income. She would like a representative
that is sensitive, thoughtful, progressive, and someone who knows what it is like to not
have a great living wage. She also wants someone that will take the time to get
connected and engage with the residents in district one. She stated that she will be open
and fair when endorsing someone and she feels that Shelley Kaplan would do a good job,
but she also believes the City needs diversity and a woman deserves to be there.
Terry Applegate, Cathedral City resident, was called to speak. She supports Shelley
Kaplan. She feels the proposed process is flawed and she would like the City Council to do
the right thing and call for a special election.
Ellen O'Rourke, Cathedral City resident, was called to speak. She feels she is watching
democracy fall apart. Everyone makes mistakes, the important thing is to correct those
mistakes. She believes that the City Council has lost its moral authority to appoint
someone and supports a special election.
Chrys Goodell, Cathedral City resident, was called to speak. She stated that she filed a
freedom of information request and received copies of emails and gave statistics of
those in favor for a district one representative.
Allen Worthy, Palm Springs resident, was called to speak. He expressed his frustration
with the City. He believes the City Council has lost all moral authority and they need to
call a special election. He wants the Mayor to resign.
Bill Holzhauer, Palm Desert resident, was called to speak. He cited information from the
Freedom of Information Act and the Brown Act. He feels the City Council has violated the
Brown Act.

Diane Gill, Cathedral City resident, was called to speak. She feels that it was odd that the
application process did not include a background check and an interview. She stated that
she is against doing a costly election and is supportive of appointing a woman to fill the
vacant seat.
Dale Jagodzinski, Cathedral City resident was called to speak. He would like the City
Council to appoint someone at-large to fill the vacant seat since it was an elected at-
large seat. He endorses Stan Henry.
Valerie Schecter, Cathedral City resident, was called to speak. She stated that the
appointment process has been screwed up and the City Council should not appoint
anyone tonight. She proposed the City Council take into considerations the beliefs of
Greg Pettis and those in district one.
Jasmine Espinoza was called to speak. She stated she is grateful that City is a sanctuary
city. She would like the City Council to go to district voting.
Rosario Avila, Cathedral City resident, was called to speak. She is opposed to appointing
Shelley Kaplan to fill the vacant seat. She feels whoever fills that seat should be someone
who can communicate with the community.
Roger Culbertson, Cathedral City district one resident, was called to speak. He stated
that he is disturbed by the tone of the City Council. He believes people who do not
support Shelley Kaplan have been scared away from attending meetings because of the
retribution they face over social media. He stated there are five candidates from district
one which should make it easy for the Council to appoint someone. He supports the
appointment of Rita Lamb. He provided a brief background on Rita Lamb and he believes
she will bring a good balance to the current City Council.
Sergio Espericueta, Cathedral City resident, was called to speak. He advocated for district
elections. He supports the appointment of someone from district one.
Michael Hagedorn, Cathedral City resident, was called to speak. He stated if individuals
were interested in being appointed to fill the vacant seat they should be at the meeting.
He is in support of appointing a woman from district one.
Mayor Mark Carnevale stated that this has been a hard couple of weeks. He stated that
he has always been fair and honest, and he has heard everyone. He has made his mind
up multiple times throughout this process. He is not in favor of an election. He thinks
appointing a woman would be good. He stated that the City Council will discuss the issue
here and now to make a decision, not in private.
Mayor Pro Tern John Aguilar thanked everyone for attending. He stated that all four
Council members have been very careful not to discuss candidates with each other. They
have however discussed the social media attacks on some candidates and Council
members and how distasteful they were. He stated that the public's portrayal of his

emails is not true. His emails were to show Stan Henry, despite the attacks against him,
there are reputable people of the community who support him. He stated that his email
in question was an attempted jester to balance the attacks against Stan Henry from a
group supporting another applicant. He believes that former Mayor Greg Pettis would
want him to vote with his conscious for what is best for the City and he believes Stan
Henry would be a great choice for a variety of reasons. He stated that for as long as he is
on the City Council all of the important decisions that have been made in the past will
not be at risk.
Councilmember Raymond Gregory thanked everyone for coming. He stated that he had
hoped they would be able to resolve this issue by making an appointment and feels the
processes could have gone smoother. He wants to listen to what the facts are, not to
who spoke more passionately. He can see that district one needs representation.
Although he believes the City Council would make the best unbiased decision, he does
not believe they should appoint someone at this time and a special election for district
one only should be called.
Councilmember Ernesto Gutierrez stated that he went through all the applications and
considered all applicants equally. He would like to see someone fill the vacant seat that
will unite the City, has no personal agenda, is honest, has vision, and has integrity. He
will not cave under pressure and he will make the decision that is best for the City.
Motion to call a special all-mail ballot election to fill the vacant seat on the City Council
representing District One only and to allow qualified electorates from District One only to
run in the election.
