• MAYOR'S RECOGNITION - Chris Parman
The Mayor and City Council presented Chris Parman, the City's Communications
and Events Manager, with a certificate of appreciation for his efforts and execution of
the "Celebration of Life for Mayor Gregory S. Pettis".
• STATEMENT OF PARTICIPATION BY THE CITY CLERK

2. STUDY SESSION
A. Sister Cities January 2019 Tequila, Jalisco Mexico Work Trip Update
Recommendation: This presentation is to update the Council on the work
accomplished to date, and the immediate direction of the
Sister Cities Task Force.
Stone James, Economic Development Director, and Pattie Hagedorn, Sister City
Task Force Member, provided an update to the City Council on the
accomplishments of the Sister City Task Force, their immediate goals and their
recent trip to Tequila, Jalisco, Mexico.
B. Fire Department Strategic Plan 2019-2023
Recommendation: This item is presented for information, discussion and
direction only.
Paul Wilson, Fire Chief, presented the 2019-2023 Strategic Plan for the Fire
Department. He indicated that the 2019-2023 Strategic Plan for the Fire
Department will come before the Council for approval at their next meeting.
C. Regulation of Cannabis Advertising on Billboards
Recommendation: This item is presented for information, discussion and
direction only.
Eric Vail, City Attorney, provided an overview of billboard regulations that are
currently in place and state regulations.
Nancy Ross stated that she is not necessarily concerned with the size or the
amount of billboards, however, she is concerned with the messages that are on
the billboards and how it can affect children. She feels that some of the
messages are not family friendly. It is her opinion that it is the responsibility of
the billboard companies to manage and ensure all regulations related to
advertisements are met.
It was the consensus of the City Council to direct staff to do an analysis on all of
the billboards and bring back the information along with recommended
regulations.
D. 2019 City Wide Speed Limits Survey Results Review
Recommendation: Results of the 2019 City Wide Speed Limits Survey will be
presented for review, discussion and comment.
The 2019 City Wide Speed Limits Survey Results Review was continued to
February 27, 2019.
3. CLOSED SESSION
Eric Vail, City Attorney, announced that the City Council will meet in Closed Session
to discuss the following items listed on the Agenda.

The City Council reconvened at 6:30 p.m. City Attorney Eric Vail announced that the
City Council met in Closed Session and discussed items 3A. Conference with Labor
Negotiator Pursuant to Government Code Section 54956.6 and 38. Conference with
Legal Counsel - Anticipated Litigation Pursuant to Government Code Section
54956.9 (d)(2), two potential cases. There was no reportable action taken. Item 3C.
Conference with Real Property Negotiator Pursuant to Government Code Section
54956.8, approximately 13.5 acres south of East Palm Canyon Drive at Date Palm
will be heard during the Regular Meeting of February 13, 2019, and will be reflected
in the minutes.

• SPECIAL PRESENTATION - Introduce the 2019 Riverside County Fair &
National Date Festival Queen & Court
The 2019 Riverside County Fair & National Date Festival Queen and Court
introduced themselves and gave a breakdown of the activities at the Fair.
• STATEMENT OF PARTICIPATION BY THE CITY CLERK
1. PUBLIC COMMENT
Allen Worthy, Cathedral City, spoke again regarding an old case. He stated that he
filed a claim due to a violation of a Government Code. He also stated that he was
harassed by one of the officers and wants the Chief of Police to resign as well as the
Deputy Chief.
Bethany Ballard, Cathedral City, wanted to confirm that the City Council received an
email that she sent to each of them. She also stated that the speakers in the
Council Chambers are supposed to be for the hearing impaired, however, they are
not. She would really like to see something done for the hearing impaired in the
chambers.
Mayor Mark Carnevale requested that staff to look into having hearing devices for
those that need them in the Council Chambers.
2. COUNCIL REPORTS
Councilmember Ernesto Gutierrez stated that he has had a very busy few weeks.
He attended the Goal Setting Workshop, Celebration of Life for former Mayor
Gregory Pettis, took a tour of the City with John Corella, Director of Engineering and
Public Works, to look at the streets and areas that may need improvement. He also
toured the City with Robert Rodriguez, Director of Planning and Building, to look at
areas that need to be addressed by code enforcement. He met with Mayor Pro Tern
John Aguilar and the sub-committee to discuss potential living legacies for Mayor
Gregory Pettis. He also attended the Taste of Jalisco festival.
Mayor Pro Tern John Aguilar announced that he recently took a position on the
Board for Shelter from the Storm. He requested that the 24 hour victims hotline
number be added to the City website. He reported that he attended the League of
California Cities Executive Committee meeting. He stated that he was invited by
Supervisor Perez to attend a meeting that was held in Rancho Mirage where the
findings of a survey that was done on County Veterans was presented. One of the
needs that was identified is sustainable housing. He is excited that the City is
working on the Veterans Housing project to try and address some of those needs.
He attended the DCE Board Meeting and as indicated by Councilmember Gutierrez,
the sub-committee meeting for the Lasting Memorial for Mayor Gregory Pettis. He
indicated that the City has been working for quite some time trying to improve
access to better financial access and is happy to announce that Wells Fargo has
agreed to a new free standing bank.
Councilmember Raymond Gregory stated that he also attended a lot of the prior
mentioned events. He feels that all of the events are really well done and it's
amazing what is going on in the City. He reported that he attended the C VA G Public
Safety Committee Meeting, Desert Community Energy Committee Meeting and
CVAG Transportation Committee Meeting. He also reported that in the last couple
of weeks he was able to attend a Planning Commission Meeting and Public Arts
Commission Meeting.
Mayor Mark Carnevale reported that he and Stone James, Economic Development
Director, met with the Auto Dealership group. He felt that they had very positive
discussion with the group. He feels that CVREP is a magnificent opportunity for the
City.

Recommendation: Staff recommends the City Council review the list of Local
Agency Assignments and ratify the appointments.

C. 2019 Agua Caliente Band of Cahuilla Indians Grant Award
Recommendation: Staff recommends the City Council approve a grant award
from the Agua Caliente Band of Cahuilla Indians in the
amount of$33,836 to the fire department. The 2019 award
provides funding for structural firefighting coats and pants for
fourteen incumbent firefighters and provides funding for an
EMS rapid entry system for home-bound or functional needs
residents.

D. Whitewater Bike Trail Final Acceptance and Notice of Completion
Recommendation: Staff recommends the City Council accept and approve the
Whitewater River Bike Trail, CIP 7015 as final; and authorize
the City Manager to file a Notice of Completion with the
Riverside County Recorder's office on behalf of the City
Council; and authorize the release of City held retention
funds to CT&T Concrete Paving upon expiration of the
Notice of Completion.

A. Zone Ordinance Amendment No. 18-002A TUMF Fee
Recommendation: Staff recommends the City Council approve a minor
amendment to Chapter 3.40 (Transportation Uniform
Mitigation Fee) of the Municipal Code to correct an
inadvertent omission of text within Ordinance 816.
Approve the first reading, by title only, of an Ordinance of the City Council
of the City of Cathedral City amending Section 3.40.070 of the City of

Cathedral City Municipal Code.

5. LEGISLATIVE ACTIONS
A. Process of Filling a Vacated Council Seat
Recommendation: Staff recommends the City Council: (1) Decide to fill the
vacated Council seat by appointment rather than by special
election; and (2) that Council discuss and direct the process
by which candidates will be considered for appointment to
the vacant seat and set any relevant dates associated with
such process.
City Attorney Eric Vail provided an overview of the requirements of the City
Charter and State Law to fill the vacant seat on the City Council. He provided the
options available to the Council and requested that they have a discussion on
how to proceed. He encouraged those in the audience to be respectful while
others are speaking so that everyone has an equal opportunity to speak and be
heard.
Richard Altman, Cathedral City, stated he supports the Council appointing who
they feel would be right for the City. He supports the appointment of Shelley
Kaplan.
Michael Higgens, Gay Business Association, stated that he chose to open his
business in Cathedral City because it is a very progressive City. He would like to
see someone appointed that will continue to move Cathedral City forward.
Antonio Lopez, would also like to see someone appointed that will continue to
move Cathedral City forward. He stated that the Gay Business Association voted
to recommend Shelley Kaplan to fill the vacant seat.
Art Gregoire, Cathedral City District 1 resident, stated that Shelley Kaplan is a
progressive leader that is the best choice for Cathedral City and he supports his
appointment.
Steven Gire, Cathedral City District 1 resident, stated that he is a proud resident
of District 1. He feels that the appointment should be someone that lives in
District 1 and he supports the appointment of Shelley Kaplan.
Becki Robinson, Cathedral City resident, stated that she is a homeowner in the
northern part of District 1. She feels that there is only one way to honor Greg

Pettis' legacy and that is to appoint someone that will continue his ideas. She
supports the appointment of Shelley Kaplan.
Bill Holzhauer, Palm Desert resident, stated that he supports someone from
District 1 being appointed to fill the vacant seat and supports the appointment of
Shelley Kaplan.
Yolanda Brown, Joshua Tree resident, stated that she supports the appointment
of Shelley Kaplan.
Yasmin Espinoza, Palm Springs resident, supports the appointment of Shelley
Kaplan.
Laura Ahmed, Cathedral City resident and business owner, stated that she
resides in District 5 and owns a business in District 1. She feels that owning a
business in District 1 should qualify her to represent District 1 and would like to
be considered. She stated that she votes on the issues and not on her emotions.
Lewis Stewart, Cathedral City resident, discussed the appointment process and
voting on the issues. He thanked the City Council for their consideration of his
comments.
Peter Maietta, Palm Springs resident, stated that the City Council should be
following the California Government Code as it was intended, and he supports
the appointment of someone from District 1 and the appointment of Shelley
Kaplan.
Jimmi Thomas, Palm Springs resident, echoed the comments of Becki Robinson.
He feels that the City must keep moving forward, and other cities are following
Cathedral City. He would like the Council to listen to the will of the people and he
supports the appointment of Shelley Kaplan.
Kathleen Patterson, Cathedral City District 1 resident, stated that she supports
the appointment of Stan Henry.
Sue Townsley, Cathedral City resident, stated she supports the appointment of
someone from District 1 and the appointment of Shelley Kaplan.
Dan Bowe, Cathedral City resident, supports the appointment of someone from
District 1.
Lynnie O'Neill, Cathedral City resident, supports the appointment of someone
from District 1 and the appointment of Shelley Kaplan.
Antonio Baciu, Cathedral City resident, supports the appointment of someone
from District 1 and the appointment of Shelley Kaplan.
Chuck Parker, Bermuda Dunes resident, stated that the City Council has always
been a place where he felt safe to come. He was very proud when the City voted
to become a sanctuary city. He feels that whatever the Council decides it should

be the will of the people that voted for Greg Pettis. He supports the appointment
of someone from District 1 and the appointment of Shelley Kaplan.
Feliz Nunez, Bermuda Dunes resident, stated that whoever is chosen to fill the
vacant seat should live in the district and know the needs of the people.
Joe Duffle, President of the Central Labor Counsel for San Bernardino and
Riverside Counties, stated that he was a personal friend of Greg Pettis. He
stated that there is someone from District 1 that can be appointed and supports
the appointment of Shelley Kaplan.
Ricardo Cisneros, Secretary of Treasure for the Central Labor Counsel, stated
that he stands in support of the appointment of Shelley Kaplan.
Bill Perez, Executive Secretary of the San Bernardino and Riverside Building
Trades Council, stated that he supports the appointment of someone from
District 1 and the appointment of Shelley Kaplan.
Ellen O'Rourke, Cathedral City resident, stated that she and her husband moved
to the City three years ago and she supports the appointment of Shelley Kaplan.
Miriam Alario, Cathedral City resident, stated that she supports the appointment
of someone to represent everyone.
David Eckert, Cathedral City resident, stated that the City Council should select
someone from District 1.
Robert Kretzla, Cathedral City resident, stated that the City Council should
appoint someone from District 1.
Randy Cupp, Cathedral City District 1 resident, stated that he has lived here for
15 years and he feels that someone should be appointed from District 1.
Bruce A. Lederer, Cathedral City District 1 resident, stated that he supports the
appointment of someone from District 1 to fill the vacant seat.
Carlson Peters, Cathedral City District 1 resident, stated that he feels the District
deserves representation and supports Shelley Kaplan.
Peter Palladino, Cathedral City resident, stated that he supports appointing
someone from District 1 and the appointment of Shelley Kaplan.
Simeon Den, Cathedral City resident, thanked the Council for their service. He
commended his neighbors for coming out to speak and he feels that someone
from District 1 should be appointed. He supports the appointment of Shelley
Kaplan.
Heather Bray, Cathedral City District 1 resident, stated that she supports the
appointment of Stan Henry.

Josie Diaz, Cathedral City resident, stated that she supports filling the vacant
seat by appointment. She feels that Stan Henry or Shelley Kaplan would do a
fine job and she does not support the appointment of Laura Ahmed. She
supports the appointment of someone from District 1.
Robert Durban, Cathedral City District 1 resident, stated that he supports the
appointment of someone from District 1.
John Rivera, Cathedral City resident, stated that he supports the appointment of
someone from District 1 and the appointment of Shelley Kaplan.
Ginny Foat, stated that Cathedral City has stood out and she is proud of the work
that has been done. She feels that the Council needs to look at who is going to
represent District 1 and supports the appointment of Shelley Kaplan.
Dale Jag, Cathedral City resident, stated he feels that making the wrong
appointment will divide the city even more and he supports the appointment of
Laura Ahmed or Stan Henry.
Fabiola Alvarez, Cathedral City District 1 resident, stated that she supports the
appointment of someone from District 1 and the appointment of Shelley Kaplan.
Sergio Espericueta, Cathedral City resident, supports the appointment of
someone that resides in District 1.
Michael Hagedorn, Cathedral City resident, stated that the vacant seat should
stay at large and he feels it will be safe to hold a special election.
Rosario Avila, Cathedral City resident, stated that she does not support the
appointment of Shelley Kaplan. She feels the City Council needs someone that
will talk about policies and issues.
Barbie Smart, Cathedral City resident, stated that she would like to be
considered for the vacant seat and thanked the City Council for their
consideration.
Allen Worthy, stated that he supports the appointment of Shelley Kaplan.
Tim Cagney, Cathedral City resident, stated that he is proud to live in Cathedral
City and does not want to lose the progress that the city has made. He supports
the appointment of someone from District 1 and he feels that the majority has
spoken.
Robbie Sherwin, Cathedral City, stated that he supports the appointment of
someone from District 1 and he wants the City Council to choose wisely.
Melinda Shapiro, Cathedral City resident, stated that she supports the
appointment of Stan Henry.
Aron Velarde, did not speak but wanted the record to reflect his support of

appointing Shelley Kaplan.
Bob Warburton, Indio resident, did not speak but wanted the record to reflect his
support of appointing Shelley Kaplan.
Councilmember Ernesto Gutierrez stated that he was honored to have been
elected to serve on the City Council. He stated that running a campaign is very
time consuming and costly and does not feel that it is in the best interest of the
City to hold a Special Election. As a Councilmember, he represents the entire
City, not just his District he was elected to and feels that the City Council will
make the best decision for the entire City.
Councilmember Raymond Gregory, thanked everyone for coming out to the
meeting. He feels that Greg's legacy is very important and he will consider all
comments that have been made this evening. He stated that he strongly agrees
with District representation.
Councilmember Raymond Gregory made a Motion to appoint someone and to
take applications from District one residents only. The Motion died due to a lack
of a second.
Councilmember John Aguilar thanked everyone for coming out and speaking.
He indicated that he wants to make a decision that is right for the entire
community. He is very disappointed with the horrible treatment of potential
appointees and reminded everyone that former Mayor Greg Pettis wanted to see
civility and decorum during his term. He stated that he is not in favor of calling a
special election and he feels that this position is an at-large position, which does
not preclude members from District 1 from being appointed. He stated that the
Council is here to serve regardless of their address.
Mayor Mark Carnevale stated that Stan Henry and Shelley Kaplan are both very
qualified candidates. He stated that the City Council represents all residents in
the community and that the vacant seat is and should be an at-large position. He
does not support a special election.

Motion to approve the following process for filling the vacant seat on the
City Council:
Accept questionnaires from at-large residents that would like to be considered for
appointment to the vacant seat on the Council. The questionnaire will be made
up of the following questions:

1. Why do you want to be on the City Council? How does your background
complement the backgrounds of the existing Councilmembers?
2. How long have you lived in Cathedral City and in what neighborhood do
you currently reside?
3. What will be your top two priorities for action if you become a member of
the City Council?
4. What is your understanding of the role of the City Council in relation to the
roles of the City Manager and staff?
5. How will you handle policy disagreements with other members of the
Council while still maintaining the ability to work together respectfully for the good
of the community?
6. How do you view the diversity of Cathedral City and how will that influence
the positions you take as a member of the City Council.
The questionnaire will require their legal name and address and confirm that they
are at least 18 years of age, a legal citizen and a registered voter of Cathedral
City.
Questionnaires will be available on-line and will need to be submitted to the City
Clerk by the close of business on Tuesday, February 19, 2019.
The appointment process will be in an open meeting on February 27, 2019. The
Council will review and discuss the questionnaires but no interviews will be
conducted.
Those to be considered for the vacant seat will be only those who submit a
questionnaire.
