HomeMy WebLinkAboutOrd 779 ORDINANCE NO. 779 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY, CALIFORNIA, AMENDING SECTIONS 3.25.050, 3.46.050, 11.88.010, 11.88.020 AND 11.64.040 OF THE CATHEDRAL CITY MUNICIPAL CODE PROHIBITING DISCRIMINATION BASED ON GENDER IDENTITY NOW, THEREFORE, the City Council of the City of Cathedral City ordains as follows: SECTION 1. Section 3.25.050, paragraph (C) of the Cathedral City Municipal Code is amended to read as follows: "C. Nondiscrimination. During the hotel's participation in the transient occupancy tax sharing program, the operator covenants and agrees for itself, its successors, assigns or designees, that the hotel and any of its employees shall not discriminate against any person on the basis of sex, gender, gender identity, gender expression, marital status, domestic partnership status, sexual orientation, race, color, religion, ancestry, national origin, or disability." SECTION 2. Section 3.46.050, paragraph (C) of the Cathedral City Municipal Code is amended to read as follows: "C. Nondiscrimination. During the business's participation in the sales tax sharing program, the owner covenants and agrees for itself, its successors, assigns or designees, that the business and any of its employees shall not discriminate against any person on the basis of sex, gender, gender identity, gender expression, marital status, domestic partnership status, sexual orientation, race, color, religion, ancestry, national origin, or disability." SECTION 3. Section 11.88.010 of the Cathedral City Municipal Code is amended to read as follows: "It is hereby declared as the public policy of the city of Cathedral City that it is necessary to protect and safeguard the right and opportunity of all persons to be free from all forms of arbitrary discrimination, including discrimination based upon sex, gender, gender identity, gender expression, marital status, domestic partnership status, sexual orientation, race, color, religion, ancestry, national origin, or disability." SECTION 4. Section 11.88.020 of the Cathedral City Municipal Code is amended to revise the definition of unlawful discriminatory practice to read as follows: "'Unlawful discriminatory practice' means to do any act, or fail to do any act, as described herein, based in whole or in part upon a person's sex, gender, gender identity, gender expression, marital status, domestic partnership status, sexual orientation, race, color, religion, ancestry, national origin, or disability." SECTION 5. Section 11.64.040, paragraph (B) of the Cathedral City Municipal Code is amended to read as follows: "B. Where its application results in or is coupled with an act prohibited by any other provision of law relating to unlawful discrimination against any person on account of sex, gender, gender identity, gender expression, marital status, domestic partnership status, sexual orientation, race, color, religion, ancestry, national origin, or disability;" SECTION 6. The City Council declares that, should any provision, section, paragraph, sentence or word of this ordinance be rendered or declared invalid by any final court action in a court of competent jurisdiction or by reason of any preemptive legislation, the remaining provisions, sections, paragraphs, sentences or words of this Ordinance as hereby adopted shall remain in full force and effect. SECTION 7. This Ordinance shall take effect thirty (30) days after its adoption. SECTION 8. The City clerk shall within 15 days after passage of this Ordinance, cause it to be posted in at least three (3) designated public places; shall certify to the adoption and posting of this Ordinance; and shall cause this Ordinance and its certification, together with proof of posting, to be entered in the Book of Ordinances of this City. The foregoing Ordinance was introduced at the June 8, 2016 City Council Meeting and adopted by the City Council of the City of Cathedral City at its meeting held July 13, 2016, by the following vote: Ayes: Council Members Aguilar, Carnevale and Kaplan; Mayor pro.
