• CALL TO ORDER
Mayor Stan Henry called the Study Session Meeting to order at 4:30 p.m.
• ROLL CALL
Mayor Pro Tern Greg Pettis participated via telecom from the following location: Liaison Capitol Hill Hotel, 415
New Jersey Avenue NW, Washington, DC 20001.

Mayor Henry announced that the City Council will hear Item 2E. after Item 2B.
• STATEMENT OF PARTICIPATION BY THE DEPUTY CITY CLERK
1. PUBLIC COMMENT
Angela Valente Romero, Cathedral City, was called to speak. She stated that she is a business owner on Perez
Road and expressed her concern with marijuana dispensaries and the effect that they will have on the surrounding
businesses on Perez Road.
Peter Taylor, Cathedral City, was called to speak. He indicated that he is also a business owner on Perez Road,
an Art Gallery. He expressed his concern with the effect of marijuana dispensaries being allowed so close to his
business.
Alan Carvalho, Cathedral City, was called to speak. He indicated that he appreciates the local art galleries,
however, he feels that all of the businesses in town need to open their minds and welcome new businesses
including marijuana dispensaries.
2. STUDY SESSION
2.A. 2016-198 Citizen Commendation
Captain Welsh, Cathedral City Fire Department presented a Citizen Commendation to Ms. Diana Corona for her
life saving efforts during an emergency situation.
2.B. 2016-182 Medical Cannabis Taxation
Rebecca Pikus, Cathedral City, was called to speak. She indicated that she is a business owner on Perez Road.
She expressed her concern with marijuana dispensaries being allowed near her art gallery.

Valerie Schechter, Cathedral City, was called to speak. She stated that she is in support of a tax on the
cultivation of marijuana.
Council directed staff to bring back ballot language for discussion at the June 8, 2016, City Council Meeting.
2.C. 2016-189 Golf Carts and Neighborhood Electric Vehicles(NEV's) on City
Streets
Rosario Avila, Cathedral City, was called to speak. She urged the Council to continue the discussion on CVLink
and allowing golf carts and electric vehicles on city streets. She encouraged the City Council to include the
residents in Dream Homes to see what suggestions they may have.
It was the consensus of the City Council for staff to move forward with the preparation of a Golf Cart
Transportation Plan.
2.D. 2016-193 Permitting of Tobacco Retailers
It was the consensus of the City Council to move forward with a Tobacco Retailers Permit Program and to have a
representative from the Department of Environmental Health come to a future meeting to provide a presentation
and answer questions and have staff contact CVAG to get the enitre Valley involved.
2.E. 2016-191 Inclusionary Housing
Gretchen Gutierrez, DVBA, was called to speak. She encouraged the Council to think long and hard before
implementing any policies. She indicated that the DVBA would like to be included in any discussions when it
comes to affordability housing.
It was the direction of the City Council to bring back this item sometime in the summer for further discussion and
requested that staff do research on what tools are available and in use in other jurisdictions, what units are in the
pipeline for the next five years and get information on the DVBA funding model.
2.F. 2016-181 2015/2016 3rd Quarter Budget Review
Tami Scott,Administrative Services Director,presented the 2015/2016 3rd Quarter Budget Review.
3. CLOSED SESSION
City Attorney Eric Vail announced that the City Council will recess to Closed Session to discuss the items listed
on the Agenda.
The City Council recessed to Closed Session at 5:53 p.m.

City Attorney Eric Vail announced that the City Council met in Closed Session to discuss the items listed on the
Agenda. The Council was able to discuss all of the items listed on the agenda and there was no reportable action
taken.

1. PUBLIC COMMENT
Lee Wilson,Jr., Cathedral City, was called to speak. He invited Council to attend the Palm Springs Fallen
Heroes Memorial Dedication that will be held on May 21, 2016 at 9:30 a.m. He also requested that the City do
some type of commendation/proclamation for the mother's of the fallen heroes that will be participating in the
ceremony. He also requested that the City implement a Hometown Hero banner program.

2.D. 2016-194 Second Reading of Ordinance Amending Title 9 Related to Medical
Cannabis Businesses(ZOA 16-002)
Richard Hibbard, Cathedral City, was called to speak. He indicated that he owns property that he is interested in
leasing for the cultivation of marijuana, with the new zoning ordinance,it will no longer be allowed. He has already
leased the building and questioned if some type of variance could be issued.

3. PUBLIC HEARINGS
3.A. 2016-179 Community Development Block Grant(CDBG) FY 2016-2017
Annual Action Plan
John Corella, City Engineer,presented the Staff Report.
Mayor Stanley E. Henry opened the Public Hearing for comments, there being none, he closed the Public Hearing
and returned the discussion to the Council.
A motion was made by Council Member Aguilar,seconded by Council Member Kaplan,to approve the
FY 2016-2017 Annual Action Plan(AAP)for submittal to HUD and authorize the City Manager to execute
the new SF-424 appliction to receive funding.The motion carried by the following vote:

Council Member Aguilar

3.B. 2016-186 Change of Zone No. 16-001 Open Space Residential to Open
Space
Mayor Pro Tern Greg Pettis indicated that he will be recusing himself from this discussion and will mute his
phone.
Mayor Henry indicated that Council received a message to be included in the record from the following:
Nina Hood-She indicated that she is opposed to development on the mountainside and supports the zone
change to Open Space.
Mayor Henry opened the Public Hearing for comments.
Frank Castiglione, Cathedral City, was called to speak. He expressed his concern with development on the
hillside and wants to retain his view of the mountains that he has from his house.
Mayor Henry closed the Public Hearing.
Mayor Henry indicated that he stands behind keeping dispensaries off Palm Canyon. With this zone change a
small portion of Palm Canyon would be allowed to have dispensaries so he does not support this change or would

prefer to make some changes in sections.
Council Member Aguilar,indicated that he is comfortable with the Planning Commissions recommendation.
Council Member Kaplan, also indicated that he is also comfortable with the recommendation of the Planning
Commission.
Council Member Carnevale, stated that he has heard all of the comments that were made with regard to this item
and he too supports the decision of the Planning Commission.
A motion was made by Council Member Kaplan,seconded by Council Member Aguilar,to approve the
associated exemption to the California Environmental Quality Act(CEQA)pursuant to section 15601(b)
(3)of the CEQA Guidelines;and waive further reading,read by title only and introduce the first
reading of an Ordinance adopting Change of Zone No.16-001,excluding the property identified as
APN 687-040-058. The motion carried by the following vote:
Aye: 3- Council Member Kaplan, Council Member Carnevale,and Council Member Aguilar
Nay: 1 - Mayor Henry
Abstain: 1 - Mayor Pro Tem Pettis

4. LEGISLATIVE ACTIONS
4.A. 2016-195 2016 Fireworks Permits
The Council directed Staff to bring a Study Session Item to a future meeting to discuss preference of
organizations that is in the Code related to Fireworks Permits.
A motion was made by Council Member Aguilar,seconded by Council Member Carnevale,to approve
a Resolution to issue the following Six(6)Fireworks Permits for 2016:
Salvery Christian School
St.Louis Church
Desert Elite football Club
Palm Springs Elks Lodge#1905(Located in Cathedral City)
The Band of Cathedral City High School Band Boosters

The motion carried by the following vote:

4.B. 2016-192 Fal IFest
A motion was made by Council Member Kaplan,seconded by Council Member Carnevale,to approve
SUP#16-008 to allow an annual event to be named FallFest in Downtown Cathedral City.The motion

5. COUNCIL REPORTS
Council Member Mark Carnevale, reported that he attended the Oasis Awards. He also attended the SCAG
General Assembly Meeting, the dedication of the X Sculpture at the Library and the Cinco de Mayo Event at the
Senior Center. He attended the Public Safety Meeting where they spoke about tobacco permiting and CERT. He
announced that residents can take old medications to Walmart on the corner of Date Palm an Dinah Shore. He
also attended the League of California Cities Meeting at Spencer's in Palm Springs which was very interesting.
Council Member John Aguilar, reported that he attended the 35th Anniversary celebration at the Boys and Girls
Club. He along with Council Member Carnevale met with City Staff to discuss joining the Desert Recreation
District. They came up with an action plan and he is looking forward to what comes next.
Council Member Shelley Kaplan, stated that as the representative of the Mountains Conservancy Commission he
participated in a bus tour of properties in the Valley that they have been focused on for conservation. He reported
that there is a rally scheduled at the State Capitol with regard to the maintaining of roads. The Cinco de Mayo
was a result of a grant from the Rotary and the Interact Students. There were over 60 people in attendance and
turned out to be a wonderful event. The GloRun and Health Fair was a successful event. Public Arts
Commission DATA Awards will be held at the Mary Pickford Theater at 2:00 p.m. and the Battle of the Badges
will be held in the eventing.
Mayor Pro Tem Greg Pettis, reported that he is in Washington D.C. at a transportation conference. They continue
to move forward. Catheral City High School was able to perform at the Coachella Valley Symphony, they
represented the City well.
Mayor Stan Henry, received a letter complimenting the Cathedral City Police Department and Staff with regard to
an incident with an elderly woman. It is"Mental Health Awareness Month"and he went to the Coachella Valley
Rescue Mission and participated as a judge for an Art Show Competition. There were over 400 art pieces to
judge. He was glad to be a part of the event. He congratulated Chris Parman for being the recipient of the Oasis
Award for Catheral City and congratulated all of the City Staff that have been nominated for the Orion Award. The
Desert Valley Visitors Association Dinner will be held on Thursday and on May 18th the Senior Scholarship
Awards will be held.
6. CLOSED SESSION
City Attorney Eric Vail announced that the City Council met in Closed Session during Study Session and were
able to cover all of the items listed on the Agenda, there was no reportable action taken.
