A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CATHEDRAL CITY, CALIFORNIA AUTHORIZING ACCESS TO
CRIMINAL HISTORY INFORMATION FOR LICENSING PURPOSES
WHEREAS, Penal Code Sections 11105(b)(11) and 13300(b)(11) authorize
cities, counties, districts and joint powers authorities to access state and local summary
criminal history information for employment, licensing or certification purposes; and
WHEREAS, Penal Code Sections 11105(b)(11) and 13300(b)(11) require that
1 1, there be a requirement or exclusion from employment, licensing, or certification based
on specific criminal conduct on the part of the subject of the record; and
WHEREAS, Penal Code Sections 11105(b)(11) and 13300(b)(11) require the
City Council to specifically authorize access to summary criminal history information for
employment, licensing, or certification purposes; and
WHEREAS, the City of Cathedral City has imposed specific requirements
relating to the issuance of specified entitlements required for the operation of a medical
cannabis business within the City which necessitates access to summary criminal
history information in compliance with the above requirements.
NOW, THEREFORE, the City Council of the City of Cathedral City does hereby
resolve that:
1. The above-referenced recitals are true and correct and material to this
Resolution.
2. The City of Cathedral City is hereby authorized to access state summary
criminal history information for licensing or certification purposes related to applications
for medical cannabis and may not disseminate the information to a private entity.
