Henry called the Study Session Meeting to order at 4:30 p.m. • ROLL CALL Present 5- Mayor Stan Henry, Mayor Pro Tern Gregory S. Pettis, Council Member Shelley Kaplan, Council Member Mark Carnevale, and Council Member John Aguilar • AGENDA FINALIZATION Mayor Henry announced that Item 2A. will be rescheduled to the next City Council Study Session Meeting which will be held on Wednesday,April 13, 2016. • STATEMENT OF PARTICIPATION BY THE DEPUTY CITY CLERK 1. PUBLIC COMMENT Allen Worthy, Palm Springs, was called to speak. Expressed his concern with the removal of the Mary Pickford exhibit at the Pickford Theater. 2. STUDY SESSION 2.A. 2016-1.17 Palm Springs International Airport Commission Update from John Haag, Commissioner This item was rescheduled to the April 13, 2016 City Council Study Session Meeting. 2.B. 2016-74 City of Cathedral City Safe and Sane Fireworks Program Fire Chief Paul Wilson gave an overview of the Safe and Sane Fireworks Program. 2.C. 2016-100 Electric Vehicle Charging Stations Tami Scott,Administrative Services Director,presented a proposal from Tesla to partner with the City to install Electric Vehicle Charging Stations in the Civic Center. It was the consensus of the City Council to direct staff to move forward with an agreement with Tesla to install Electric Vehicle Charging Stations in the Civic Center. 2.D. 2016-114 Citywide Directional Sign Concepts Cathedral City Page 1 City Council Study Session STUDY SESSION March 23,2016 Leisa Lukes, Economic Development Manager,presented the preferred design options for Citywide Wayfinding Sign Program. She indicated that the different options will be shared with the City Council and City Commissions for input through the month of March. The consultant will then refine the draft designs that will be considered by the City Council in late spring. Each Council Member provided their preference to Staff. 2.E. 2016-109 Review of Cathedral City Municipal Code Chapter 9.80 "Accessory Structures, Structure Heights,Yards,Walls and Fencing" and Chapter 9.62.040 item G "Window Signs" Pat Milos, Community Development Director,provided an update and review of Chapter 9.80 of the Cathedral City Municipal Code related to Accessory Structures, Structure Heights, Yards, Walls and Fencing and Chapter 9.62.040 Item G 'Window Signs" Valerie Schechter, Cathedral City, was called to speak. She expressed her support to allow for metal fencing materials. Alan Carvalho, Cathedral City, was called to speak. He expressed his appreciation that the Council was being more opened minded and considering allowing new materials for fencing. It was the direction of the Council that Staff prepare amendment to the Ordinance with a specific definition of materials allowed to be used for fencing. The Ordinance will go to the Planning Commission for approval then to the Council for consideration. 3. CLOSED SESSION City Attorney Eric Vail,indicated that he has a Closed Session Item that he would like to add to the Agenda as Item 3D. Conference with Legal Counsel,pursuant to Government Code 54956.9(a)(b4)potential litigation one case: Time Warner Cable. This item came up after the Agenda was posted and requires action prior to the next regularly scheduled meeting. A motion was made by Council Member Carnevale,seconded by Council Member Aguilar,to add Closed Session Item 3D. Conference with Legal Counsel,pursuant to Government Code 54956.9(a) (b4)potential litigation one case: Time Warner Cable. The motion carried by the following vote: Aye: 5- Mayor Henry, Mayor Pro Tern Pettis, Council Member Kaplan, Council Member Carnevale, and Council Member Aguilar City Attorney Eric Vail announced that the City Council will be meeting in Closed Session to discuss the following items listed in the Agenda as well as the following added item: 3D. Conference with Legal Counsel,pursuant to Govemment Code 54956.9(a)(d)(4)Potential Litigation one case: Time Warner Cable. Any item not addressed at this time will be discusssed at the end of the Regular City Council Meeting. He requested that staff look into it and follow-up with him. Sergio Espericueta, Cathedral City, was called to speak. He stated that he does not support giving the City Attorney the authorization to initiate Code Compliance Litigation. Rick Pantele, was called to speak. He expressed his last concern with the proposed Omnibus Cannabis Ordinance. Sonja Marchand, Cathedral City, was called to speak. She expressed her dissatisfaction with the Plastic Bag Ordinance. 2. PUBLIC HEARINGS 3.A. 2016-39 Sales Tax Sharing Agreement with Honda of the Desert Leisa Lukes, Economic Development Manager,presented the Staff Report. Mayor Henry opened the Public Heaing for comments. Sonja Marchand, Cathedral City, was called to speak. She indicated that she does not support this tax sharing agreement. He expressed his concern with portions of the agreement Tyrone Pearson, Cathedral City, was called to speak. He spoke about long term businesses. Mayor Henry closed the Public Hearing. A motion was made by Council Member Carnevale,seconded by Council Member Kaplan,to approve a Resolution making findings and authorizing a Sales Tax Sharing Agreement between the City of Cathedral City and GL HOD,LLC.doing business as Honda of the Desert. The motion carried by the following vote: Aye: 5- Mayor Henry, Mayor Pro Tern Pettis, Council Member Kaplan, Council Member Carnevale,and Council Member Aguilar Enactment No: Reso 2016-12 4. LEGISLATIVE ACTIONS 4.A. 2016-105 Public Arts Commission Recommendation to Use the Former Chamber of Commerce Office Space as a Temporary Public Arts Exhibit Space Rick Pantele, was called to speak. He would like to see the work from the participants at the Boys and Girls Club to be displayed in this space. A motion was made by Council Member Aguilar,seconded by Council Member Carnevale,to allow the Public Arts Commission to use the former Chamber of Commerce Office as a Public Art Exhibit Space and a venue to host art classes on a temporary basis and to work with staff to develop requirements for insurance purposes. Aye: 4- Mayor Henry, Mayor Pro Tern Pettis, Council Member Carnevale, and Council Member Aguilar Abstain: 1 - Council Member Kaplan Enactment No: M.O.6559 4.B. 2016-112 Phase Two of the City's Pavement Management Program (PMP) A motion was made by Council Member Kaplan,seconded by Mayor Pro Tem Pettis,to approve a cooperative purchase order with PetroChem Materials,Inc.(PM!)to supply and apply Rubberized Emulsion Aggregate Slurry(REAS)to designated streets for the first part of the Second Phase of the PMP including traffic control and striping in the amount of$414,900. Authorize the City Manager(or designee)to execute the required contract documents. Approve a fifteen percent(15%)contingency in the amount of$62,234 dollars for unforseeable construction costs and approve$7,000 for staff labor to perform project management,inspection and materials testing. Authorize the City Engineer to request insurance for this project and issue a Notice of Proceed thus making this the first part of the Second Phase of the 2015/2016 PMP expenditure in the amount of$484,135. Mark Carnevale, as a resident of Cathedral City, was called to speak. He indicated that he is opposed to the event and doesn't see the value of the event for the City. Alan Carvalho, Cathedral City, was called to speak. He feels that if there was a way to prove that the event won't disturb the residents they may feel more comfortable with the event. A motion was made by Mayor Pro Tern Pettis,seconded by Council Member Kaplan,to approve SUP #16-005 with conditions met.The motion carried by the following vote: Aye: 4- Mayor Henry, Mayor Pro Tern Pettis, Council Member Kaplan,and Council Member Aguilar Abstain: 1 - Council Member Carnevale Enactment No: M.O.6561 5. COUNCIL REPORTS Council Member Shelley Kaplan, reported that he attended the celebration of life for George Zander. He reminded everyone of the upcoming LGBT Events and encouraged them to attend. Mayor Pro Tem Greg Pettis,reminded everyone that Cathedral City High School is producing Copacabana. He has a block of tickets if anyone is interested. Mayor Stan Henry, reported that he did an interview with Palm Springs Life, he asked Council for three words to describe Cathedral City, they agreed to"Pride and Excellence". He also reported that he met with CVREP representatives. There are a lot of activities coming up this weekend and encouraged everyone to go to Discovercathedralcity.corn. 6. CLOSED SESSION City Attorney Eric Vail announced that the City Council will meet in Closed Session to discuss the items listed on the Agenda that were not completed earlier in Closed Session. He stated that the Council did add a Closed Session Item during Study Session, which is item 6D.
