HomeMy WebLinkAboutOrd 821 ORDINANCE NO. 821 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY CALIFORNIA ADDING CHAPTER 2.31 TO THE CATHEDRAL CITY MUNICIPAL CODE REGARDING HISTORIC PRESERVATION WHEREAS, the City desires to safeguard the heritage of the City of Cathedral City by providing for the protection of historical sites and areas representing significant elements of its history; WHEREAS, the City desires to encourage public knowledge, understanding and appreciation of the City's past; WHEREAS, the City desires to, strengthen the economy of the City by protecting and enhancing the city's attractions to residents, tourists and visitors; and WHEREAS, the City desires to promote the private and public use of historical areas and sites for the education, prosperity and general welfare of the people. THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY DOES ORDAIN AS FOLLOWS: SECTION 1. Addition of Chapter 2.31. A new chapter 2.31 is added to the Cathedral City Municipal Code as set forth in the attached Exhibit A. SECTION 2. CEQA. The City Council hereby finds that this Ordinance is exempt from the California Environmental Quality Act (CEQA) under Section 15061(b)(3) of the State CEQA Guidelines because it can be seen with certainty that this Ordinance does not have the potential to cause a significant effect on the environment. SECTION 3. Effective Date. This Ordinance shall be effective 30 days from and after its final passage. SECTION 4. Severability. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, then such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council of the City of Cathedral City hereby declare they would have adopted this Ordinance, and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that anyone or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional. SECTION 5. Publication. The City clerk is authorized and directed to cause this Ordinance to be published within fifteen (15) days after its passage in a newspaper of general circulation and circulated within the City in accordance with Government Code Section 36933(a) or, to cause this Ordinance to be published in the manner required by law using the alternative summary and pasting procedure authorized under Government Code Section 39633(c). Vail, City Attorney EXHIBIT "A" Sec. 2.31.010 Creation of Cathedral City Historic Preservation Committee There is created an historic preservation committee. The committee shall consist of five (5) members who shall be appointed by the city council, serving without compensation. Sec. 2.31.020 Qualification of members. To be eligible for appointment to the committee, an individual must have demonstrated knowledge and interest in the cultural, socioeconomic, architectural or archaeological history of the area, either through experience, training, education or occupation. Sec. 2.31.030 Term Vacancies. Members of the committee shall be appointed and removed in accordance with and shall be subject to all the provisions of Chapter 2.06 of the Cathedral City Municipal Code, as the chapter now reads, or as it may thereafter be amended from time to time. Consistent with Section 2.06.010(A), two of the initial committee members shall be appointed to serve a two-year term and three of the initial committee members shall be appointed to serve a three-year term so that thereafter the terms are staggered. Sec. 2.31.040 Meetings. Meetings of the committee shall be held as necessary to fulfill its duties at such time and place as shall be fixed by the committee. A majority of the appointed members of the committee shall be considered a quorum for the transaction of business. The committee may establish such rules and regulations as it deems necessary for the conduct of its business. In matters relating to holding and conducting regular and special meetings, the committee shall be bound by the provisions of the Ralph M. Brown Act of the state, as it may be amended, applicable to advisory committees. Sec. 2.31.050 Organization. Designation of a chairperson for the committee shall be governed by Section 2.06.020 of this municipal code. The city manager may appoint an executive secretary and other staff and provide such compensation for their services as may be authorized by the city council. The committee shall be authorized to establish and fix the membership of standing and temporary subcommittees as it may find expedient for the performance of its duties. 2.31.060 Functions, powers and duties. The committee shall review projects for compliance with applicable provisions of the Code related to the preservation of historic resources and shall make recommendations to the City Council and Planning Commission, as appropriate, related to the approval of projects involving historic resources and the adoption of regulations aimed at preserving historic resources.
