Pettis, Council Member Shelley Kaplan, Council Member Mark Carnevale, and Council Member John Aguilar • AGENDA FINALIZATION • STATEMENT OF PARTICIPATION BY THE DEPUTY CITY CLERK 1. PUBLIC COMMENT Allen Worthy, was called to speak. He spoke about having a regional theater in Cathedral City. 2. STUDY SESSION 2.A. 2016-86 Introduction of Curt Wafts, Economic Development Director City Manager Charles McClendon introduced Curt Watts, the newly hired Economic Development Director. Cutts Watts, Economic Development Director,provided some of his personal background information and indicated that he is looking forward to working with the City. 2.B. 2016-84 Funding for Roy's Desert Resource Center Erica Felci, CVAG, was called to speak. She indicated that the last report that they received reported that 42%of the clients that go to Roy's are from Cathedral City. Resident, was called to speak. She indicated that she has utilized Roy's. She feels that the numbers are not accurate and encouraged the City to investigate. She feels that there is a need for additional services. Allen Worthy, was called to speak. Feels that there is a need for homeless services. It was the consensus of the City Council to keep the current funding for Roy's at this time. 2.C. 2016-85 Special Logo for the 35th Anniversary Celebration It was the consensus of the City Council to direct staff to design a simpler logo similar to the alternate choice that was provided. Cathedral City Page 1 Printed on 3/23/2016 City Council Study Session REGULAR MEETING March 9,2016 2.D. 2016-70 Update on Animal Control Services with Riverside County Captain Earl Moss,presented an update on Animal Control Services with Riverside County. It was the direction of the City Council to direct staff to negotiate a multi-year contract with 20 hours a week service with alternate options for additional hours for patrol starting in FY 2017-2018, which will allow time to collect data on the additional hours that are necessary but cost effective. 2.E. 2016-83 Request for Qualifications (RFQ)for the Historic and Cultural Assessment It was the consensus of the City Council to direct Staff to move forward with an Agreement with Kaplan Chen Kaplan to complete a Historic and Cultural Assessment of Cathedral City. 2.F. 2016-87 Draft Medical Cannabis Administrative Rules Erica Vega,Assistant City Attorney, gave an overview of the Draft Medical Cannabis Administrative Rules and the Draft Forms related to the application process. Patrick McMahon, Venice, CA, was called to speak. He thanked the Council for starting off the right way and is looking forward to doing business in Cathedral City and offered any help they can offer with the experience they have. Steve Rosenberg, Palm Springs, was called to speak. He stated that he believed the application process and CUP were going to handled seperately and expressed his concern. He also expressed his concern with having to provide a list of employees early on, he feels that it may be premature, he also expressed his opinion regarding having to provide a surveyed map. He feels that the six month reexamination time be pushed back to a year. It was the consensus of the City Council that language be clarified in the Administrative Rules as to what can be changed on an applciation and when. 3. CLOSED SESSION City Attorney Eric Vail announced that the City Council will be meeting in Closed Session to discuss the following items listed on the Agenda. Any item not addressed at this time will be discussed at the end of the Regular City Council Meeting. The City Council recessed to Closed Session at 6:08 p.m. 3.A. 2016-94 Conference with Legal Counsel - Anticipated Litigation Significant exposure to litigation pursuant to paragraphs (d)(2) and (e)(1) of the Government Code. PUBLIC COMMENT Tom Ward, Thousand Palms, was called to speak. He expressed his concern with a potential overlay of Open Space on APN 680-380-011 and requested that Staff look into it. Karen Panico Willis, Cathedral City, was called to speak. She requested that consideration be made when setting up the rules for medical cannabis that no smoking areas be included,just as tobacco is. 2. CONSENT AGENDA Approval of the Consent Agenda A motion was made by Council Member Aguilar,seconded by Council Member Kaplan,to approve the following Consent Agenda Items with the amendment to Section 12 in the Contract with Barrister Professional Serives,LLC.to include"sexual orientation or gender identity". Enactment No: M.O.6551 3. PUBLIC HEARINGS 4. LEGISLATIVE ACTIONS 4.A. 2016-95 Omnibus Cannabis Ordinance Rick Pantele, Rancho Mirage, was called to speak. He expressed his condolences for the loss of Mayor Pro Tern Pettis'father. He commended the City on all of the hard work they have done on the Medical Cannabis Ordinance. He feels there should be local preference given, he supports having a Task Force, close the illegal facilities, have a review in a year to see if there needs to be changes, and requested support of the Council to oppose SB 987. Karen Panico-Willis, Cathedral City, was called to speak. She questioned if the sames rules will apply to medical marijuana as tobacco. A motion was made by Council Member Kaplan,seconded by Council Member Carnevale,to introduce and approve the first reading of an Ordinance of the City Council of Cathedral City, California,Amending Title 3,Title 5 and Title 13 of the Cathedral City Municipal Code Relating to Medical Canabis Businesses with the amendment to Section 5.88.140 Cathedral City Medical Cannabis Commission to Medical Cannabis Task Force. The motion carried by the following vote: Aye: 5- Mayor Henry, Mayor Pro Tern Pettis, Council Member Kaplan, Council Member Carnevale, and Council Member Aguilar Enactment No: M.O.6552 4.B. 2016-71 Crime Statistics Update and Authorization to Establish a Crime Analyst Position A motion was made by Council Member Carnevale,seconded by Council Member Kaplan,to authorize an increase in the Police Department staffing to add a full-time Crime Analyst position to be partially funded by the State of California Post Release Accountability and Compliance Team(PACT) in the amount of$50,000 for FY 2015/2016 and$50,000 for FY 2016/2017 for a total of$100,000 and allocate the remaining funds from the reserve fund.The motion carried by the following vote: Aye: 5- Mayor Henry, Mayor Pro Tern Pettis, Council Member Kaplan, Council Member Carnevale, and Council Member Aguilar 4.C. 2016-79 Creation of an Enterprise Applications Engineer for the MIS Department. A motion was made by Council Member Kaplan,seconded by Council Member Aguilar,to approve an increase to the authorize staffing in the MIS Department on one position in lieu of a Permit Specialist and authorize staff to recruit an Enterprise Applications Engineer. COUNCIL REPORTS Council Member John Aguilar, reported that a Financial Expo for Latino businesses will be held on April 21, from 6 to 8 p.m. at Spotlight Casino. He also reported that there is a new auto detailer in town and welcomed them to Cathedral City. Council Member Shelley Kaplan, announced that the giant potato is visiting the City. He reported that he attended the Riverside County State of Education address and participated in a bowling fundraiser for Senior Advocates of the Desert. He reminded everyone that Throwback Thursday will be held this week. He announced that he and Council Member John Aguilar will be hosting City Hall at your corner at the Fire Station and that the Date Palm Country Club will be holding a Pancake Breakfast on Saturday for Citizen's on Patrol. The Children's Art Party will also be held on Saturday. Council Member Mark Carnevale, reported that a Cathedral City Police Department Retire Lt. and long time resident, Ray Griffith,passed away. Services will be held at Foreset Lawn on Saturday. He thanked the Commissioners who attended the Planning Commission Academy. He also reported that he attended the Riverside County State of Education address with Council Member Kaplan. He announced that the State of the City,hosted by the Cathedral City Chamber of Commerce will be held on Thursday March 10, 2016. Mayor Stan Henry,reported that Forest Lawn will host an Easter Sunrise Service. He and the City Manager attended an event at Cal State SB to hear about their Strategic Plan. He announced the Dam and Line 43 Dedication will be held March 10, 2016 at 9:00 a.m. and the State of the City will be held at 11:30 a.m. He reported that on Saturday the Relay for Life will be at Cathedral City High School and the Heart to Heart luncheon will also be held. 6. CLOSED SESSION City Attorney Eric Vail announced that the City Council will meet in Closed Session to discuss the remaining items listed on the Agenda.
