HSA 2016 - 01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY, CALIFORNIA, AS THE GOVERNING BODY OF THE HOUSING SUCCESSOR AGENCY TO THE FORMER REDEVELOPMENT AGENCY, APPROVING THE TRANSFER OF TWO PARCELS OF LAND TO THE CITY AND ACCEPTING IN EXCHANGE TEN PARCELS OF CITY-OWNED LAND FROM THE CITY WHEREAS, the City owns ten (10) parcels of vacant land located on Landau Boulevard between Vega Road and Elizabeth Road (APNs: 678-060-001 through 005 and 678-060-049 through 053) originally intended to be developed as a park (the "City Parcels"). The City Parcels are described more particularly in Exhibit "A" hereto; and WHEREAS, the Housing Successor Agency owns two (2) parcels of vacant land on San Diego Drive in the Dream Homes neighborhood (APNs 677-332-003 and 677- 410-009) that was intended for an affordable housing development (the "Housing Successor Agency Parcels"). The Housing Successor Agency Parcels are described more particularly in Exhibit "B" hereto; and WHEREAS, the developer that intended to build the affordable housing development on the Housing Successor Agency Parcels has terminated its agreement with the Housing Successor Agency and there are no current plans for the construction of affordable housing on these parcels; and WHEREAS, the Dream Homes neighborhood is in need of a park due to the expansion of the Agua Caliente School, which has eliminated the joint use park that was serving the Dream Homes neighborhood; and WHEREAS, the City Council desires to transfer the Housing Successor Agency Parcels to the City in exchange for the City Parcels to allow for the future construction of a park in the Dream Homes neighborhood on the Housing Successor Agency parcels and affordable housing on the City Parcels. NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS: A. CEQA. The City Council hereby finds that it can be seen with certainty that there is no possibility that the approval of this transaction may have a significant effect on the environment. The trade in ownership of the City Parcels and Housing Successor Agency Parcels does not authorize construction and will not result in a direct or indirect physical change in the environment. Prior to commencement of any development on the parcels, all necessary review required by the California Environmental Quality Act ("CEQA") shall be completed. The adoption of this Resolution and the changes in ownership of the parcels is therefore exempt from the environmental review requirements of CEQA pursuant to Section 15061(b) (3) of Title 14 of the California Code of Regulations. Staff is hereby directed to file a Notice of Exemption with the County Clerk within five days of the adoption of this Resolution pursuant to Section 15062 of Title 14 of the California Code of Regulations. B. Public Purposes. The City Parcels and Housing Successor Agency Parcels are of equivalent value and the transfer of ownership of those parcels furthers the public purpose of providing affordable housing and parks within the City. C. Disposition of Housing Successor Agency Parcels. The City Council, as the governing body of the Housing Successor Agency, hereby approves the transfer of the Housing Successor Agency Parcels to the City and authorizes and directs the General Manager of the Housing Successor Agency to do any and all things and to execute and deliver, and if appropriate, record, any and all documents which he may deem necessary or advisable in order to effectuate the transfer of the Housing Successor Agency Parcels to the City. D. Acceptance of City Parcels. The City Council, as the governing body of the Housing Successor Agency, hereby accepts the transfer of the City Parcels to the Housing Successor Agency and authorizes and directs the General Manager to do any and all things and to execute and deliver, and if appropriate, record, any and all documents which he may deem necessary or advisable in order to effectuate the transfer of the City Parcels to the Housing Successor Agency.
