• CALL TO ORDER
Mayor Stan Henry called the Study Session Meeting of August 29, 2018 to order at 4:35 P.M.

1. PUBLIC COMMENT
Eugene Warnecke, Cathedral City, was called to speak. He requested that the City Council endorse Proposition
10.
Chip Yarborough, Cathedral City, was called to speak. He stated that he recently heard that the Police
Department hired a Lead Dispatcher position,he strongly feels that it should be a manager position. He
expressed his concern that the Emergency Medical Dispatch is not provided in the City and he feels that it is
something that should be provided.
Bethany Ballard, Cathedral City, was called to speak. Expressed her concerns with the Convention on the Rights
of the Child.
2. STUDY SESSION
2.A. 2018-335 Cathedral City Community Coalition Update
Leisa Lukes, Business Development Manager, introduced the members of the Cathedral City Coalition
Committee.
Josie Diaz and Fabiola Alvarez provided an update on the efforts of the Coalition and their accomplishments to
date.
2.13. 2018-326 Committee and Commission Policy Manual and Code of-Ethics
City Manager, Charles McClendon,presented the Committee and Commission Policy Manual and Code of Ethics
that was prepared by staff.
Ernesto Gutierrez, Cathedral City, was called to speak. He stated that he has been personally attacked by a
Commissioner on social media. He believes that Commissioners should be held to higher code of conduct and

would like to see additional amendments to the Policy.
Chip Yarborough, Cathedral City, was called to speak. He feels that it is a good idea to have a policy in place.
He questioned what would happen if a Commissioner does not follow the policy.
Bethany Ballard, Cathedral City, was called to speak. She stated that social media has prevented people from
getting involved. She feels that those in public service should adhere to a higher standard and show courtesy.
Dale Jag, Cathedral City, was called to speak. He stated that even though Commissioners are required to take
ethics classes,he feels that they are useless. A Commissioner is always a representative of the City and should
act accordingly.
Rosario Avila, Cathedral City, was called to speak. Stated that she would like to hear the comments from the
Council prior to her giving her comments. She questioned how to file a complaint with regard to a commissioner
and who will determine if there has been a violation. She feels that there needs to be something added for
violations and enforcement.
Mayor Stan Henry stated that the City is limited on the ability to enforce social media for a personal site. He also
stated that just because you are a staff member or a commissioner does not mean that you give up your right to
freedom of speech.
Councilmember Shelley Kaplan stated that social media is not an official site of the City, there is a lot of
misinformation, lies, etc. He stated that individuals should contact him directly by email or by a phone call.
The following changes will be made to the Policy based on comments made by the City Council:
Both the Policy Manual and Code of Ethics must be acknowledged and signed.
Ethics Training shall be completed within 60 days of appointment.
Clarification language added to the Manual related to social media.
Members of ad-hoc committees and task forces shall also adhere to the established policies.
Staff was directed to do periodic reporting to the Council on the training of the commissionsers and committee
members.
2.C. 2018-328 Council Travel Policy
City Manager Charles McClendon stated that the Travel Policy is being presented for Council to discuss and
make revisions as desired.
It was the consensus of the City Council to have Mayor Henry, Councilmember Kaplan, City Manager McClendon
and Administrative Services Director Scott work on the policy and bring it back to the City Council for approval.
2.1). 2018-329 Resolutions -League of California Cities Conference
It was the consensus of the City Council that the voting delegate for the annual League of California Cities
Conference support the Resolutions that will be considered.
2.E. 2018-327 Convention on the Rights of the Child
Bethany Ballard, Cathedral City, was called to speak. She stated that she doesn't feel the City needs to do this.
She feels that the rights of the Child will take away rights of the parents and could cause more problems for the
City.
Alan Carvalho, Cathedral City, was called to speak. He supports a referendum and encouraged the support of fair
human conditions for everyone.

It was the consensus of the City Council to prepare a Resolution supporting the principals of the Covention on the
Rights of the Child and bring it back to the Council for consideration.
3. CLOSED SESSION
Eric Vail announced that the City Council will meet in Closed Session to discuss the following items listed on the
Agenda.
3.A. 2018-333 Conference with Real Property Negotiator Pursuant to Government
Code Section 54956.8.
Property Location: Approximately 2 acres at the southeast corner of
West Buddy Rogers and East Palm Canyon Drive.
Negotiating Parties: City of Cathedral City as the Housing Successor
Agency to the former Redevelopment Agency, and CCD,LLC
Property Owner: City of Cathedral City as the Housing Successor
Agency to the Former Redevelopment Agency
Under Negotiations: Price and Terms for potential sale of real property.
The City Council adjourned to Closed Session at 6:02 p.m.
ADJOURN
The City Council reconvened at 6.30 p.m.
City Attorney Eric Vail announced that the City Council met in Closed Session to discuss property negotiations at
the following location:
Approximately 2 acres at the southeast corner of West Buddy Rogers and East Palm Canyon Drive.
There was no reportable action taken.

Mayor Stan Henry called the Special Meeting of August 29, 2018 to order at 6:35 p.m.
• PLEDGE OF ALLEGIANCE
Council Member John Aguilar led the Pledge of Allegiance.
• INVOCATION (MOMENT OF REFLECTION)
Council Member Mark Carnevale offered the Invocation. He mentioned that Jenny Ash, lost her battle with cancer
and announced the services that are planned for her.

1. PUBLIC COMMENT
David Peters, Cathedral City, was called to speak. He stated that grass is growing in the cracks in the streets
and expressed his dissatifaction. He commented that when individuals call from city hall you don't know who it is.
He feels that the Go Request App should have emergency contact information. He also stated that he does not
like the safety wall that was built in the lobby of City Hall.
Brad Anderson, Rancho Mirage, was called to speak. He stated that it would be nice to have emergency phone
numbers posted somewhere at City Hall. He stated that phone numbers would be nice to have. He stated that
the Coachella Valley Mosquito and Vector Control District has found another species of mosquitos. He urged
everyone to get rid of standing water to help create a safer environment. He stated that Vector Control has
allowed the west nile virus issue go on for far too long due to what he believes to be from poor performance of the
district.
2. COUNCIL REPORTS
Council Member John Aguilar reported that he attended the Dream Homes Community Forum, which was really
well attended and productive. He thanked everyone involved for doing an outstanidng job.
Council Member Shelley Kaplan signed the Bill making Desert Memorial as the State LGBTQ Memorial. He
attended the badge presentation for the Fire Department he expressed his satisfaction with the Fire Department.

He was able to attend the Motivation Program for the students at the Nellie Coffman Middle School,he felt that it
was a great program for the students.
Council Member Mark Carnevale stated that he will be attending the SB One press conference at 10:30 tomorrow.
He provided kuddos to Officer Hodge, again, for all of his work on the homelessness issue. He also talked about
the 90 days of summer program that CRVM, a west side state of the art shelter and a meeting with Supervisor
Perez for assistance with funding.
Mayor Pro Tem Greg Pettis reported that he attended the Mobile Source Air Pollution Reduction Committee
meeting, he intended that the traditional funding for grants has eneded for this fiscal year, however, there is still
money available for charging stations. He stated that those in the Dream Homes neighborhood are having issues
with Animal Control. He also requested that the Fire Chief look into the tamarisk trees on the north side of the
freeway, it is a fire hazard and a place for the homeless to go.
Mayor Stan Henry talked about the long term initiative with the Health Care District related to the Dream Homes
Meeting that was encouraged by their goals and is looking for success in the near future.

A motion was made by Mayor Pro Tem Pettis,seconded by Council Member Kaplan,to approve the
following Consent Agenda Items.The motion carried by the following vote:

Recommendation: Approve the City Council Minutes of June 13, 2018.

3.13. 2018-325 Annual Virgin de Guadalupe Procession 2018
Recommendation: Staff recommends the City Council approve Special Use Permit#18-022.

3.C. 2018-330 Fountain of Life Soft Surface Replacement
Recommendation: Staff recommends the City Council authorize replacement of the soft
surface material located in Town Square at the Fountain of Life in an
amount not to exceed $59,013.

3.D. 2018-336 Resolution in Support of Proposition 1
Recommendation: Staff recommends the City Council approve a Resolution Supporting

Proposition 1, the Veterans and Affordable Housing Act, on the November
6, 2018 Statewide Ballot.
This item was approved.

5.A. 2018-334 Public Arts Commission Recommendation to Purchase the
Sculpture "PROTECTOR" in an Amount not to Exceed $32,000
Recommendation: Staff recommends the City Council approve the recommendation of the
Public Arts Commission to purchase the 2/3 size sculpture "Protector" from
Brodin Studios honoring fallen heroes in an amount not to exceed $32,000.
Councilmember John Aguilar stated that he would donate$1,000 to the project.
Richard Altman stated that he would donate$1,500 to the project.
A motion was made by Council Member Carnevale,seconded by Council Member Kaplan,to approve
the recommendation of the Public Arts Commission to purchase the 213 size sculpture"Protector"from
Brodin Studios honoring fallen heroes in an amount not to exceed$32,000. The motion carried by the
following vote:

5.B. 2018-324 Annual Agnes Pelton Society's Historic Home, Block Party &Art
Fest
Recommendation: Staff recommends the City Council approve SUP#18-021 with conditions.
Dale Jag, Cathedral City, was called to speak. He expressed his concern with the conduct of Mr. Den on social
media and feels that he shouldn't be around children. He stated that Agnes Pelton was not this type of person
and urged the Council not to fund the event.
A motion was made by Council Member Aguilar,seconded by Mayor Pro Tem Pettis,to approve
Special Use Permit#18-021 with conditions and to sponsor the event in the amount of$2,800 and to
waive the$300 special use permit application fee. The motion carried by the following vote:
Aye: 4- Mayor Pro Tem Pettis, Council Member Kaplan, Council Member Carnevale, and Council
Member Aguilar
Nay: 1 - Mayor Henry

5.C. 2018-331 Monthly Children's Art Party
Recommendation: Staff recommends the City Council approve SUP#18-020.
A motion was made by Council Member Kaplan,seconded by Mayor Pro Tem Pettis,to approve
Special Use Permit#18-020 for the Monthly Children's Art Party and approve funding in the amount of

$1,200 and waive the$300 Special Use Permit fee. The motion carried by the following vote:

5.D. 2018-332 Ordinance Banning Plastic Straws
Recommendation: Staff recommends the City Council introduce and provide first reading, by
title only, to an ordinance banning plastic straws from distribution by
restaurants in Cathedral City.
Dick Shalhoub, owner of McDonalds, was called to speak. He encouraged the City Council to hold off on the ban
of plastic straws until there are better paper straws available.
Terry Applegate, Cathedral City, was called to speak. She urged the Council to do more research on this topic.
She stated that there are many people with disabilities that rely on straws. She encouraged the City Council to
talk to those individuals prior to making a decision to ban straws.
Brad Anderson, Rancho Mirage, was called to speak. Spoke in opposition of banning plastic straws.
Rosario Avila, Cathedral City, was called to speak. Spoke in opposition of banning plastic straws.

A motion was made by Mayor Pro Tem Pettis,seconded by Council Member Aguilar,to table this item
until November 14,2018 and to create a Council sub-committee with Mayor Pro Tem Pettis and
Council Member Carnevale to speak with the owners of McDonalds,Carl's Jr.,Circle K and someon
representing those with disabilities. The motion carried by the following vote:
