Pettis,Council Member Shelley Kaplan, Council Member Mark Carnevale, and Council Member John Aguilar • AGENDA FINALIZATION • STATEMENT OF PARTICIPATION BY THE DEPUTY CITY CLERK 1. PUBLIC COMMENT 2. STUDY SESSION 2.A. 2017-192 Regulation of Signage Advertising Cannabis Erica Vega, Deputy City Attorney,provided information to the City Council regarding regulating cannabis advertising on billboards. It was the consensus of the City Council to create a sub-committee, Mayor Pro Tem Pettis and Council Member Aguilar will represent the Council on the sub-committee, to conduct a comprehensive sign study. They also directed the City Attorneys office to draft a set of regulations related to billboards and on-site signs to address the issues that have been raised. The Medical Cannabis Task Force will review the regulations and make recommendations to the City Council. They City Attorney's office will also do an analysis of bills related to billboards so that letters of support may be drafted. 2.B. 2017-167 Discussion on the Proposed Formation of an Underground Utility District John Corella, City Engineer, gave an update on the Ramon Road Bridge Widening Project and the proposed Underground Utility District, SCE, and Rule 20(A)Funding. 2.C. 2017-184 Local Government Immigration Enforcement Charles McClendon, City Manager, stated that this topic was discussed at the beginning of the year and at the direction of the City Council, staff prepared a statement affirming the City's Statement on Community Inclusiveness. Wth the recent Executive Order, members of the community have requested that the City re-look at their position on becoming a formal sanctuary city. Council Member Kaplan has requested that this topic be brought back to the City Council for discussion and to clarify the City's position with regard to immigration Cathedral City Page 1 City Council Study Session STUDY SESSION May 10,2017 enforcement. Becki Robinson, Cathedral City, was called to speak. She stated that she lives in Cimmeron Cove. She expressed her concern for the children and feels that the residents need to feel safe. She supports being a formal sanctuary city. Lynne ONeil, Cathedral City, was called to speak. She feels that becoming a formal sanctuary city is legally necessary and supports it. Fabiola Alvarez, Cathedral City, was called to speak. She supports Cathedral City becoming a formal sanctuary City. Rev Luis Guido, Cathedral City, was called to speak. He encouraged the City Council to make the best decision for the community. He expressed his concern with the children in the community living in fear. Valerie Schechter, Cathedral City, was called to speak. She thanked Council Member Kaplan for bringing this item forward. She stated that she agrees with what has been said this evening and encouraged the City to take the extra step and provide the information on the basic rights that everyone has to the community. Celia Garcia Cruz, Cathedral City, was called to speak. She supports Cathedral City becoming a formal sanctuary city. Steve Conklin, teacher at Cathedral City High School, was called to speak. He feels that everyone should feel safe and secure in their community and supports becoming a sanctuary city. Cyndie Swauger, Cathedral City, was called to speak. Stated that she supports becoming a formal sanctuary City. Lynn Conklin, Cathedral City, was called to speak. She stated that she is a special education/special needs teacher. She would like to see Cathedral City lead the way in the Valley to be a formal sanctuary city. Ellen O'Rourke, Cathedral City, was called to speak. She stated that she would like the City to be declared a sanctuary city. Carlos Pineda, was called to speak. He stated that he is speaking on behalf of a lot of people who won't come out and speak because they are in fear. He encouraged the City Council to declare Cathedral City a sanctuary City. Edward Holzhauer, Cathedral City, was called to speak. Encouraged the Council to make a commitment to protect all citizens whether illegal and undocumented. He supports becoming a sanctuary city. David Martin, ICUC, was called to speak. Would like to see Cathedral City move forward and become a sanctuary city. He stated that Coachella Valley does not have a sanctuary city and Cathedral City can be the first in Desert to stand out. Karen Borja, ICUC, was called to speak. She indicated that ICUC has a strong relationship with the City and expressed their support of Cathedral City declaring itself a sanctuary city by resolution. Carmen Giuter was called to speak. She expressed her support for Cathedral City becoming a sanctuary city. Terry Applegate, Cathedral City, was called to speak. She presented the benefits of becoming a sanctuary city from a healthcare perspective. She supports Cathedral City becoming a sanctuary city. Maribel Zermeno, Cathedral City, was called to speak. She supports Cathedral City becoming a sanctuary city. Cathedral City Page 2 City Council Study Session STUDY SESSION May 10,2017 Josie Diaz, Cathedral City, was called to speak. She expressed her pride for her community and the Council for their efforts. She expressed her support for Cathedral City becoming a sanctuary city. Elisa Clayton, Cathedral City, was called to speak. She would like the Council to declare Cathedral City a sanctuary city. Bob Mueler, Rancho Mirage, was called to speak. He stated that he has taken a personal interest in this topic. He supports Cathedral City taking the lead in the Coachella Valley and declare itself a sanctuary city. Fran Muselar, was called to speak. She supports Cathedral City becoming a sanctuary city. She feels that it is a moral issue and that no one should live in fear. Alan Carvalho, Cathedral City, was called to speak. He is excited about the pride in the City. He is supportive of Cathedral City becoming a sanctuary city. Itzel Aguilar, stated that she is a DACA recipient. She urges the City to become a sanctuary city. She has fear that members of her family will be deported and becoming a sanctuary city will be a huge step forward. Marlene Aguilar, was called to speak she has a fear of her parents being deported and asked that the Council declare Cathedral City a sanctuary city. Council Member Shelley Kaplan, expressed his appreciation for all of those who came out to speak. Clearly it is a very emotional issue. He feels that the City needs to step up and take a stand and declare ourselves a sanctuary city. He requested that the City Council establish a policy for the Council to vote on. Mayor Pro Tem Greg Pettis, supports Cathedral City becoming a sanctuary city. Council Member Mark Carnevale, expressed his support of becoming a sanctuary city. Council Member John Aguilar, stated that there is a growing sense of fear and is supportive of becoming a sanctuary city. Mayor Stan Henry, stated that he has spent his whole adult life protecting peoples rights. He applauds the Police Department for listening to the community and for protecting the rights of the people. Council directed staff to draft a Resolution declaring Cathedral City a sanctuary city for the next City Council Meeting and to bring forward a recommendation on how to get the word out. 3. PUBLIC COMMENT Ernesto Gutierrez, Cathedral City, was called to speak. He stated that item 3A./6A. under Closed Session doesn't appear to have the correct APN Number listed on the Agenda. He stated that properties for sale or have been sold are not and have not been listed on the MLS. He indicated that as a real estate broker he would like to have the opportunity to buy or list the properties and they are being sold less than market value. Rosario Avila, Cathedral City, was called to speak. She stated that there are audio complaints and can be difficult to hear some of the Council Members on tv as well as during the Public Arts Commission Meetings. She also requested that the doors be unlocked to the stairway. Denise Cross, Cathedral City, was called to speak. She stated that the audio and video for the council chambers needs to be adjusted. 2. Enactment No: Ord 794 3. PUBLIC HEARINGS 3.A. 2017-187 Approve the CDBG Five-Year Consolidated Plan and first year pp Y Annual Action Plan for submittal to U.S. Department of Housing and Urban Development(HUD) Rosario Avila, Cathedral City, was called to speak. She indicated that she was approached to participate in a survey by a consultant from the Ramsey Group. She was happy that she was asked to participate,however, disappointed in the material she was asked to participate in. A motion was made by Mayor Pro Tem Pettis,seconded by Council Member Kaplan,to continue this item to a date uncertain. LEGISLATIVE ACTIONS 4.A. 2017-181 Resolution Adopting an Amended Public Hearing Schedule for Potential Council Election Districts Denise Cross, Cathedral City, was called to speak. She stated that there are some issues with the website with regard to the district maps and requested that the site be updated on a regular basis. A motion was made by Council Member Kaplan,seconded by Council Member Aguilar,to adopt an amended Public Hearing Schedule for potential council election districts with the following changes: June 9,2017 will be the deadline for map submittal June 7,2017 City Hall at your corner will be discussion on redistricting as opposed to district maps. The motion carried by the following vote: Aye: 5- Mayor Henry, Mayor Pro Tem Pettis, Council Member Kaplan, Council Member Carnevale, and Council Member Aguilar Enactment No: Reso 2017-16 2017-178 4.B. Adopting Resolutions for the Biennial Budget p 9 9 Rosario Avila, Cathedral City, was called to speak. She expressed her concern with the fact that this item was not on the Study Session instead it is on the Regular Meeting for approval. A Resolution by the Board of the Cathedral City Public Financing Authority Approving a Budget for the Fiscal Years 2017-18 and 2018-19. A Resolution by the Successor Agency to the Cathedral City Redevelopment Agency Approving a Budget for the Fiscal Years 2017-18 and 2018-19. COUNCIL REPORTS Councilmember Shelley Kaplan,reported that Communications and Events Manager Chris Parman is recording Council Comments during the meetings and will be placing those videos on-line soon. There will be a free homebuyers workshop held at the Cathedral City Library on Saturday,hosted by Wells Fargo. He stated that there was tremendous turnout from residents during the Study Session Meeting with regard to becoming a Sanctuary City. A Resolution will be coming to the City Council for consideration at the next meeting as a result of that discussion. Councilmember Mark Carnevale, reported that he attended a Commercial Brokerage Breakfast, which was successful and commended staff for their efforts. He attended the Staybridge grand opening. He attended a Small Business Expo that was put on by Assemblyman Garcia. He wished all the mothers a Happy Mother's Day. Mayor Pro Tem Greg Pettis,reported on future events that will be coming up. Mayor Stan Henry, reported that he attended the SCAG conference in Palm Desert He also reported that the Agua Caliente Band of Cahuilla Indians will be speaking at the Desert Valley Builders Association on their future development. He also attended the League of California Cities Division Meeting. The Oasis Awards was held at Cathedral City Page 4 Printed on 1112112018 City Council REGULAR MEETING May 10,2017 the Double Tree Hotel, which was a nice event. He, along with Councilmember Kaplan, attended a memorial service for Pat Murphy. He announced that he will be adjourning the meeting in memory of Pat Murphy. 6. CLOSED SESSION Eric Vail, City Attorney stated that the City Council will meet in Closed Session to discuss the following items listed on the Agenda.
