HomeMy WebLinkAboutCC Reso 2018-32 RESOLUTION NO. 2018-32 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY, CALIFORNIA, APPROVING TAX ROLL BILLING, THE NEW ADJUSTED RATE SCHEDULE OF FEES FOR RESIDENT, COMMERCIAL,AND ROLL-OFF, FOR THE COLLECTION, RECYCLING, AND DISPOSAL OF MUNICIPAL SOLID WASTE AND RESIDENTIAL COMMERCIAL RECYCLING WHEREAS, in June 2015, the City approved an Amended Franchise Agreement with Burrtec Waste and Recycling, LLC, extending the Franchise Agreement to May 31, 2023, for the provision of solid waste collection and residential and commercial recycling services to residents and businesses within Cathedral City and approved the Agreement at its meeting of May 28, 2015; and WHEREAS, pursuant to Article 6, Section 6.3 of the Franchise Agreement, Burrtec is eligible each year for a rate increase based on the Consumer Price Index (CPI)for the Los Angeles-Riverside-Orange County Area; and WHEREAS, the change in the CPI for 12 months ending January 2017 was 2.11%; and WHEREAS, on May 22, 2018, the Riverside County Board of Supervisors approved an Edom Hill gate fee increase of 3.46%. The disposal rate will increase from $45.96 to $ 47.55er ton effective Jul 1, 2018; and P Y WHEREAS, the new solid waste collection service rates, that take into account the CPI adjustment and increased disposal rate approved by the Riverside County Board of Supervisors, are set forth in Exhibit A to this Resolution; and WHEREAS, California Health and Safety Code Sections 5473 et. seq. authorizes the City to adopt a resolution by two-thirds of the members of the City Council to collect solid waste rates on the tax roll, in the same manner and at the same time as the general taxes; and WHEREAS, Section 6.04.030 of the City of Cathedral City Municipal Code provides that "the city may cause the collection of the fees or charges for such services, from the owner(s) of property served, by means of collection on the tax roll in the manner prescribed by applicable provisions of the Health and Safety Code and of the Government Code"; and WHEREAS, in accordance with Health and Safety Code Section 5473, the City has prepared a written report, attached hereto as Exhibit B and on file with the City Clerk, which contains a description of each parcel of real property receiving solid waste collection services and the amount of the charge for each parcel for the 2018-2018 tax year. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City Of Cathedral City, California, as follows: SECTION 1: The above recitals are true and correct. SECTION 2: The revised solid waste collection service rates, as reflected in Exhibit A to this Resolution, are approved and adopted, and will be considered to be effective as of July 1, 2018. SECTION 3: The City approves the collection of the solid waste collection services rates via the tax roll in the same manner and at the same time as the general taxes. The report attached hereto as Exhibit B, which contains a description of each parcel of real property receiving solid waste collection services and the amount of the charge for each parcel for the 2018-2018 tax year, shall remain on file with the City Clerk.
