A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CATHEDRAL CITY, CALIFORNIA, AUTHORIZING THE
RESTORATION OF ABUTTERS RIGHTS OF ACCESS TO
RAMON ROAD OVER PORTIONS OF THE RAMON ROAD
FRONTAGE OF PARCELS 1 AND 3 OF PARCEL MAP NO.
31261, LOCATED ON THE SOUTH SIDE OF RAMON ROAD,
OPPOSITE EL TORO ROAD (CONDITIONAL USE PERMIT
CUP 2016-013) (APN 673-020-039, 041, 043)
WHEREAS, abutters rights of access to Ramon Road were offered for dedication to
the City along the frontages of Parcels 1 and 3 of Parcel Map No. 31261, as shown on the
map filed in Book 220 of Parcel Maps, at Pages 27 through 29, inclusive, Records of
Riverside County, California; and
WHEREAS,the current owners of said Parcels 1 and 3 have requested that portions
of said abutters rights be restored for the purpose of relocating and widening driveways
onto Ramon Road in conjunction with the development of a commercial site under
Conditional Use Permit CUP 2016-013; and
WHEREAS, it is in the best public interest to provide convenient driveway locations
for the proposed development and to facilitate safe and proper traffic movement into and
out of the development to and from Ramon Road.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Cathedral City as follows:
SECTION 1. AUTHORIZATION: The City Council finds and determines that:
a. The development under Conditional Use permit CUP 2016-013 is hereby permitted
and authorized to develop and use driveways on the Ramon Road frontages of Parcels 1
and 3 of Parcel Map No. 31261, as per map thereof filed in Book 220 of Parcel Maps, at
Pages 27 through 29, inclusive, Records of Riverside County, and abutters rights of access
are hereby restored at the following described locations:
Easterly Driveway:
Commencing at the Northeast corner of Parcel 3 of said Parcel Map No.
31261; Thence, South 890 59' 11"West, 40.00 feet along the Southerly right
of way line of Ramon Road, 63.00 feet half width, as shown on said Parcel
Map No. 31261 to the True Point of Beginning;Thence, continuing South 891
59' 11" West, 13.29 feet along said Southerly right of way line of Ramon
Road to the Point of Terminus. Total length of restoration of abutters rights
of access equals 13.29 feet. (APN 673-020-0041)

Westerly Driveway:
Beginning at the Northwest corner of Parcel 1 of said Parcel Map No. 31261;
Thence North 89159' 11" East, 191.01 feet along the Southerly right of way
line of Ramon Road, 63.00 feet half width, as shown on said Parcel Map No.
31261 to the Point of Terminus. Total length of restoration of abutters rights
of access equals 191.01 feet. (APN 673-020-039)
b. The above described openings are to be utilized for ingress and egress from said
development on condition that the driveways to be constructed therein shall be improved in
a manner as approved by the City Engineer, and that they be maintained in good, safe,
and useable condition at all times.
SECTION 2. RECORDATION: The City Clerk is hereby directed to cause a
certified copy of this Resolution, attested by him/her under seal, to be recorded in the
Office of the County Recorder of Riverside County only upon the City Clerk's receipt of a
written instrument from the City Engineer certifying the following:
a. That the property owner has dedicated abutters rights of access to the City for the
following portions of the Ramon Road frontages of Parcels 3 and 5 of said Parcel
Map No. 31261:
(i) Beginning at the Northeast corner of Parcel 3 of said Parcel Map No. 31261;
Thence, South 890 59' 11"West 11.19 feet along the Southerly right of way
line of Ramon Road, 63 feet half width, as shown on said Parcel Map No.
31261, to the Point of Terminus. (APN 673-020-041)
(ii) Beginning at the Northwest corner of Parcel 2 of said Parcel Map No.31261;
Thence, South 890 59' 11"West 40.00 feet along the Southerly right of way
line of Ramon Road, 63 feet half width, also being the Ramon Road frontage
of Parcel 5 of said Parcel Map, to the Northeast corner of Parcel 1 of said
Parcel map No. 31261, also being the Point of Terminus(APN 673-020-043).
b. That the property owner has dedicated a portion of Parcel 1 of said Parcel Map No.
31261 to the City for street widening and a right turn deceleration lane, and that
such dedication includes the dedication to the City of abutters rights of access over
the portion of the new right of way line created by such dedication which is not used
for driveway purposes. (APN 673-020-039)
SECTION 3. EFFECTIVE DATE: This resolution shall become effective upon its
recordation in the office of the County Recorder of Riverside County.
