HomeMy WebLinkAboutCC Reso 2015-28 RESOLUTION NO. 2015-28 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY ESTABLISHING A RESIDENCY REQUIREMENT POLICY FOR CITY BOARDS COMMISSIONS AND COMMITTEES WHEREAS, the Cathedral City Municipal Code sets general rules regarding appointments, terms, vacancies, and addresses residency for Boards, Commissions and Committees members; and WHEREAS, the code states the following: Unless otherwise provided by law, or by Ordinance or Resolution of the City Council, all members of Boards and Commissions of the City appointed by the City Council shall be initially, and during their incumbencies, bona fide residents and registered voters of the City, except the licensed architect and landscape architect of the Planning Commission and two members of the Public Arts Commission, may come from throughout the Coachella Valley. No such member at or during such time shall be an employee of the City; and WHEREAS, on May 27, 2015 Council held a Study Session to discuss potential residency requirements for City Boards, commissions and Committees; and WHEREAS, during the Study Session held on May 27, 2015 the City Council directed Staff to prepare a Resolution establishing a Residency Requirement Policy for appointments to City Boards, Commissions and Committees. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY AS FOLLOWS: Section 1. The City Council of the City of Cathedral City hereby establishes a Policy that residency within City Limits of Cathedral City shall be a requirement for appointment to a City Board, Commission or Committee except in cases where the City Council deems it appropriate to appoint a nonresident to a board that has a need of specific expertise offered by a nonresident and required on an ongoing basis. Section 2. SEVERABILITY The City Council declares that, should any provision, section, paragraph, sentence or word of this resolution be rendered or declared invalid by any final court action in a court of competent jurisdiction or by reason of any preemptive legislation, the remaining provisions, sections, paragraphs, sentences or words of this resolution as hereby adopted shall remain in full force and effect.
